MAYOR & COUNCIL MEMBERS/ SUCCESSOR AGENCY/ITEMS FOR CONSIDERATION:

A. Consider Entering into an M.O.U. with Avenal Rotary Club for June 11, 2023, LANeva Jaripeo y Baile.

City Manager Lopez reported that The LaNeva Jaripeo y Baile is a new event spearheaded by Avenal Rotary to bring a new avenue of entertainment to the community, and potential revenue source to continue supporting Rotary’s non-profit activities. This event includes a portion of bull riding, and dance, with food and alcohol sales, booth vendors, and entry tickets. Attached is a flyer which details more about the event. Staff is seeking formal consent by Council to collaborate and commit resources to this event in collaboration with Avenal Rotary.

He continues that examples of potential resources being used are City facilities (which now have a charge to non-profits), staff time to help manage certain activities, advertising the event, and city equipment. The City is currently helping the event by offering ticket sales at City Hall. The largest contribution will be City equipment and staff time to prepare the Avenal Sports Complex for the event.

Staff has prepared a basic M.O.U. to be signed by both the City and Avenal Rotary Club to begin the process of more formally recognizing the collaboration between both the City and Avenal Rotary Club, and authorizing the waiving of fees for City facilities, and allowing the City’s participating in the event. In return, Avenal Rotary agrees to share 35% of its profits to the City. With Avenal Rotary managing the event, Avenal Rotary will provide insurance for the event. The subcontractors of the musical bands and bull riding will also provide their own insurance and indemnify the City and Avenal Rotary for their activities.

Staff is recommending, by motion, authorizing the City Manager to sign an M.O.U. with Avenal Rotary Club regarding the collaborations for the 2023 LaNeva Jaripeo y Baile. FISCAL IMPACT: Small loss in revenue by waiving the rental fees for City facilities and some staff time to prepare the facilities. In return, Avenal Rotary agrees to share 35% of its profits from ticket, food, and other relevant sales back to the City. As this is the first time an event like this takes place, potential revenues.

Councilman Hernandez motioned to authorizing the City Manager to sign an M.O.U. with Avenal Rotary Club regarding the collaborations for the 2023 LaNeva Jaripeo y Baile. Mayor, second by Mayor Preciado and carried.

A. Consider Approval for Kings County Behavioral Health to Reconstruct the Digital Signage on the Kings St/Skyline Blvd.

Intersection.

Humberto Bermudez, IT Manager reported that the Kings County Behavioral Health has begun an initiative to provide services within the City as requested by our community. A major factor of success for any organization within the City is outreach. Unfortunately, Avenal has historically struggled with this due to a lack of both effective digital and physical outreach methods. The Kings St./Skyline Blvd. intersection has a perpetual digital message of the City Council date and location and the City entrance on Highway 269 June 8, 2023 Pg. 7
Joint Meeting City Council/Successor Agency/PFA – May 25, 2023

Page 4 of 4 ends

currently has an unlit billboard which is only effective with both sunlight and large high-contrast text. Kings County Behavioral Health has reached out to the City proposing an offer to build digital signage as means of advertising. After several meetings and discussions between KCBH and City Staff, KCBH is hoping to focus on outreach to our residents through a large digital sign. From these discussions, Staff is recommending that KCBH focus on replacing the sign on the Kings/Skyline intersection.

Staff recommends by motion to grant Kings County Behavioral Health permission to replace the digital sign at the Kings/Skyline intersection. KCBH will work with the selected vendor, to have the new sign installed. After which, it will be the City’s responsibility to utilize and maintain the sign moving forward. Attached are four quotes which Staff is recommending KCBH to review and accept a version of. Staff is recommending a 4’ x 8’ sign which will be fully digital, front, and back. Staff is also following up with these vendors to purchase and replace additional signs across the City. From the ARPA funds, $300,000 had been allocated for these projects. Luckily this sign will not require any City funding.

Councilman Verdugo motioned to grant Kings County Behavioral Health permission to replace the digital sign at the Kings/Skyline intersection. KCBH will work with the selected vendor, to have the new sign installed. After which, it will be the City’s responsibility to utilize and maintain the sign moving forward, second by Councilman Hernandez and carried.

AGENDA ITEM NO. 5- B
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: June 8, 2023
RE: Ratify Reinvestment of Certificate of Deposit (CD) for a new five-year term through Multi-Bank Securities, Inc. (MBS).

INFORMATION:

In 2018, the City Council approved diverting $246,000 of Local Agency Investment Fund (LAIF), into a Certificate of Deposit (CD), to generate at a higher interest rate. At that time, the interest rates hovered just above 3%. As of April 2023, the CD matured and the City had the option to reinvest those funds once again.

With the help of the City’s banker at MBS, it was recommended the City elect to invest into a five year CD once again, taking advantage of record high interest rates. To date, it appears the market may contract in the coming months with interest rates stalling or coming slowly back down, making this the best time to invest money long-term.

RECOMMENDATION:

Due to the quick nature of CD offers MBS shares with the City, with deals changing daily, after having informed Council of the opportunity to reinvest the funds, chose a deal for a five year CD with San Francisco Credit Union, at 4.6% interest, which was offered on May 31, 2023.

Staff is requesting by Motion, the Council ratify the reinvestment of the CD funds for another five year term.

FISCAL IMPACT:

Staff calculates a five year CD at 4.6% coupon could generate close to $63,479.49 over the course of the five years, with interest rate payouts monthly.

HOW DOES COMMUNITY CHOICE ENERGY (CCE) OPERATE?
4 • Utility bills and collects from
customer on behalf of CCE, then
pays CCE for power supplied.
• CCE replaces Investor-Owned
Utility (IOU - e.g., SCE) as
purchaser of power for
customers.
• Utilities still responsible for
delivery of power to
customers.

June 8, 2023 Pg. 20
2 HOW DOES COMMUNITY CHOICE ENERGY (CCE) OPERATE? (CONT’D) 3 • All customers are “in” the CCE program
unless they actively “opt out.”
• CCEs design customer rates and have
greater flexibility than IOUs.
• CCEs eligible for state funding for
customer efficiency programs.
• CCEs typically buy more renewable
power.
• CCEs have greater regulatory flexibility
than IOU on buying power.
• CCEs receive customer revenues from
IOU, pay off operating expenses, retain
net revenues.
• CCEs can still work with
IOUs to develop reliable
electric grids in their
communities.

7 RECOMMENDED NEXT STEPS, TIMELINE
 Introduction, follow-up questions (ongoing)
 Discuss RFP with electeds, issue RFP for Turnkey Services (1 month)  Receive RFP responses, evaluate, award, execute contract (6 months)  includes time needed to respond to RFP
 Includes Feasibility Study Results
 Turnkey provider initiates all steps to create CCA
 Discuss Feasibility Study Results: Go, wait, or no-go point (3 months)  Deploy governance structure (3 months)
 Begin Start-up and Operations activities (ongoing)
 Agency adopts CCA ordinance, deploys governance structure (3 months)  Public Utility Commission mandatory waiting period (minimum 12 months)  Begin service
June 8, 2023 Pg. 26
8 OVERVIEW OF CCE FINANCIAL FEASIBILITY STUDY
 Can an individual local government (or group) CCE be financially feasible under a range of likely future operating conditions?
 Methodology: Conservatively estimate CCE revenues and costs and compare to Investor-Owned Utility  Determine power costs, non-power costs (e.g.; staff, consultants).  Determine needed CCE revenues to cover all costs.
 Establish rates – compare to IOU rates, if lower – CCE is viable.  Results of study will determine financial feasibility, emissions reductions, and local business and macroeconomic impact potential.
6 June 8, 2023 Pg. 27

HOW TO SET UP A CCE
“Turnkey Approach” provides all of these services under a single “team” of experts within a streamlined approach.

Can provide an RFP for market proposals.

Formation
 Load Data from Incumbent Utility Investor-Owned Utility for Feasibility Study  Feasibility Study/Business Plan (GO/NO GO)
 Form CCE/Ordinance then Form Governance (City, County, JPA w others) Operations
 Secure Start-Up Financing – the market for this is very fluid  Hire Start-Up Consultants, Staff – cities don’t run their CCEs initially  Arrange Billing/Payment Activities with Incumbent Utility  Consultant Buys Power, Manages Risk, Runs Operations
 Launch, serve customers
 Local electeds typically make up the governing board
5 June 8, 2023 Pg. 28

GOVERNANCE STRUCTURES
 Form an Enterprise Fund within Agency (Turnkey)
 Electeds are CCA Board
 Plenty of precedent
 Must check general fund liability
 Create Joint Power Authority - 2+ agencies (Turnkey)
 JPA provides liability shield for cities
 Leverage larger scale
 Less local control
 Join existing Joint Power Authority
 Set up work, expenses already invested
 Minimal to zero local control depending on JPA size (e.g., some CCA JPAs have 30+ members) June 8, 2023 Pg. 29
8 CCA FAQ
What is Community Choice Aggregation?
Community Choice Aggregation (CCA) is a program that enables city and county governments to pool (or aggregate) the electricity demand of their communities together for the purpose of supplying electricity. A CCA buys electricity on behalf of residential, commercial, and municipal electricity users in its jurisdiction. The electricity continues to be distributed and delivered over the existing electricity lines by the incumbent utility-which is Pacific, Gas, and Electric (PG&E) in San Mateo County.

Is a CCA a government agency or a separate organization? CCAs are public, non-profit agencies. It is important to note that all CCAs, once they are operational, are completely ratepayer funded and are not subsidized by taxpayer dollars. These ratepayer dollars previously went to the incumbent utility (PG&E), but would now be directed to the CCA. Any surplus funds generated by the CCA can be reinvested into the community in the form of either new energy projects and programs or lower rates. Surplus funding does not go into the general funds of the member cities/counties.

Why are so many local governments looking at CCA?
CCA provide communities with more local control over their energy supply. As a result, communities can choose to increase the amount of electricity procured from renewable sources, such as solar, wind, and geothermal. CCAs can also develop innovative energy programs tailored specifically for each community and support the development of local renewable energy projects. Finally, CCAs introduce competition into the energy market. Customers in a CCA jurisdiction can choose to stay with the CCA or go back to PG&E; it offers customers a choice where none currently exists.

What are the economic advantages of CCA?
CCAs can accelerate the development of local renewable energy projects, which can result in significant local job creation. In general, renewable energy facilities provide many more jobs per unit of investment than traditional natural gas and coal plants.

What are the environmental advantages of CCA?
CCAs can choose to purchase from and develop electricity sources that are more heavily weighted towards renewable energy. The production and burning of traditional energy sources, such as coal and natural gas, releases significant amounts of GHG emissions into the atmosphere. These GHG emissions are a leading cause of climate change. Renewable energy can provide electricity with little or no GHG emissions.

How does this relate to my city’s Climate Action Plan?
Many cities and counties now have “Climate Action Plans” that outline different measures that the city or county can take to reduce its GHG emissions and conserve its natural resources. In San Mateo County, electricity consumption is a significant contributor of GHG emissions. Joining a CCA is one way jurisdictions in the county can reduce their GHG emissions from electricity and meet their local climate goals.

Has this been done in other areas and what have been the results? There are two CCA programs up and running in California: Marin Clean Energy (MCE) in Marin County and Sonoma Clean Power (SCP) in Sonoma County. Both MCE and SCP offer their customers June 8, 2023 Pg. 30
10-30% more renewable energy than PG&E at prices that are competitive or even lower than PG&E prices. MCE and SCP are now actively building local sources of renewable energy in their communities and beginning to offer specialized energy efficiency programs. A third CCA in the City of Lancaster will begin serving customers this year.

If a CCA was formed in San Mateo County, what would be PG&E’s role? If a CCA was to form in San Mateo County, the CCA would be responsible for buying or generating all electricity required to meet the demands of its customers. Customers who chose to opt-out of the CCA would continue to have PG&E buy their electricity. All customers, whether they are a part of the CCA or PG&E, would continue to pay PG&E delivery charges and receive PG&E bills. The only difference between a CCA customer and PG&E customer is the charge for the generation of energy.

If the power goes out, will PG&E still fix a CCA customer’s outage problem? Yes, PG&E will still provide the same delivery and customer services regardless of whether that home or business is a CCA customer.

If I joined a CCA, would my electricity rates go up?
A technical study will examine the impacts of a CCA on rates, but so far CCAs have generally been around 5% lower than PG&E prices. This is dependent on the customer class and the particular CCA option each customer chooses. Current CCAs offer a “default” option that is cheaper than PG&E as well as a 100% renewable energy option that is slightly more expensive than PG&E. In addition, CCAs have the added advantage of price stability. While PG&E rates change several times a year, while CCA rates have generally only changed once a year, offering some measure of rate stability for CCA customers. While there is no guarantee that CCA rates will always be lower than PG&E rates, CCAs do have the advantage of being small, non-profit agencies that pay no shareholder dividends or income taxes like investor-owned utilities (such as PG&E) do.

How does a CCA procure electricity? A CCA must submit a plan to the California Public Utilities Commission (CPUC) that specifies how it will purchase 115% of the estimated electricity demand for its area for a period of one year. Once the plan is approved, CCAs negotiate the purchase of electricity for its service area on the open energy market by entering in power purchase agreements (PPAs) with energy providers. These PPAs can be long or short term, depending on the needs of the CCA and type of energy being provided. A CCA can also sponsor a bidding process whereby project developers can bid to build new electricity sources solely for CCA customers, which also ends in a PPA. CCAs have contracts with PG&E to transmit the electricity that the CCA buys over PG&E’s lines.

Do the electrons purchased or generated by the CCA actually go to my house? No, when we say that the CCA supplies power to customers, we mean that the CCA puts the same amount of electricity into the grid that its customers use. When the individual electrons from all power resources go into the grid, no one can determine which electrons go where. Think of it as depositing $100 in one ATM and taking out $100 in another. It’s not the same $100 bill, but it’s still your money. One can think of electricity in the same way. If you consume 500 kilowatt-hours in a month, the CCA must supply 500 kWH to the grid on your behalf. The advantage of a CCA is that what’s supplied to the grid on behalf of CCA customers can be cleaner than would otherwise be the case.

How is a CCA program set up? Local governments must pass an ordinance to join a CCA program, and the CCA agency must draft an Implementation Plan that is approved by the CPUC. This is June 8, 2023 Pg. 31
typically done after an initial technical study to determine the amount of electricity that will be required and examine if the potential CCA can price its electricity to be competitive with PG&E. The Implementation Plan outlines how the CCA will function, how it will set rates, how it will procure electricity, and how it will carry out all other functions required under CPUC regulations.

I have heard that CCAs are “opt-out” programs. What does that mean? When a county or city decides to create or join a CCA, all customers within that jurisdiction are automatically enrolled in the CCA. However, every customer can choose to opt-out and go back to the incumbent utility (which is PG&E in San Mateo County) for generation service (again, power delivery and customer service stay with PG&E) at any time. State law requires customers receive several notifications to opt-out for free just before and just after a CCA program launches. At any time after that initial launch period, a CCA customer can still go back to the incumbent utility’s service for a small fee.

What is the governance structure of a CCA?
There is no law regulating how the how the governing body a CCA should be structured, so each CCA is a little different. Most CCAs are governed under a Joint Powers Agreement by a Board of Directors. The Board of Directors is usually comprised of a representative from each member city (and the county) within the CCA jurisdiction. The Board sets the CCA’s policies and electricity rates. A CCA may also have a steering committee made up of representatives from other stakeholder groups, such as local businesses and community organizations. CCAs also have a small staff to run the day-to-day operations of the program and interface with CCA customers. The CCA process is designed to be very transparent with all meetings open to the public.

If I installed solar panels on my home or business, would I need a Power Purchase Agreement to sell our excess energy to a CCA?
No. The CCA would be able to offer property owners fair market rates for their excess energy production without a Purchase Power Agreement, even if that solar installation took place before the CCA launched. CCAs have been able to offer better net metering options for customers who generate surplus electricity, and those customers would automatically be enrolled into a CCAs net metering program, unless they choose to opt-out and return to PG&E.

TO: The Honorable Mayor and City Council
FROM: Griselda Price, Director of Administrative Services DATE: June 8, 2023
RE: Consider Fiscal Year 2022-2023 – End Budget Revisions INFORMATION:

As part of the auditing process, Staff must address and propose to the City Council fiscal budget year-end revisions which must be approved prior to June 30, 2023.

For the FY 2022/2023 budget, supply chain availability issues, inflation, major projects, and staff turn-over have adversely affected many accounts in ways not previously foreseen. Additionally, a software glitch from CentralSquare for the accounts receivables end have caused delays in accurately accounting revenues to the right accounts. Accordingly, staff will need additional time to reallocate budget amounts accordingly to reconcile revenues with expenditures.

Staff is requesting that the City Council authorize Staff to adjust the revenues at fiscal year-end to reflect the actual revenues received and adjust the expenditures within the budgeted funds and reallocate funds as necessary. Staff is also requesting authorization to adjust the revolving funds as needed throughout the year: Revolving Accounts consist of CDBG, HOME, CalHome, Grants, Recreation programs, Explorers, Police Activity League, etc.

RECOMMENDATION:

1. By motion, authorize the City Manager to utilize the department budgets in the best interest of the City, within the departments approved bottom line budgeted Fund amounts as per approved by the City Council, and further authorize the year-end Fiscal Year 2022/2023 budget revisions (revenues and revolving accounts) as needed and/or required after closure of Fiscal Year 2022/2023.

TO: The Honorable Mayor and City Council
FROM: Griselda Price, Director of Administrative Services DATE: June 5, 2023
RE: Consider Fiscal Year 2023-2024 – Appropriations Limit INFORMATION:

Article XIII B of the State of California Constitution places limits on the amount of revenue which can be spent by all entities of Government. To address the restrictions of the Article, and increase the accountability of government entities in adopting their limits, voters approved Proposition Ill in June 1990. Among other things, this Proposition provides new adjustment formulas which should make the Appropriation Limits more responsive to local growth issues. It also requires an annual review of Limit Calculations.

The City Council shall, each year by Resolution, establish an appropriations limit for the expenditure of so-called proceeds of taxes. The adoption of the Resolution must be at a regularly scheduled meeting of the City Council or at a noticed special meeting.

The Fiscal Year 2023/2024 Appropriations Limit is $4,307,231.82 and the budget estimate of revenues from the proceeds of taxes is estimated to be less than $1,500,000.00. Since the City's estimated revenues are $2,807,231.82 less than the limitations, it is safe to say we will not exceed our limit this year.

RECOMMENDATION:

1. It is staff's recommendation that the City Council establish the Appropriations Limit for Fiscal Year 2023/2024 by adopting the proposed resolution.

Dear Fiscal Officer:

Subject: Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code section 2227 requires the Department of Finance (Finance) to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2023, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2023-24. Attachment A provides the change in California’s per capita personal income and an example for utilizing the price factor and population percentage change factor to calculate the 2023-24 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.

Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit.

Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. The code section and the California Constitution can be accessed at the following website: http://leginfo.legislature.ca.gov/faces/codes.xhtml.

Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.

Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2023.

Please Note: The prior year’s city population estimates may be revised. The per capita personal income change is based on historical data.

If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2023-24 appropriation limit is:

Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2023-24 4.44
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2023-24 appropriation limit.
2023-24:

Per Capita Cost of Living Change = 4.44 percent
Population Change = -0.35 percent
Per Capita Cost of Living converted to a ratio: 4.44 + 100 = 1.0444 100
Population converted to a ratio: -0.35 + 100 = 0.9965
100

INFORMATION:

At the April 11, 1996 meeting, the City Council authorized staff to establish and implement a Capital Project Fund which would identify the Capital Project needs of the City and assist each department's budget for long term capital projects that could not normally be funded in a fiscal year.

Staff, at this time, is requesting Council's consideration and approval to transfer monies into the City of Avenal's CIP Fund for future capital improvements as noted in Exhibit "A".

Notation: Any expenditures/draw down requests would require Council's approval.

RE: Consider Proposed City of Avenal Budget for FY 2023/24; Consider Avenal Successor Agency/RDA Debt Obligation Fund FY 2023/24 Budget; and Consider Proposed Public Financing Authority (PFA) FY 2023/24 Budget INFORMATION:

The Public Hearing Notice to consider the proposed City of Avenal's FY 2023/24 Budget; proposed Avenal Successor Agency/RDA Debt Obligation Fund FY 2023/24 Budget; and, proposed Public Financing Authority (PFA) FY 2023/24 Budget was duly noticed and posted for the City Council's June 8, 2023 Regular meeting. Any new proposed "Fees and Charges" were also noted in the Public Hearing Notice; however, there are no "Fees and Charges" proposed at this time as part of the FY 2023/24 City Budget.

The Avenal City Council noticed and held two (2) FY 2023/24 Budget Workshops in order to review all departments/funds including fund revenues and fund expenditures with City Department Heads and Management Staff. As part of the review process and associated discussions, the following concerns were discussed: the possibility that certain General Fund revenues such as property tax revenues could be decreased or delayed, how the budget continues to be impacted due to the COVID-19 related issues such as supply chain availability and inflation. Staff turnover and shortages also have contributed to the readiness of the budget.

RECOMMENDATION:

The City, Successor Agency/RDA and Public Financing Authority are required to have adopted budgets in place by July 1, 2023. Due to uncertainties as noted above, Staff is recommending the following: 1) continue the Public Hearing(s); 2) adopt FY 2023/24 Operating Budgets by Resolution (City, Successor Agency/RDA & Public Financing Authority); 3) continue monitoring activity that could affect the City's finances over the next few months; and, 4) resume review of the budgets during the first quarter of the fiscal year. **Resolutions for consideration to adopt Operating Budgets are attached.
