They ran with it his family built a sleigh and they delivered to most of the kids in this community told me you were there. You folks were there, and it was a great event, and they did that event not because we wanted social media attention, not because we wanted to make it seem like we had changed our department was better. It's because it's the right thing to do. Mr. Mendez was told that it's all about building trust and building a relationship with this community and that is exactly what Mr. Mendez dedicated himself on doing. After the sensory thing, Mr. Mendez went on to teach the Citizens Police Academy for Spanish speaking residents, our first one here in Avenal. Chief Nevarez vision, but his not too proud to say that he put that together by himself with the assistance of nobody else. It was the Chief’s vision, but Mr. Mendez did it along covering his shift as a supervisor. That first Citizens Police Academy was a success. They graduated the second class from the Citizens Police Academy. We go back a little bit that August 10, 2023 Pg. 6

The City of Avenal’s Economic Development has the opportunity to join the Kings- Tulare Valley California Economic Resilience Fund (CERF) program. 1 TRANSFER OF OWNERSHIP, AND

WAIVER, RELEASE AND INDEMNITY AGREEMENT
(Avenal Police Department, Police Service Dog Retirement) This Agreement is made and entered into this __ day of _____, 2023, (“Effective Date”) by and between the CITY OF AVENAL, a municipal corporation, hereinafter referred to as “City” and TYLER STRYD, an individual, hereinafter referred to as “OWNER”

RECITALS
WHEREAS, the City has determined that the City’s police service dog, known as “Gunnar” (“K-9”) is seven (7) years old, and ordinarily after approximately six (6) years of service with the Avenal Police Department (“APD”) should be retired; and WHEREAS, OWNER has been the sole handler of this K-9 through his employment as a sworn peace officer with the APD; and
WHEREAS, the K-9 was trained to perform certain police work and has in fact performed services for APD. Because of such training and work experience, if not properly handled, the K-9 is potentially dangerous and may cause serious bodily harm. The K-9 received numerous hours of K-9 training during its service to APD and OWNER, as its handler, actively participated in most if not all of such training; and WHEREAS, APD has determined that given the K-9’s age, its value as a police service dog has now completely depreciated and ownership of, and full responsibility for, the K-9 should be humanely euthanized or otherwise transferred to a qualified handler who can and will safely care for the K-9 and prevent it from behaving dangerously toward any person whomsoever; and
WHEREAS, OWNER has expressed that he is qualified to safely care for the K-9 and prevent it from behaving dangerously toward any person whomsoever, and expressed a desire to acquire full ownership of and full responsibility for the K-9, fully releasing the City from any further obligation to maintain the K-9 and from all responsibility for the conduct of the K-9.

SPECIFIC TERMS
NOW, THEREFORE, it is agreed by and between the parties hereto as follows:

Section 1. The City, as owner of the K-9, hereby transfers full ownership of, and full responsibility for, the K-9 to OWNER. The City hereby transfers absolute legal ownership and possession of the K-9 to OWNER in return for the commitment of OWNER to assume full and complete responsibility for the future care, maintenance and behavior of the K-9.

August 10, 2023 Pg. 17
2 Section 2. OWNER acknowledges, understands and agrees to the following:
(i) K-9 was trained and used as a police service dog; (ii) K-9 was trained to bite and restrain people under certain conditions or situations; (iii) during his service, K-9 bit and injured people and personal property but only upon command; (iv) K-9 is now being retired from service and will no longer be used in law enforcement by the APD; (v) because of K-9’s training and history, K-9 requires special handling and care to ensure no person or property is bit, mauled and/or injured during my ownership of K9 and at all times thereafter; (vi) the City of Avenal does not make any representation, warranty or guaranty that K-9 will not bite and injure, or attempt to bite or injure any person(s) in the future, nor that K-9 will behave in any particular manner; and (vii) upon transfer of ownership of K-9, OWNER will from that point onward be solely and completely responsible for each and all actions of K-9, even if OWNER subsequently transfers ownership of the K-9 to another person.

Section 3. OWNER agrees to provide all necessary care and maintenance for the K-9 at OWNER’s sole expense, including but not limited to the following:
(i) all nutritional, medical and behavioral training services and maintenance necessary for the health and safety of both the K-9 and each and all persons who come into contact with the K-9;
(ii) to restrain and house K-9 in a secure kennel constructed in a manner which is certain to prevent the K-9 from escaping into any area where it can harm any person whomsoever;
(iii) no later than thirty (30) days after OWNER observes or is notified by anyone of any act or potential act of aggression toward any person by the K-9, the OWNER shall immediately notify the City in writing of each all details of the same and must complete each and all of the following:
(a) have the K-9 complete a comprehensive behavioral evaluation for retired police dogs from a professional police dog trainer (whose qualifications are acceptable to the City in its sole and absolute discretion);
(b) provide accurate information to, and obtain a written certification or sworn opinion from, a professional police dog trainer (whose qualifications are acceptable to the City in its sole and absolute discretion), that the K-9 does not appear to present any threat to the public at this time; and
(c) provide written proof to the City, which is acceptable to the City in its sole and absolute discretion, of all evaluations, retirement training and certifications or sworn opinions.

August 10, 2023 Pg. 18
3 In the event this Section (3)(iii)(a-c) is not satisfied, the parties agree that the K-9 must either be returned to the City, at the sole expense of OWNER, as a full transfer of ownership back to the City upon City’s receipt of the K-9, or alternatively, be humanely euthanized by OWNER no later than fourteen (14) days after the deadline specified above, or any extension thereof which is mutually agreed upon by the parties in a signed writing.
(iv) to provide all special handling and care necessary to ensure that no one is bitten and/or otherwise injured during OWNER’s ownership of the K-9 and at all times thereafter, even if OWNER subsequently transfers ownership of the K-9 to another person;
(v) to refrain from handling or otherwise utilizing K-9 for any purpose which is within the scope of training for police services; and
(vi) to assume total and complete risk of personal injury, death and/or property damage arising or allegedly arising during OWNER’s ownership and/or control of K9 and at all times thereafter, including after each and all further transfer(s) of ownership of the K-9 thereafter, if any.

Section 4. OWNER agrees to, and shall release, indemnify, hold harmless and defend the City of Avenal, the Avenal Police Department and its officers, officials, agents, employees and volunteers (collectively “CITY”) from and against each, any and all loss, liability, costs and damages (whether in contract, tort or strict liability, including but not limited to personal injury, death at any time and property damage) incurred by CITY or any other person, including OWNER, and from each, any and all claims, demands and actions in law or equity (including attorneys’ fees, paralegals’ fees, legal expenses, expert witness fees), arising or alleged to have arisen during and/or as a result of OWNER’s ownership of K-9, and for each breach of this Agreement. CITY shall be reimbursed for any and all such fees and costs incurred by CITY in enforcing this Agreement and/or any and all litigation which in any way relates to this Agreement or K-9.

Section 5. It is the intent of this Agreement that the CITY shall have no responsibility or financial liability resulting for any future action of the K-9 and that OWNER shall be fully and solely responsible for the K-9’s wellbeing and behavior upon City’s transfer of ownership to OWNER of the K-9, including during and after each and all further transfer(s) of ownership of the K-9 thereafter, if any.

GENERAL TERMS
Section 6. This Agreement shall be binding upon City and it successors and upon OWNER and his heirs, executors, administrators and assigns.

August 10, 2023 Pg. 19
4 Section 7. This Agreement shall be interpreted and governed under the laws of the State of California without reference to California conflicts of law principles.

The parties agree that this contract is made in and shall be performed in the City of Avenal, California.

Section 8. The recitals and the exhibits to this Agreement are fully incorporated into and are integral parts of this Agreement.

Section 9. This Agreement represents the entire agreement between the parties hereto as to its subject matter and no prior oral or written understanding shall be of any force or effect. No part of this Agreement may be modified without the signed and written consent of both parties, with specific reference to this Agreement.

Section 10. This Agreement reflects the contributions of all undersigned parties and accordingly the provisions of Civil Code section 1654 shall not apply to address and interpret any alleged uncertainty or ambiguity.

Section 11. This Agreement may be executed in two or more counterparts, and by facsimile, all of which shall be considered one and the same agreement.

Section 12. This Agreement is subject to all applicable laws and regulations.

If any provision of this Agreement is found by any court or other legal authority, or is agreed by the parties to be, in conflict with any code or regulation governing its subject matter, only the conflicting provision shall be considered null and void. If the effect of nullifying any conflicting provision is such that a material benefit of the Agreement to either party is lost, the Agreement may be terminated at the option of the party whose material benefit(s) is adversely affected. In all other cases the remainder of the Agreement shall continue in full force and effect.

RETIREMENT OF A POLICE

SERVICE DOG FROM THE AVENAL
POLICE DEPARTMENT.

RESOLUTION 2023-_34__

The K-9 received numerous hours of K-9 training during its service to APD and OWNER, as its handler, actively participated in most if not all of such training; and WHEREAS, APD has determined that given the K-9’s age, its value as a police service dog has now completely depreciated and ownership of, and full responsibility for, the K-9 should be humanely euthanized or otherwise transferred to a qualified handler who can and will safely care for the K-9 and prevent it from behaving dangerously toward any person whomsoever; and
WHEREAS, OWNER has expressed that he is qualified to safely care for the K-9 and prevent it from behaving dangerously toward any person whomsoever, and expressed a desire to acquire full ownership of and full responsibility for the K-9, fully releasing the City from any further obligation to maintain the K-9 and from all responsibility for the conduct of the K-9; and
WHEREAS, in conjunction with the City’s insurance and risk management carrier, CSJVRMA, any party wishing to adopt the City’s police service dog is required to fill out an adoption application.

AGENDA ITEM NO. 6-B
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: August 10, 2023
RE: Consider Changing the Date of the September 28, 2023 Regular City Council Meeting to accommodate Fresno Area Hispanic Foundation event on same day INFORMATION:

The Fresno Area Hispanic Foundation (FAHF) has reached out to City Staff requesting to host a special event for community members and business owners in Avenal. The event will be a resource fair coupled with raffles and prizes for participants. The FAHF intends to provide cash prizes and grants to local businesses that could total over $10-15k to the community.

Tim Rios is a major sponsor of the FAHF on behalf of Wells Fargo Bank, and intends to be at the event in person to hand out the prizes. The FAHF is requesting the evening of September 28, 2023 to host the event. This date conflicts with the City’s second council meeting scheduled for that date.

RECOMMENDATION:

Staff is recommending, a discussion to either move the September 28, 2023 City Council meeting to another date, or cancel said meeting. Staff is also working with Reef-Sunset Unified School District to potentially host the event at one of the high school gyms to accommodate the large crowd that is expected.

AGENDA ITEM NO. 6. C
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: August 10, 2023
RE: Discussion on filling two (2) Vacant Planning Commission Seats INFORMATION:

As of August 7, 2023, the Planning Commission has two vacancies. Former Chair, Lymari Larios, handed her resignation due to moving out of the City on July 28, 2023. Commissioner Donna Elliott, has also indicated her intention to step down from the commission effective August 8, 2023.

This creates two vacancies in the Planning Commission, which will require two new appointments by the Council. Per the rotation, Councilmembers Gravelle and Verdugo have the next opportunities to appoint a commissioner.

Staff is able to advertise the vacancies and bring any new applications back for Council’s consideration at the September meetings.

STUDY SESSION
TO: Honorable Mayor and Council Members
FROM: Kao Nou Yang, Director of Community and Economic Development DATE: August 10, 2023
SUBJECT: STUDY SESSION – GIS WEB TECH PRESENTATION FOR ECONOMIC

DEVELOPMENT TOOL FOR SITE SELECTION
BACKGROUND:

The City of Avenal has made Economic Development and Growth a priority for the past 15 years.

One of the main City Council goals was to bring more attention and resources to Economic Development, therefore staff were directed to reach out and find strategic ideas to bring more growth and sustainability to the community.

The City’s Economic Development Plan was adopted in 2017 and laid out recommendations and policies that were adopted as part of the General plan to be implemented and executed. Policy

4.2.5 Business Attraction states that “Collaborate with real estate brokers, property owners, and other stakeholders to create and maintain an inventory of buildings and sites available for economic development.,” and Policy 4.8.3 also states “Prioritize economic development activities that will lead to jobs that provide career opportunities and living wages.” These two policies are very important to understanding the need and marketing of the city to grow economically and be able to sustain its revenue generation. With these two policies in mind, city staff has looked into many new resources and strategic planning software to help market the city and provide data and resources to potential developers, business owner, business leaders and interested parties.

One of those strategic planning software is GIS WEBTECH Services. City Staff have requested for the company to present a demonstration and a proposal to City Council with their product. This product not only addresses site selection and marketability, but it always provides data in one location such as demographics, travel time, generations of vehicles/ pedestrian, information that all developers, business owners, interested parties are looking for.

This Agenda item along with the proposal attached was sent to the City Manager Antony Lopez and Director of Administrative Services Griselda Price for review.
