AGENDA ITEM NO. 4 - B
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: May 22, 2025
RE: Consider Approval of Staffing Adjustments, Reclassifications, Updated Job Descriptions, Updated Salary Schedule for FY 2024–25
BACKGROUND/DISCUSSION:

The City of Avenal is ending FY 2024–25 with increased fiscal flexibility. Revenues from sales tax, vehicle taxes, and other primary sources are outperforming expectations, resulting in a projected General Fund surplus of over $1 million this fiscal year. Projections for next year anticipate more than $2 million above typical baseline revenues of the last 2–3 years. Additionally, operational savings from IT efforts to cancel redundant services brought in-house, cost-effective consultants at 4Creeks and A&M Consulting Engineers, as well as grant funding for Police Department personnel further contribute to available fiscal resources.

As Avenal grows, our operational demands require a realignment of staffing to ensure continuity, responsiveness, and preparedness for what lies ahead—including the formation of our own Volunteer Fire Department and expansion of internal City services. These proposed staffing changes fall into three categories:

INFORMATION:

1. Entry-Level and Part-Time Staffing (Talent Pipeline) • Add Two Temporary Part-Time Landscapers @ $18/hr, max 960 hours/year • Add One Temporary Part-Time Custodian @ $18/hr, max 960 hours/year • Add One Part-Time Kennel Technician @ $18/hr, max 960 hours/year (cost recovered via Lemoore & Corcoran contracts)
These roles help build a feeder system to scout and evaluate future full-time talent while supporting daily operations.

2. Operational Restructuring and Recreation Staffing
• Create Director of PARCs @ Range ____ (midpoint $_____) • Add Two Permanent Part-Time Recreation Staff @ $18/hr, max 960 hours/year This restructured team will better serve youth and adult programs and is anticipated to be partially funded through a possible School District MOU for after-school programing.

AGENDA ITEM NO. 4 - B

3. Role Adjustments, Reclassifications, and Management Compensation • Reclassify Animal Control Officer from Range B to C.5 (+$5k) for parity with Code Enforcement Officer I, for possessing PC 832 certification • Reestablish Operator in Training (OIT) Position for Utilities (+$58k) to Water/Waste Water Enterprise accounts
• Adjust IT Director from Range S-__ to S-__ ($__k), supported by $84k/year in telecom and IT outsourcing savings
• Retitle and Adjust Deputy City Clerk to Assistant City Manager/Deputy City Clerk from Range E to Range K (+$18k)
• Merit Increase to Chief of Police from $154k to $161k (+$7k, offset by $110k in OT and grant savings)
These adjustments retain institutional knowledge, reflect the workload already being performed, and prepare the City for expansion of services with the right staff in place ready to execute that vision.

4. Adjustment to Exempt/Management Salary Scale (DIR Compliance) To maintain legal compliance with California labor law, the City must revise its exempt/management salary schedule. On May 10, 2024, the California Department of Industrial Relations (DIR) announced that starting January 1, 2025, all salaried exempt employees must earn a minimum of $68,640 annually to remain exempt under state labor law (DIR News Release No. 2024-107:
https://www.dir.ca.gov/DIRNews/2024/2024-107.html).

The City’s current salary schedule includes several exempt ranges (S-1 through S-4) that fall below this required threshold. In response, staff proposes to:
• Eliminate the Ranges included in S-1 through S-4;
• Shift the entire exempt/management scale upward by approximately __%; • Adjust the upper limit of the salary scale to cap at $140,000 annually, allowing for growth, promotion, and recruitment within a sustainable and compliant structure.

This restructuring will ensure all exempt employees meet the state’s minimum salary requirement, allow proper step alignment for current staff, and provide a future-proof salary framework that reflects the increasing complexity of City operations.

The fiscal impact of this adjustment is estimated at $__,000 to the General Fund, and it will be incorporated into the proposed FY 2025 budget.

FISCAL IMPACT:
• General Fund impact: ~$194,000
• Enterprise Fund impact (Water/Wastewater): $58,000
These changes are fully supportable under current and projected budget conditions, while still allowing flexibility for other COLA adjustments needed for the bargaining units and POA.

RECOMMENDATION:

Staff recommends the City Council approve the attached resolution authorizing multiple personnel changes, including creation of new positions, job description updates, salary range adjustments, and classification realignments necessary to support City operations for FY 2024–25. • Resolution Authorizing FY 2024–25 Personnel Changes

Organizational Priorities
I. Leadership Stability
• Commander Edward Rij continues to demonstrate growth in his leadership role. He successfully coordinated staff support for the Every 15 Minutes program and completed the FTO SAC training. He now oversees the department’s Field Training Program, ensuring our officers receive structured and consistent development. • Chief Velasco attended Session I of the POST Executive Development Course in Folsom, CA. This marks a major milestone toward earning the POST Executive Certificate and sharpening the executive leadership capabilities required of a modern police chief. Session II will commence on June 9.
• The department continues to uphold high expectations and accountability across all ranks.

A recent supervisors’ meeting reinforced the vision of excellence, integrity, and professional standards expected of department leaders.
• The Avenal Police Department passed both the POST Backgrounds Audit and the DOJ CLETS Audit with no negative findings—an accomplishment that reflects our team's diligence and commitment to compliance.

II. Recruit and Retain the Best
• Recruitment efforts remain ongoing for both Police Officer I/II and Sergeant positions. • Officers Mendez, Martinez, and Lopez are now in the final phases of their Field Training and are expected to transition into solo roles soon.
• Officer Christopher Drake was recently sworn in and is currently in the early, formative phase of his policing career. His onboarding marks continued momentum in our hiring strategy. • Erika Martinez, assigned to Property and Evidence, has successfully completed the POSTCertified Crime Scene Investigations Course. She has begun processing minor scenes and is actively shoring up our evidence management supplies and protocols. Plans are underway to partner with an allied agency to allow her to shadow a full-time crime scene unit for expanded hands-on experience.

May 22, 2025 Pg. 27

III. International Model of Community Trust
• Our Community Service Unit and officers actively participated in a wide range of events this spring, including:
• Rotary
• Every 15 Minutes Program
• Annual Easter Egg Hunt
• 3rd Annual Technical & Vocational Career Expo at Avenal High School • APD Spring Block Party
• Old Timer’s Day
• Student vs. Staff Rally at Reef-Sunset Middle School
• May the 4th Community Engagement Campaign
• Tour for the Kings County Grand Jury
• We officially launched the recruitment phase for our upcoming Avenal Police Explorers Program in partnership with the Scouts of America. We’ve already received approximately five applicants and are moving steadily toward full implementation. • We are finalizing our Byrne SCIP Advisory Board, which will guide implementation of our outreach campaign focused on mental wellness education and Gun Violence Restraining Order (GVRO) awareness. These efforts will provide valuable tools and resources to residents, aligning with our community-first mission.

IV. Among the Safest Cities in America
• Our department continues to see a significant reduction in crime. The combination of strategic staffing, proactive patrols, and internal accountability has yielded strong early results.
• Flock Safety Cameras have been approved and are currently in the installation phase. City permits have been issued, and our vendor is working through Caltrans permitting to finalize placement on major corridors. These ALPR tools will greatly enhance our investigative reach and response capability.
• We remain actively engaged with regional partners. In April, the department participated in the Kings County Ambulance Commission Meeting, and we continue to collaborate with all neighboring law enforcement agencies to enhance regional safety and interoperability. • As we continue implementation of the Momentum Policing Model, we are diligently investing in personnel, processes, and technology to solidify the foundation of an efficient and responsive public safety strategy.

V. Embrace Wellness Among Our Employees
• We continue to prioritize employee wellness by maintaining practices outlined in previous months, including promoting open communication, encouraging participation in community events, and reinforcing a positive, mission-oriented work environment.

May 22, 2025 Pg. 28

• As before, officers are given opportunities to engage with the community in supportive and uplifting ways, which boosts morale, builds trust, and reduces occupational stress.

Supervisors are encouraged to check in regularly with their teams and promote a culture of mutual care and resilience.

The CrisCom Company –
City of Avenal Update
May, 2025
Legislative Update:

May Revise
We want to provide you with a clear summary of Governor Newsom’s May 2025 budget revision and highlight how it may affect local priorities.

State Revenue Shortfall
California is facing a significant drop in expected revenue-about $16 billion less than previously forecasted over the next two years. This is largely due to a slowing U.S. economy, recent federal policies, and decisions the state has made regarding spending.

As a result, the state must address a projected $7.5 billion budget gap for the coming fiscal year.

Governor’s Budget Solutions
To close the gap, the Governor’s May Revision proposes several strategies:
• Reducing Costs: Limiting Medi-Cal (California’s health coverage for low-income residents) eligibility for certain adults, which will save money both now and in the future.
• Shifting Funds and Borrowing: Moving funds between state accounts and delaying repayment of some state loans.
• Delaying or Reducing Program Expansions: Potentially postponing or scaling back new initiatives in food assistance and foster care if revenues fall short. • Closing a State Prison: Scheduled for October 2026, saving approximately $150 million annually. Governor Newsom has not announced which prison will be closed.

Local Impacts and District Requests
• Limited Funding for New Local Projects: Due to the budget shortfall, the state is being very selective with new spending. Most new local or district-specific projects-often requested by legislators-are unlikely to receive funding this year.

The focus is on maintaining essential services and honoring existing commitments. • Ongoing Budget Negotiations: The May Revision is not the final budget. The Legislature will continue negotiations, but there is some flexibility for new discretionary spending with the current shortfall.

Bottom Line
California’s May budget revision reflects a cautious approach due to economic uncertainty and lower revenues. While the state is taking steps to protect reserves and core programs, most new or discretionary local projects will likely be delayed.

With all this said we will continue to work diligently in Sacramento and will keep you informed of any significant developments as the budget process moves forward. Our goal is to make certain that, should any funding be allocated for district budget requests, Avenal’s needs are recognized and prioritized in the final budget.

Federal Update: Big Picture & Local Advocacy
Federal Legislative Landscape
At the federal level, Congress is currently focused on the Fiscal Year 2025 budget, with ongoing debates around infrastructure, water resources, and community development funding. The House and Senate are considering several major spending bills, but progress has been slow due to broader negotiations over the federal deficit and competing policy priorities.

Avenal Representation in Washington, DC
Earlier this month, John was in Washington, DC, advocating on behalf of the City of Avenal. He had a great meeting with Congressman Valadao’s team, where our local priorities were front and center. We are pleased to report that our FY26 Water Storage Tank project is looking good and we are hopeful that our project will come to fruition.

Sacramento Snapshot:

For your awareness, we currently distribute a bi-weekly "Sacramento Snapshot" that provides updates on important state legislation. Antony is currently on the distribution list for this update. We would be pleased to add any City Council members who are interested in receiving this information regularly. If you would like to be included, please let us know.

Economic Development Update:

Our team remains steadfast in pursuing new opportunities to ensure the City of Avenal is top of mind for developers, retailers, and investors. Earlier this week, we attended the International Council of Shopping Centers (ICSC) conference in Las Vegas, where we engaged with a variety of retailers and restaurant representatives to introduce them to Avenal’s potential for growth and development. Our team is aware that the City would like to have a chicken restaurant in town. We met with representatives from Popeyes, Chic-fil-A, Raising Cane’s, Slim Chickens, and Bojangles, as well as Wendy’s, Jack in the Box, McDonald’s, Burlington, TJ Maxx, etc. We will continue to pursue and follow up with all these venues, as well as any others that were not attendance in Las Vegas.

As noted in previous updates, many fast-food establishments operate under a franchise model. Accordingly, our team is continuing outreach efforts by connecting directly with franchise directors to promote Avenal as a viable location for future expansion. This was also a common theme at ICSC. Many of the restaurant representatives that we spoke with stated we needed to find franchisees. Several of these companies will not assist with that pursuit, therefore, we need to increase our outreach.

Grant Writing Update:

A representative from the CrisCom team continues to attend bi-weekly staff meetings to assist with grant administration and to keep department heads informed of current and upcoming funding opportunities relevant to citywide projects.

We remain proactive in researching and identifying a broad range of grant opportunities that align with the City’s strategic goals.

Upcoming Grant Deadlines:
• COPS Hiring Program Grant – Due June 25 & July 1
• Safe Streets and Roads for All (SS4A) – Due June 26
• T-Mobile Hometown Grant – Due June 30
• Recreational Trails Program – Due July 1

TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: May 22, 2025
RE: Authorize the City Manager to Initiate Steps Toward the Formation of a CityOperated Volunteer Fire Department INFORMATION:

The City of Avenal has long worked toward becoming a self-sustaining, full-service city—capable of delivering essential services under local control. Establishing a City-run Volunteer Fire Department is the next step in that vision.

With gratitude for the County’s years of service, the City is now ready to assume responsibility for local fire protection. This shift will improve sustainability, operational responsiveness, and efficiency—aligning fire protection services more directly with Avenal’s needs.

Council authorization will allow the City Manager to:
• Recruit key personnel, including an Interim Fire Chief and Battalion Chief • Finalize and bring forward job descriptions for Council review • Begin outreach and onboarding of volunteer firefighters • Procure critical equipment and protective gear
• Organize staffing and retrofitting of the west wing of the Avenal hospital to house the department
• Initiate time-sensitive procurement and bring items back for ratification at the next Council meeting
The City aims to formally launch the department on or around August 1, 2025.

FISCAL IMPACT:
• Personnel Costs: Estimated at up to $350,000 annually, depending on the number of volunteers.
• Soft Costs (insurance, utilities, building maintenance): Will be absorbed under existing City operations and insurance coverage. RMA has confirmed that no additional policies are required—fire personnel and equipment will be covered under existing protections for the Police Department and General City operations.
• One-Time Facility Costs:
o $400,000–$500,000 to retrofit the west wing of the Avenal Hospital building and build a metal structure to house fire equipment and vehicles. • One-Time Equipment Costs:
o Estimated at $300,000–$400,000 to purchase a Type 3 or brush fire engine, water tender, communications equipment, turnout gear, and other fire protection tools.

AGENDA ITEM NO. 9 - A
Once operational, the City aims to maintain fire service operation costs between $300,000 and $400,000 annually.

Funding for this initiative will come from a combination of:
• General Fund allocations (currently $450,000 budgeted toward County fire services) • Recovered property tax revenues currently retained by the County (estimated $420,000) Together, these funds represent approximately $870,000 that has been available annually to support the launch and maintenance of the City’s fire services. An additional $380,000 will be incorporated from the City’s FY 2025–26 General Fund budget to cover the one-time capital investments. As stated, future fiscal budgets would in fact have a savings for the City and free up dollars from the General Fund.

RECOMMENDATION:

Staff recommends that the City Council adopt the attached resolution authorizing the City Manager and City Staff to begin the necessary steps to establish a City-operated Volunteer Fire Department, with a target launch date of August 1, 2025.

WHAT IS HAPPENING
• Since incorporation, 1979, the City has relied on County Fire for fire protection services
• All cities strive to become self-sufficient and become a full-service city, meaning they provide all services in-house
• Discussions for a City Fire Department started 20 years ago • Avenal Police Department was the first step in 2010
• Five years ago, Avenal and Corcoran conducted a study about a Fire Services Distrrict

WHAT IS HAPPENING
• County has been gracious in charging amounts that the City could afford, with gradual increases
• For the last 10 months, the City and County have been in discussions about the renewal of the City’s contract for Fire Services, for FY 2024 onwards • Over the past eight years, the City has agreed to gradual increases of up to $50k each year, understanding there is a subsidy to the cost based on some calls happening outside the City
• Corcoran also contracts with Kings County at a subsidized cost

CITY REVENUES

MEASURE - A
To preserve the safety and character of Avenal, and maintain essential general City services for Avenal residents including police, 911 emergency response, fire protection, disaster preparedness, recreational programs and facilities, park maintenance and improvements, street maintenance and repairs and other essential services, shall Ordinance No. 2022-04, imposing a 1-cent general sales and use tax, be adopted? Estimated revenues between $400,000 and $500,000 annually, indefinitely.

FY 2024/2025 BUDGET

THE PLAN
• In order to continue providing and grow all city services, an increase of $806,932 in one year is not seen as feasible • Departments would need to see staff reductions or cuts, like recreation, public works, and the police department
• Measure - A is averaging $1m per year, which would leave very little for other department or services, in light of inflation, increasing costs everywhere

WHY VOLUNTEER FIRE
• The city explored contracting with other neighboring entities, Cal Fire, private firefighters, even CDCR at Avenal State Prison who already provides mutual aid • The upfront costs were too high with no locally owned infrastructure or local talent • The City explored different models and determined that a hybrid Volunteer Fire Department with paid stipends, call-outs, and two permanent full-time positions (Fire Chief and Battalion Chief) was a suitable model for a City with less than an average of 10 structure fires per year.

STRUCTURE
• Fire Chief – search begun
• Battalion Chief

BENEFITS TO VOLUNTEER FIRE DEPARTMENT
• Local Control
A City-run department means quicker decisions, faster response times, and the ability to set our own standards of service.
• Career Pathways for Local Residents
Provides hands-on training, leadership opportunities, and a direct path to fire service careers for Avenal residents.
• Keeps Funding Local
City funds stay within Avenal, supporting our own infrastructure and workforce rather than being sent out to other jurisdictions.

BENEFITS TO VOLUNTEER FIRE DEPARTMENT
• Improved Response and Coverage
Avenal is geographically isolated from other County stations. We already rely on Avenal State Prison for mutual aid—this builds on that local readiness. • Meets Safety Staffing Standards
The City can currently only afford two full-time firefighters — not enough to legally enter a burning structure under the “2 In, 2 Out” safety rule. A volunteer force helps fill that gap, ensuring we have the manpower needed without waiting on delayed mutual aid.

INSURANCE QUESTION
• Will my home insurance go up if Avenal switches to a Volunteer Fire Department? • Short answer: Insurance rates are going up statewide — regardless of whether Avenal uses County Fire or a City-run department.
• Rates are rising across California. Insurance companies are raising premiums statewide due to wildfire risks and state-approved increases — some as high as 30%. • Fire departments are rated using something called a PPC (Public Protection Classification), scored from 1 (best) to 10. This rating helps some (but not all) insurers set your premium.

INSURANCE QUESTION
• Switching to a Volunteer Fire Department doesn’t automatically change our PPC. • Unless the City requests a new evaluation, our current PPC stays in place — and your rate probably won’t change because of the transition alone.
• Avenal can request a PPC evaluation when the new department is ready. We’d have time to make improvements before any new rating is shared with insurance companies. • You can lower your rate by doing fire-safe upgrades at home — like clearing brush or using fire-resistant materials. State law requires insurance companies to offer discounts for this. 919 Skyline Blvd.

AGENDA ITEM NO. 9 - B
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager
DATE: May 22, 2025
RE: Consider Approval of Agreement with City of Lemoore for Animal Shelter Services
INFORMATION:

The City of Avenal continues to strengthen partnerships with neighboring cities that seek costeffective, community-based services. The attached agreement with the City of Lemoore is a direct result of Avenal’s growing reputation as a regional leader in animal care—recognized for operating as a primarily no-kill shelter and facilitating successful animal adoptions across the country, from Alaska to New York.

This agreement is modeled after the City’s existing agreement with City of Corcoran and is designed to operate within similar capacity limits. Under the terms of the agreement, Lemoore will transport animals to Avenal’s animal control shelter facility up to two times per week. Avenal staff will handle housing, care, and processing, and provide monthly reports on activity and outcomes.

The agreement will:
• Support continued shelter operations with a Year 1 payment of $165,000, which will assist with costs related to the ongoing expansion of the animal shelter facility; • Transition to a recurring cost of $125,000 annually, increasing by 5% per year through 2030; • Cover the added staffing needs and workload associated with Lemoore’s intake volume.

As part of implementation, staff is also exploring the addition of an Animal Control Officer to support operations. Discussions are underway with the City of Corcoran to evaluate cost-sharing opportunities for that position.

This partnership reflects Avenal’s ability to deliver high-quality public services regionally, leveraging economies of scale while maintaining humane and responsible animal care standards.

FISCAL IMPACT:

The agreement will generate $165,000 in the first year to support capital and operational needs of the animal shelter. Subsequent annual payments will begin at $125,000 and increase 5% per year through FY 2029–30. The additional revenue will help offset staffing costs and support long-term shelter maintenance and expansion.

RECOMMENDATION:
