A. Consider Approval and Adoption of the Kings County Multi-Jurisdictional Hazard Mitigation Plan.

Alex Mena, Emergency Services Coordinator and Chief Resilience Officer for Kings County Office of Emergency Services.

Lopez reported that the purpose of the hazard mitigation plan is to reduce or eliminate long-term risk to human life, property, and infrastructure by minimizing the impact of disasters. The County of Kings, alongside the involved jurisdictional cities of Avenal, Corcoran, Hanford, and Lemoore, have developed this multijurisdictional hazard mitigation plan to reduce future losses to the county and its communities resulting from any natural or man-made disaster. The plan meets the requirements of the Disaster Mitigation Act (DMA) of 2000 (Public Law 106-390) and achieves eligibility for the Federal Emergency Management Agency (FEMA) Grant Program.

AVENAL’S PORTION OF THE PLAN: This Annex summarizes the hazard mitigation elements specific to the City of Avenal. The Annex supplements the Kings County Multi-Jurisdictional Hazard Mitigation Plan (MJHMP); therefore, the Annex is not a stand-alone plan but is intended to supplement the hazard information provided in the Base Plan document.

All other sections of the Kings County MJHMP, or Base Plan, including the sections on the planning process, countywide risk assessment, and procedural requirements related to plan implementation and maintenance apply to the City of Avenal.

Key Elements in Avenal’s Portion: • Community Profile: Detailed information on the City’s profile, including geography, climate, history, and economy. • Risk Assessment: Assessment of hazards specific to Avenal, including flood, drought, earthquake, extreme temperatures, and public health hazards. • Mitigation Strategy: Customized mitigation actions and projects specific to the City of Avenal, developed by the City’s Local Planning Committee (LPT). • Critical Facilities and Infrastructure: Identification and assessment of critical facilities within the City of Avenal. • Development Trends and Future Planning: Information on development trends, future growth, and how the City plans to manage potential hazards. The City of Avenal is committed to working with Kings County and other jurisdictions to implement the mitigation strategies outlined in the plan to protect its residents and enhance the community’s resilience to disasters. By approving this plan, should there ever be a major disaster in Avenal, FEMA would be able to a grant a greater percentage of fiscal assistance to the City. This also continues the bond and communication City Staff has with County Staff. ACTION REQUESTED: Approve by motion.

Moses Diaz, City Attorney asked if there was a need for a written resolution on this approval? Parties, are the minutes fine? Mr. Mena stated yes, because they send it to FEMA and that's one of the conditions.

City Attorney Diaz recommended that if the City Council approve by motion to authorize the signing of a resolution 2024-25 to Approve the Adoption of the Kings County Multi-Jurisdictional Hazard Mitigation Plan.

After a brief, discussion the following action was taken.

Councilman Verdugo motioned to approve Adoption of the Kings County Multi-Jurisdictional Hazard Mitigation Plan and authorize the signing of a resolution. 2024-25, seconded by Councilman Hernandez and motion carried.

AGENDA ITEM NO. 5.- B
TO: The Honorable Mayor and City Council
FROM: Humberto Bermudez, IT Manager
DATE: June 13, 2024
RE: Consider Approval to Purchase One (1) Digital Poster Board for Kings/Skyline
BACKGROUND:

At the recent City Council meeting, the agreement with the County of Kings for digital signs was approved. Following this approval, we are now presenting the quotes for the signs themselves. As per the agreement, the City is receiving $100,000 for the purchase of two signs. The plan is to place these signs at two locations in Avenal: one to replace the existing sign at Kings Street and Skyline Boulevard, and the other as a new sign at the entrance of Avenal, on Hydril/Skyline at Elliott Park.

We are presenting the replacement sign first, as we are still awaiting quotes for the second sign with Staff having requested it to be larger than originally planned.

We have received two quotes for the first sign (Attached):

1. Golden Rule Signs: $37,875.00 for a 4’ x 6’ LED sign.

2. A-Plus Signs: $62,653.58 for a 4’ x 6’ LED sign.

We were also awaiting a third quote from SignWorks, which did not submit a quote or bid within the requested timeframe.

RECOMMENDATION:

Staff recommends proceeding with the purchase of the 4’ x 6’ LED sign from Golden Rule Signs for $37,875.00. This recommendation is based on the competitive pricing and specifications that meet our requirements.

FISCAL IMPACT:

The purchase will be funded through the $100,000 allocation from the County of Kings as per the approved agreement. Any additional costs or quotes for the second sign will be presented at a future meeting.

By motion, approve the purchase of the 4’ x 6’ LED sign from Golden Rule Signs for $37,875.00.

Golden Rule Signs, Terms and Conditions of Sale v5117

1.0 Basis of Sale
No variation to these Conditions shall be binding unless agreed in writing between authorized representatives of the Buyer & Seller. For this Contract, authorized representatives of the Buyer and Seller shall refer to individuals who have been expressly designated in writing by the respective party, with the authority to negotiate and enter into agreements on their behalf. Additional, different, or inconsistent terms or conditions proposed or received from Buyer, including without limitation, any additional, different, or inconsistent terms or conditions in Buyer’s request for proposals or order, are hereby rejected and shall not be a part of the parties’ contract. Seller’s commencement of any work or delivery of any goods does not constitute acceptance of or consent to any additional, different, or inconsistent terms. Changes in orders must be requested by Buyer in writing. No changes shall be binding on Seller unless specifically agreed in writing and signed by Seller. Seller is not liable or responsible for any delays caused by Buyer’s changes in orders. Sales literature, price lists, and other documents issued by Seller about the Goods are subject to alteration by Seller without notice, do not constitute offers to sell the Goods which are capable of acceptance, and do not constitute a part of this Contract unless the parties otherwise expressly agree in writing. Typographical, clerical, or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice, or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.

2.0 Orders, Specifications & Permits
The Buyer's signed quote form will include all specifications of the order, products, and services provided by the Seller, such as shipping, installation, permitting, training, custom artwork, and design. Any items not listed on the quote are not included in the Goods' specifications. Seller does not provide/run electrical or grounding – this is a Buyer responsibility unless otherwise specifically stated on the signed quote form. No order that has been accepted by the Seller may be canceled by the Buyer except by an agreement in writing from the Seller and with the understanding that the Buyer shall indemnify the Seller in full against all loss (including loss of profit), costs (including the cost of all labor and materials used), damages, charges and expenses incurred by the Seller. Up to $350 in local zoning sign permit fees are included for projects where the Buyer has purchased installation service from the Seller. Permit fees above $350 are the sole responsibility of the Buyer unless the entirety of permit fees are included as a line item in the order. The Seller may, at its option assist in providing drawings, sketches/renderings, or technical information. If applicable, permit-related fees, such as acquisition fees, are added to the balance invoice unless included as a line item price. If a variance process is required to obtain a permit, a change order confirmation will be requested. Any required core samples, engineered drawings, inspections, architect reviews, or additional certifications/tests requested or required by the Buyer or the Buyer’s local government are the financial responsibility of the Buyer and will be added to the final invoice. If for any reason the local governing authorities (be it city, county, or state planning/zoning, permit office, building inspections etc.) deny the permit application, Buyer is conclusively responsible for all costs incurred. Rock and uncommon conditions clause: If the site soil or rock conditions are such to prevent normal excavation and construction, Buyer is responsible for additional charges if incurred. Buyer will be notified if the scope of work changes due to engineering or zoning requirements; including but not limited to footer size change, use of structural forms, water pump-out, rock or sediment requiring removal, site access, or additional machinery outside of the typical and reasonable scope. Buyer is responsible for all charges which will be reflected in the balance invoice. If Seller is to utilize a client's existing support structure when installing a sign, it is hereby known that Seller has no knowledge of the depth, size, or integrity of the footer below grade or materials/methods used to construct or quality of the existing support structure. As such, Buyer agrees to hold Seller harmless and void of all liability as it relates to any existing support structures or footers.

3.0 Terms of Payment Payment to Seller
Terms of Payment to Seller are specified on the Quote. If the Buyer is paying through installments, “due on or before” dates will be set forth on the Quote. Any payments that are past due by 7 or more calendar days shall be assessed a $50 late fee. In addition, any payments that are past due by more than 30 calendar days shall bear interest at a rate equal to the lesser of (a) one and one-half percent (1.5%) per month or (b) the maximum permitted by law. Noncompliance with payment terms or any other failure by the Buyer to observe, perform, and be in compliance with the terms and conditions of this Contract, will be a breach of contract by the Buyer. In that event, (a) Seller may exercise all rights and remedies available to it at law or in equity, and title to the Goods shall revert to the Seller, and (b) the Buyer waives all rights to the Goods and services that were to be provided as well as monetary damages. If Seller hires an attorney to represent it in any dispute in any way related to this Contract, Buyer expressly agrees to pay all legal fees and costs incurred by such attorney in such a matter.

4.0 Delivery
The date of delivery of the Goods may vary due to the nature of manufacturing custom signage. Estimated delivery/installation dates are estimations. Seller shall be held harmless if the estimated delivery/installation date is exceeded. Buyer is responsible for any increased installation costs due to delays caused by Buyer (lack of access to site or personnel during the planned visit, delivery or installation, undisclosed underground lines, or unprepared site provisions or customer-caused delays). Shipping terms are FOB Plant. If Goods are shipped directly to Buyer, Buyer is solely responsible for any damage during shipping. Buyer is advised to examine the crate and Goods before accepting and rejecting any damaged shipment. This does not apply to projects where a Seller contracted installer is receiving Goods.

5.0 Assignment of Manufacturer’s Warranties
Seller hereby assigns to Buyer, to the extent assignable, all manufacturer’s warranties and service agreements with respect to the Goods, if any, for the purpose of making appropriate claims against the manufacturer, provided that the Seller shall retain at all times the right to be protected by these warranties, agreements, and indemnities.

6.0 Legal
Buyer represents and warrants that it is duly authorized to enter into this Contract and that this Contract constitutes its legal, valid, and binding obligation, enforceable in accordance with its terms. It is the responsibility of the Buyer to ensure that this purchase and signing of this contract is compliant with the Buyers protocol and procedures. This contract shall be governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of laws principles. The parties hereby irrevocably submit to the exclusive jurisdiction of the Federal and State courts located in Shelby County, Kentucky regarding the interpretation and enforcement of this Contract and the transactions contemplated hereby and hereby waive and agree not to assert as a defense that it is not subject thereto or that any such action may not be brought or maintained in such courts or that such venue may not be appropriate or convenient. This Contract constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes all other agreements, previous contracts for this signage, understandings, representations, and warranties both oral and written with respect to such subject matter. - END OF DOCUMENT -

Fixed Charge Proposal- Adopted May 9, 2024
The fixed charge proposal will decrease electric bills for lower-income residential customers, improve bill transparency and predictability and advance clean energy goals.
• California Assembly Bill 205 (AB 205) requires the California Public Utilities Commission (CPUC) to adopt or expand fixed charges based on income. • In April 2023, multiple stakeholders submitted a range of proposals to the CPUC to separate fixed infrastructure costs and cost of electricity on residential electric customers’ bills.
• In March 2024, the CPUC issued a Proposed Decision in the fixed charge proceeding.

Background

Public 4
Fixed Charge Proposal
How will this proposal change customer bills?
The CPUC's Proposed Decision changes the way electric bills are structured. It recommends a fixed monthly infrastructure charge divided by tiers and an electricity usage charge. The Proposed Decision does not include any new requirements for income verification. This reallocation of the way costs are billed means that the price for a unit of electricity will be lower for all customers, regardless of income or location.
