Adam Sass explained that Cal Net would establish its own infrastructure, likely installing two towers. Councilmember Verdugo asked whether the company had secured grants for the project to avoid using City funds. Adam Sass responded that they would assist in identifying grant opportunities. City Manager López added that the goal is to ensure uniform access across all City sites while providing services to the community, and Cal Net has been instrumental in making this initiative possible. Mayor Preciado emphasized the importance of moving forward with the project as soon as possible. IT Director Bermudez explained that the search for a dedicated wireless service stemmed from connectivity issues at the Police Department and ongoing reliability concerns with AT&T. Mayor Pro Tem Gamez asked whether other companies had been considered. IT Director Bermudez stated that discussions with AT&T have resumed to explore service improvements, but pricing information has not yet been provided, and their services would be limited to City operations rather than the broader community. OLD BUSINESS:

A. SRO Agreement with RSUSD (Discussion/Action).

City Manager López stated that the City remains committed to continuing its collaboration with the school district. He noted that the district assisted with the Confía event, which was attended by Superintendent Ruiz. Additionally, as a Rotary Club member, Superintendent Ruiz will support Old Timers Day by facilitating school participation. Regarding the School Resource Officer (SRO) program, there were no updates from the last meeting. The SRO is scheduled to begin at the high school in the next academic year. It was noted that School Board Member Eddie Maldonado has stepped down, with this information obtained through non official social media. The implications for the school board, including potential appointments or a reelection process, remain unclear. Mayor Preciado requested drafting a letter to the school district to formally propose resuming joint meetings, as had been done in the past.

NEW BUSINESS:

A. Consider Approval of Agreement with Flock Group Inc. for Citywide ALPR Camera System Funded by COPS Funds (Discussion/Action).

Chief Velasco presented his request as submitted and provided additional context by sharing his experience as a homicide investigator in Delano. He explained that implementing new technology significantly improved public safety, making Delano one of the safest cities. He also shared a tentative map outlining the proposed placement of cameras, emphasizing that these cameras would provide actionable leads and serve as a strong deterrent to crime. He gave multiple examples of how Flock cameras have been successfully used in Delano and other cities, highlighting their ability to communicate within law enforcement systems.

Councilmember Verdugo noted that he has seen media reports on the effectiveness of Flock cameras and how they have helped improve public safety. Chief Velasco acknowledged that privacy concerns were initially raised in Delano but reassured the council that laws are in place to protect privacy, and law enforcement determines who can access the data. He emphasized that these cameras collect unbiased evidence. Mayor Preciado inquired about the range of each camera. Chief Velasco directed the question to guest Jonathan Paz (FLOCK technician), who responded that the cameras focus on vehicles and can cover approximately one and a half lanes. Mayor Preciado also suggested engaging with neighboring communities to encourage them to adopt the Flock system. He added that if funding is available through COPS grants, the project would be financially feasible.

Chief Velasco stated that establishing a secure perimeter would be beneficial and noted that the cameras do not require additional infrastructure. Mayor Pro Tem Gamez asked about the cost and number of cameras. Chief Velasco responded that the pricing covers a two-year period and would provide enough cameras to monitor key exit areas. Mayor Pro Tem Gamez also inquired about the location of Flock's offices. Jonathan Paz stated that their headquarters are in Atlanta, but they have numerous technicians in California to provide support. Mayor Pro Tem Gamez asked whether Flock would supply the poles for the cameras. Chief Velasco confirmed that they would. Mayor Preciado inquired about the timeline for installation. Jonathan Paz explained that the timeline depends on permitting but estimated that installation would take a few months.

B. Review Backyard Chickens Application Process and Adopt Associated Fees (Discussion/Action).

April 10, 2025 Pg. 8
City Clerk Maria Ortiz presented the staff report and application as submitted. Mayor Preciado noted that while many residents are interested in having backyard chickens, the cost and regulatory requirements may be a concern. City Manager López clarified that the guidelines provided are recommendations, not requirements, such as the suggested height for coops. He also acknowledged the length of time this process has taken. Legal Counsel Moses Diaz stated that an ordinance is already in place governing backyard chickens. Councilmember Hernandez inquired about the possibility of a payment plan, similar to the structure used for water bills. Councilmember Verdugo commented that if residents are truly interested in keeping chickens, they could save up for the associated costs. City Clerk Ortiz added that since the application process is conducted through OpenGov, residents should be prepared to complete the application in full. Mayor Pro Tem Gamez asked how potential nuisances to neighbors would be addressed. City Manager López explained that mitigation measures include prohibiting roosters and conducting random inspections. Legal Counsel Moses Diaz further noted that civil nuisance laws also apply in cases where backyard chickens cause disturbances.

AVENAL ADOPTING A BACKYARD CHICKENS APPLICATION PROCESS AMENDING

NOES: None.

ABSENT: None.

D. Consider Approval to Enter into Interlocal Agreement with City of Hanford for Shared CLETS Line Access
Chief Velasco presented his report as submitted. He emphasized that approving the new system would enhance efficiency within the department, as the current system requires officers to rely on pen and paper, which is not ideal. Legal Counsel Moses Diaz noted that he previously represented Corcoran in a similar agreement, and his law partner assisted Avenal, potentially creating a conflict of interest. By approving this agreement, the Council would effectively be waiving that conflict. He also clarified that the agreement is a cost-sharing arrangement, which appears to be equitable. He stated that he wanted the Council to be fully informed before proceeding.

RESOLUTION 2025-22: AUTHORIZING THE CITY OF AVENAL TO ENTER INTO AN INTERLOCAL AGREEMENT FOR SHARED CLETS LINE ACCESS.

TO: The Honorable Mayor and City Council
FROM: Karla Curiel, Deputy City Clerk
DATE: April 10, 2025
RE: Consider Entering into a Comprehensive M.O.U. with Avenal Rotary Club for Use of City Facilities and Resources
INFORMATION:

For many years, the Avenal Rotary Club has been a key partner in organizing and hosting significant community events in the City of Avenal. Their events have become staples of Avenal's culture and long-lasting traditions, including the annual Pistachio Days Festival which aided in Avenal becoming officially trademarked as the Pistachio Capital of the World® since 2019, and Old Timers' Day which celebrates the heritage and history of our community.

Currently, Avenal Rotary Club is preparing to host the annual Old Timers' Day scheduled for May 3rd, 2025. This event traditionally includes activities such as a parade, community dinner, recognition of long-time residents, and various family-friendly activities that bring together multiple generations of Avenal residents.

While the City has historically collaborated with Avenal Rotary Club on these community events on a case-by-case basis, Staff is proposing to formalize this relationship through a comprehensive Memorandum of Understanding (MOU) that would cover all Rotary-sponsored events throughout the year. This approach would streamline administrative processes and provide a clear framework for the ongoing partnership between the City and Rotary.

The proposed MOU would:
• Establish a streamlined process for Rotary to request use of City facilities • Waive reasonable facility use fees for Rotary-sponsored community events • Define staff assistance parameters for Rotary events
• Outline reciprocal support from Rotary for City-sponsored events • Establish insurance and liability requirements
• Create a structured record-keeping system for tracking contributions • Be effective for three years with automatic one-year renewals thereafter This comprehensive agreement would replace the need for individual MOUs for each event, such as the one previously established specifically for the Pistachio Days Festival. The agreement would apply to all Rotary-sponsored community events, including but not limited to Pistachio Days Festival, Old Timers' Day, and any other community activities organized by Rotary throughout the year.

RECOMMENDATION:

Staff recommends authorizing the City Manager to sign a comprehensive M.O.U. with Avenal Rotary Club regarding collaborations for year-round use of City facilities and staff for community events, including the upcoming Old Timers' Day and the annual Pistachio Days Festival.

FISCAL IMPACT:

Minor loss in revenue from waiving rental fees for City facilities, which is offset by the community benefit of these events and reciprocal volunteer support from Rotary for City-sponsored activities. The City's Community Activities budget already accounts for support of these annual community events.

RE: Proclamation - Autism Awareness & Acceptance Month 2025 INFORMATION:

Staff is pleased to once again present support of the proposed proclamation for the City of Avenal to declare April 2025 as Autism Acceptance and Awareness Month. This initiative is not just a formal declaration; it symbolizes our city's commitment to fostering an inclusive and supportive community for all its members, especially those affected by autism.

Background and Importance
Autism affects approximately 1 in 36 children, cutting across all demographic lines. This complex condition presents both unique challenges and strengths. Recognizing and addressing these needs through Autism Acceptance and Awareness Month is crucial. It signifies our dedication to understanding autism's multifaceted nature and ensures that individuals and families affected by autism receive the support and resources they need.

Community Support
The Avenal community has shown robust support for individuals with autism and their families. Our Avenal Police Department officers wear autism awareness patches throughout April as one example. Additionally, our Community Activities staff's ongoing engagement with parents and families of special needs children exemplifies the City’s proactive approach. From these meetings and continued partnership with parents, the City has facilitated multiple events hosted by the Special Needs Support Squad. Most importantly, on April 16, 2025, the City is hosting the grand opening of the Avenal Kids Pocket Park, behind the Boxing Club, meant to serve as a sensory park for all children.

Conclusion
Adopting this proclamation is a reaffirmation of our city's values of inclusivity, understanding, and support for all its residents, particularly those directly affected by autism. It aligns with our ongoing efforts, such as the commendable initiatives by our APD and Community Activities staff, and reiterates that we are a community that acknowledges and celebrates diversity in all forms.

Staff strongly advocates for the adoption of this proclamation and urge the City Council to recognize the significance of Autism Acceptance and Awareness Month. Let us stand united in supporting this initiative, reflecting the strength and compassion of our community.

RECOMMENDATION:

By motion, approve Proclamation 2025-01.

RE: Proclamation – Sexual Assault Awareness Month 2025
INFORMATION: Staff is pleased to present support of the proposed proclamation for the City of Avenal to declare April as Sexual Assault Awareness Month. This proclamation represents an opportunity for our city to acknowledge the serious issue of sexual violence and express solidarity with survivors within our community.

Background and Importance
Sexual assault remains a significant public health and safety concern that affects communities of all sizes, including small agricultural communities like Avenal. Statistics indicate that one in five women experience sexual assault by the time they complete college. Many victims never report these crimes due to various barriers, including fear, stigma, and lack of awareness about available resources. Recognizing April as Sexual Assault Awareness Month provides an opportunity to raise public consciousness about this issue, promote prevention education, and express support for survivors.

Community Context
As a small agricultural community, Avenal faces unique challenges in addressing sexual assault. Our residents, many of whom work in agriculture, may experience geographical isolation, language barriers, and limited access to support services. Acknowledging these realities through this proclamation is a first step toward identifying community needs and potential resources that could benefit our residents.

Future Opportunities
The adoption of this proclamation could serve as a catalyst for future community discussions about how Avenal might better address sexual violence prevention and survivor support. Potential opportunities include collaboration with victim service providers in the region and exploring educational materials in multiple languages.

Conclusion
By adopting this proclamation, the City Council will acknowledge the importance of addressing sexual violence in our community and express support for survivors. This symbolic action aligns with our values as a compassionate community that cares for the wellbeing of all its residents.

Staff recommends the adoption of this proclamation recognizing April as Sexual Assault Awareness Month in the City of Avenal.

RECOMMENDATION:

By motion, approve Proclamation 2025-02
April 10, 2025 Pg. 32
Proclamation
Sexual Assault Awareness Month April 2025
Whereas, Sexual Assault Awareness Month is intended to draw attention to the fact that sexual violence is widespread and has public health implications for every community member of Avenal; and Whereas, Rape, sexual assault and sexual harassment impact our tight-knit agricultural community, where many of our residents work diligently in the fields and farms that sustain our local economy; and Whereas, Our small city prides itself on caring for all neighbors, and we must work together to educate our community regarding prevention of sexual assault and how to support survivors, encouraging every person to speak out when witnessing violence, however small; and Whereas, We recognize that agricultural workers may face unique challenges regarding access to resources and support services, and we commit to ensuring that all community members, regardless of occupation or background, have access to necessary support; and Whereas, We strongly support the efforts of national, state, and local partners, and of every citizen of Avenal, to actively engage in public and private efforts, including conversations about what sexual violence is, how to prevent it, how to help survivors connect with services, and how every segment of our close-knit society can work together to better address sexual violence.

Now, therefore be it resolved, that the City Council of the City of Avenal join advocates against sexual violence and support service programs in the belief that all community members must be part of the solution to end sexual violence, and declare April as "Sexual Assault Awareness Month" in our community, where we stand united in our commitment to fostering safety and respect for all residents! IN TESTIMONY WHEREOF, I have hereunto set my hand and caused the Seal of the City of Avenal to be affixed this 10th day of April, in the year 2025.

Month Of March Overview.

This month was an interesting one. We noticed an increase of dumped dogs, from the hills to Plymouth Ave. we found young pups out on the cuto> road. One was in very bad shape. He ate blue pills from a near by field. We and our neighbor Gimme Love managed to get the small pups help at no expense to us. The current area we feel that needs more attention is the horse corral. This is the area in which most dumped dogs that are left in the hills congregate. We are currently working on getting 3 other dogs that have been spotted in the Avenal Prison.

The Shelter finally got ahold of a dumped stray that was going around the Elementary school, Tamarack Elementary and the prison thanks to a resident that let us use her property to lure the dog in. we are still working hard to get the stray dog issue under control. Our mission is to secure public health and safety. And we will continue to.

We have noticed as well of many dogs that have been running at large are dogs that have owners.

Some calls we get are from owners letting dogs go out for a couple of hours and wait for them to get back home.

The Shelter has had an increase of pet owners trying to surrender their pets saying, “they just don’t want them anymore”.

Another portion of them is saying they just found the dog so they took it in, and also put it in their cars and bringing them to us. At times they don’t know if the dog is sick, friendly or has flea/tics.

They just don’t want it anymore. This is an issue we are facing due to the fact we can’t confirm their story. Not sure what we can do in a situation like this. In my opinion we are bailing pet owners of their responsibility.

The shelter is working with code enforcement to educate and enforce the chicken, rooster etc. problem.

Subject: General Plan Amendment 2024-01 and Rezone 2024-01 (GPA and RZ) Application and related Environment Finding for two adjoining parcels totaling ±3.05 acres of property located north of Highway 33 and S Seventh Avenue intersection.

Summary/Recommendations:

GPA 2024-01 proposes to change the land use designation from Public Facility to Community Commercial and the zoning district from PF to CC. The request follows the Planning and Zoning Law (Government Code 65860(a)) that requires land use and zone districts to be compatible, meaning when the land use is amended a concurrent and compatible zone change must occur. It is recommended that the Planning Commission take the following actions:
1) Ask the City Planner to deliver the staff report;
2) Ask any questions of staff regarding the project;
3) Open the hearing to the public and ask for any public testimony; 4) Ask for a motion to approve the GPA2024-01 and RZ2024-01 by adopting:
a) Resolution 2025-XX: Approving General Plan Amendment 2024-01, which finds the Project exempt from CEQA pursuant to CEQA Guidelines Section 15061 (b)(3) and amends the land use designation for the subject Property from Public Facility to Community Commercial for two adjoining parcels totaling ±3.05 acres of property located north of Highway 33 and S Seventh Avenue intersection; and b) Ordinance 2025-01: Waiving the first reading and formally introducing Rezone 2024-01, which finds the Project exempt from CEQA pursuant to CEQA Guidelines Section 15061 (b)(3) and amends the zone district for the subject property from PF to CC or two adjoining parcels totaling ±3.05 acres of property located north of Highway 33 and S Seventh Avenue intersection.

EXECTUTIVE SUMMARY:

On November 14, 2024, the Avenal City Manager initiated a General Plan Amendment and Rezone Application No. 2024-01 which pertains to two (2) adjoining parcels, respectively referred to as Parcel A (APN: 040-320-009) & Parcel B (APN: 040-320- 014), totaling approximately ±3.05 acres in size and located near the northwest corner of Highway 33 and S Seventh Avenue within City limits (Figure A – Project Location).

Parcels A and B are currently planned and zoned for Public Facility.

Parcel A (APN: 040-320-009) is approximately ±1.58 acres and undeveloped, although some off-site improvements, including curb, gutter, and sidewalk, have been installed.

Parcel B (APN: 040-320-014) is approximately ±1.47 acres and is also undeveloped; however, there are no off-site improvements previously installed, and the parcel is currently ‘landlocked’, meaning it has no access from a public street. Access will have to be granted either off Highway 33/E Laneva Boulevard with Caltrans approval or through a reciprocal access easement with future development.

PROPOSAL AND ANALYSIS
General Plan Amendment
Avenal Municipal Code (AMC) Chapter 9.86 regulates the General Plan Amendment process within the City. The purpose of a general plan amendment is to allow changes to the Avenal General Plan text, Land Use Map, Circulation Map, or other elements.

GPA/RZ 2024-01 is requesting to amend the General Plan Land Use Map to modify the land use designation of the subject properties from the current Public Facility designation to Community Commercial designation (Figure B – Land Use Designation Map). Under the existing General Plan land use designation Public Facility is intended for governmental or institutional uses such as schools, hospitals, government buildings, and other public facilities. At this time, subject parcels are not currently serving any public facility functions.

If the subject parcels are amended to the Community Commercial land use designation, a broader range of commercial and service-oriented uses could be permitted, allowing for larger shopping centers and regional-serving businesses. The proposed land use designation would accommodate any future commercial development that aligns with the city's goals for economic development.

Rezone
The proposed change in land use designation also requires a change in the property’s assigned zone district. GPA/RZ 2024-01 is requesting to rezone the subject property April 10, 2025 Pg. 43

from the current PF (Public Facility) zone district to the CC (Community Commercial) zone district. The CC zone district is associated with restaurants, shopping centers, grocery stores, retail stores, and more commercial services and is governed by Chapter

9.22 of the AMC. Although no physical project is proposed at this time, all future development will be required to comply with the applicable chapters of the AMC for uses and development standards, such as setbacks, height, parking, and landscaping.

Consistency With General Plan Goals And Policies
GPA/RZ2024-01 proposes to change the land use designations from Public Facility to Community Commercial which would not conflict with the goals and policies of the General Plan land use element. The following goals and policies reflect Avenal’s desire to maintain the tradition of responsible planning and well-managed growth to preserve the quality of life in existing neighborhoods and ensure the development of new neighborhoods with an equal quality of life.

Goal 3: Achieve an optimal balance of residential, commercial, industrial, and open space land uses.
§ Policy 3.8. Coordinate economic development with land use planning.

Goal 7: Ensure the continued viability Of Avenal’s' existing commercial areas. § Policy 7.1. Designate appropriate and sufficient commercial land for Avenal’s needs to the year 2035.
§ Action LU-7.1A Investigate and implement methods of accelerating the project review process for commercial and industrial development proposals which generate employment opportunities with appropriate phasing. § Policy 7.4. Encourage community commercial development in residential areas that serve the needs of the area and include site development standards which minimize negative impacts on adjacent properties.
§ Action LU-7.4A Identify potential sites for commercial development offering personal and convenience goods and services for nearby residential areas.

Such uses may be in new, in-fill, and/or consolidated existing strip commercial developments and at a scale which is compatible with surrounding residences.

Findings For General Plan Amendments And Rezone Applications Pursuant to Section 9.86.040 (General Plan Amendment Findings) and (Rezone Findings) of the AMC, the specific findings, or criteria, must be made before approving a general plan amendment or rezone application. Staff has concluded that all findings can be met and has attached them as Exhibit B for reference.

PLANNING COMMISSION ACTION
On March 3, 2025, the Avenal Planning Commission held a regularly schedule hearing in which they reviewed GPA/RZ2024-01. The Planning Commission unanimously voted to approve Resolution 2025-01, which recommends the City Council approve GPA/RX2024-

NOTICE OF CITY COUNCIL HEARING
On or before March 17, 2025, notices were mailed to all property owners within a 300- foot radius of the proposed project and a Notice of Public Hearing was published in the paper of record. At the time this staff report was written, no comments had been received.

ENVIRONMENTAL FINDINGS
GPA/RZ 2024-01 is exempt from review for environmental impacts as a “commonsense” exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act, because it can be seen with certainty that there is no possibility that granting the general plan amendment and rezone will have a significant impact on the environment. Since public facilities allow uses such as auditoriums and convention centers, the change to commercial land use would not generate any additional environmental impacts beyond those analyzed in the general plan.

FINDINGS FOR GENERAL PLAN AMENDMENT AND ZONING AMENDMENT The City Council hereby finds:

1. The amendment is internally consistent with the goals, policies, and actions of the General Plan and this title.

Although the request modifies the General Plan Land Use Map, the proposed amendment remains internally consistent with the General Plan’s goals, policies, and actions. Specifically, it aligns with the City's objectives of supporting commercial development, maintaining a balanced land use mix, and coordinating economic development with land use planning. Therefore, the amendment upholds the General Plan’s intent and vision.

2. The amendment would not be detrimental to the public interest, health, safety, or welfare of the community.

This amendment will not negatively impact public interest, health, safety, or welfare. Instead, it would increase commercial opportunities, generate employment, and enhance local tax revenue, benefiting nearby residential areas without negatively affecting adjacent properties.

Additionally, any future development will undergo project-specific review to ensure compliance with all applicable regulations, including CEQA. This process will confirm compatibility with adjacent land uses and protect community wellbeing.

3. The amendment would maintain the appropriate balance of land uses within the city.

This amendment preserves the city's land use balance by converting the designation from Public Facility to Community Commercial, addressing Avenal’s shortage of commercial space. The change improves accessibility for residents and businesses, supporting a well-distributed land use pattern that aligns with the City's development goals.

4. The anticipated land uses on the subject site would be compatible with existing and future surrounding uses.

The proposed Community Commercial land use is compatible with both existing and future surrounding uses. Any future development will be subject to city review processes to ensure compliance with development standards, including April 10, 2025 Pg. 53

setbacks, landscaping, building scale, and parking requirements. These standards will ensure that the project integrates harmoniously with its surroundings while minimizing potential impacts.

FINDINGS FOR ZONING ORDINANCE AMENDMENTS
The City Council hereby finds:

1. The amendment is internally consistent with the goals, objectives, and policies of the General Plan and this title.

Similar to the General Plan Amendment findings, the proposed rezone is consistent with the General Plan’s goals and policies, which promote economic development and commercial opportunities. This amendment enhances the potential for commercial uses that serve both local and regional residents.

2. The amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the community.

Similar to the General Plan Amendment findings, this rezone will not negatively impact the public interest, health, or safety. Instead, it will increase commercial options, create jobs, and generate tax revenue while maintaining compatibility with surrounding properties.

3. The amendment would maintain the appropriate balance of land uses within Avenal.

By converting the designation from Public Facility to Community Commercial, this amendment addresses the city’s need for additional commercial spaces, improving accessibility and fostering a well-distributed land use pattern. This supports the City’s long-term development goals and ensures a balanced mix of residential, commercial, industrial, and open space uses.

4. The anticipated land use on the subject site would be compatible with existing and future surrounding uses.

The proposed CC (Community Commercial) zone is compatible with both existing and planned surrounding uses. Future development will be subject to City development standards, including setbacks, landscaping, building scale, and parking requirements, ensuring compatibility and minimizing potential impacts.

5. The proposed amendment will not have a significant impact on the environment.

April 10, 2025 Pg. 54

Page 6 of 6 ends

The proposed zone change has been reviewed under CEQA and determined exempt from further environmental review under CEQA Guidelines Section 15061(b)(3). This is because there is no possibility that granting the amendment and rezone will have a significant environmental impact.

Additionally, since Public Facility zoning allows high-intensity uses such as auditoriums and convention centers, the conversion to commercial land use would not introduce any additional environmental impacts beyond those already analyzed in the General Plan.
