private water system(s) such contaminates or pollutants which could backflow or back-siphon into the public water supply system;
(2) To promote the elimination or control of existing cross-connections, actual or potential, between its customer's in-plant potable water system(s) and nonpotable water system, plumbing fixtures and industrial piping systems; and
(3) To provide for the maintenance of a continuing program of cross-connections control which will systematically and effectively prevent the contamination or pollution of all potable water systems.
(b) Statutory Authority:
(1) The Cross-connection Control Policy Handbook sets forth rules and regulations governing cross-connections.
(2) This article is adopted pursuant to the California State Water Resource Control Board's December 19, 2023 adoption of the Cross-connection Control Policy Handbook (CCCPH), effective July 1, 2024, as amended on June 17, 2025. The CCCPH and its standards apply to all California Public Water Systems (PWS), as defined in California's Health and Safety Code (CHSC, section 116275 (h)). Compliance with this CCCPH is mandatory for all California PWSs.
(c) Responsibility. The Director of Public Works or their assigned designee, ("Director") shall be responsible for the protection of the public potable water distribution system from contamination or pollution due to the backflow or backsiphonage of contaminants or pollutants through the water service connection. If, in the judgment of said Director, an approved backflow prevention device is required, at the City's water service connection to any customer's premises, for the safety of the water system, the Director shall give notice in writing to said customer to install such an approved backflow prevention device at each service connection to his premises.

The customer shall immediately install such approved device or devices at his own expense; and failure, refusal, or inability on the part of the customer to install said device or devices immediately shall constitute a ground for discontinuing water service to the premises until such device or devices have been properly installed.
6-4.20(B) Definitions.
(a) Director of Public Works. The Director of Public Works or their assigned designee, hereafter called ("Director"), in charge of the Water Department of the City, is invested with the authority and responsibility for an implementation of an effective cross-connection control program and for enforcement of the provisions of this article. (b) "Approved" means accepted by the Director as meeting an applicable specification stated or cited in this article, or as suitable for the proposal use.

September 25, 2025 Pg. 9
(c) "Auxiliary water supply" means any water supply on or available to the premises other than the City's approved public potable water supply. These auxiliary waters may include water from another public potable water supply or any natural source(s) such as a well, spring, river, stream, harbor, etc., or "used water" or "industrial fluids." These waters may be polluted or contaminated or they may be objectionable and constitute an unacceptable water source over which the City does not have sanitary control.
(d) "Backflow" means the flow of water or other liquids, mixtures or substances under pressure into the distributing pipes of a potable water supply system from any source or sources other than its intended source.
(e) "Back-siphonage" means the flow of water or other liquids, mixtures or substances into the distributing pipes of a potable water supply system from any source other than its intended sources caused by the sudden reduction of pressure in the potable water supply system. (f) "Backflow preventer" means a device or means designed to prevent backflow or backsiphonage. (g) "Air-gap" means the unobstructed vertical distance through the free atmosphere between the lowest opening from any pipe or faucet supplying water to a tank, plumbing fixture, or other device and the flood level rim of said vessel. An approved air-gap shall be at least double the diameter of the supply pipe, measured vertically, above the top of the rim of the vessel; and, in no case less than one inch. When an air-gap is used at the service connection to prevent the contamination or pollution of the City's potable water system, an emergency by-pass shall be installed around the air-gap system and an approved reduced pressure principle device shall be installed in the by-pass system.
(h) "Reduced pressure principle device" means an assembly of two (2) independently operating approved check valves with an automatically operating differential relief valves between the two (2) check valves, tightly closing shut-off valves on either side of the check valves, plus properly located test cocks for the testing of the check and relief valves. The entire assembly shall meet the design and performance specifications and approval of a recognized and City-approved testing agency for backflow prevention assemblies. The device shall operate to maintain the pressure in the zone between the two (2) check valves at a level less than the pressure on the City water supply side of the device. At cessation of normal flow the pressure between the check valves shall be less than the supply pressure. In case of leakage of either check valve, the differential relief valve shall operate to maintain this reduced pressure by discharging to the atmosphere. When the inlet pressure is two (2) pounds per square inch or less, the relief valve shall open to the atmosphere. To be approved these devices must be readily accessible for in-line maintenance and testing and be installed in a location where no part of the device will be submerged.
(i) "Double check valve assembly" means an assembly of two (2) independently operating approved check valves with tightly closing shut-off valves on each side of the check valves, plus properly located test cock for the testing of each check valve. The entire assembly shall meet the design and performance specifications and approval of recognized and City-approved testing September 25, 2025 Pg. 10
agency for backflow prevention devices. To be approved these devices must be readily accessible for in-line maintenance and testing.
(j) "Contamination" means an impairment of the quality of the potable water by sewage, industrial fluids or waste liquids, compounds or other materials to a degree which creates an actual hazard to the public health through poisoning or through the spread of disease. (k) "Cross-connection" means any physical connection or arrangement of piping or fixtures between two (2) otherwise separate piping systems one of which contains potable water and the other nonpotable water or industrial fluids or questionable safety, through which, or because of which, backflow or back-siphonage may occur into the potable water system. A water service connection between a public potable water distribution system and a customer's water distribution system which is cross connected to a contaminated fixture, industrial fluid system or with a potentially contaminated supply or auxiliary water system, constitutes one type of crossconnection. Other types of cross-connections include connectors such as swing connections, removable sections, four-way plug valves, spools, dummy sections of pipe, swivel or changeover devices, sliding multiport tube, solid connections, etc. (l) Cross-connections---controlled. "Controlled cross-connection" means a connection between a potable water system and a nonpotable water system with an approved backflow prevention device properly installed that will continuously afford the protection commensurate with the degree of hazard.
(m) "Cross-connection control by containment" means the installation of an approved backflow prevention device at the water service connection to any customer's premises where it is physically and economically infeasible to find and permanently eliminate or control all actual or potential cross connections within the customer's water system where there are actual or potential cross connections which cannot be effectively eliminated or controlled at the point of cross-connection.
(n) Hazard, degree of. (1) Hazard---Health. "Health hazard" means any condition, device or practice in the water supply system and its operation which could create, or in the judgment of the Director may create a danger to the health and well-being of the water consumer. An example of a health hazard is a structural defect, including cross-connections, in a water supply. (2) Hazard---Plumbing. "Plumbing hazard" means a plumbing-type cross-connection in a consumer's potable water system that has not been properly protected by a vacuum breaker, airgap separation or backflow prevention device. Unprotected plumbing-type cross-connections are considered to be a health hazard. (3) Hazard---Pollutional. "Pollutional hazard" means an actual or potential threat to the physical properties of the water system or to the potability of the public or the consumer's potable water system but which would constitute a nuisance or be aesthetically objectionable or could cause damage to the system or its appurtenances, but would not be dangerous to health. (4) Hazard---System. "System hazard" means an actual or potential threat of severe damage to the physical properties of the City's potable water system or the consumer's potable water system or of a pollution or contamination which would have a protracted effect on the quality of the potable water in the system.

September 25, 2025 Pg. 11
(o) "Industrial fluids system" means any system containing a fluid or solution which may be chemically, biologically, or otherwise contaminated or polluted in a form or concentration such as would constitute a health, system, pollutional or plumbing hazard if introduced into an approved water supply. This may include, but not limited to: polluted or contaminated waters; all types of process waters and "used waters" originating from the public potable water system which may have deteriorated in sanitary quality; chemicals in fluid form; plating acids and alkalies, circulated cooling waters connected to an open cooling tower and/or cooling towers that are chemically or biologically treated or stabilized with toxic substances; contaminated natural water such as from wells, springs, streams, rivers, bays, harbors, seas, irrigation canals or systems, etc.; oils, gases, glycerine, paraffins, caustic and acid solutions and other liquid and gaseous fluids used in industrial or other purposes or for firefighting purposes. (p) "Pollution" means the presence of any foreign substance (organic, inorganic or biological) in water which tends to degrade its quality so as to constitute a hazard or impair the usefulness or quality of the water to a degree which does not create an actual hazard to the public health but which does adversely and unreasonably affect such waters for domestic use. (q) Water---Potable. "Potable water" means any water which, according to recognized standards is safe for human consumption.
(r) Water---Nonpotable. "Nonpotable water" means water which is not safe for human consumption or which is of questionable potability.
(s) Water---Service connections. "Service connections water" means the terminal end of a service connection from the City's potable water system; i.e., where the City loses jurisdiction and sanitary control over the water at its point of delivery to the customer's water system. If a meter is installed at the end of the service connection, then the service connection shall mean the downstream end of the meter. There should be not unprotected takeoffs from the service line ahead of any meter or backflow prevention device located at the point of delivery to the customer's water system. Service connection shall also include water service connection from a fire hydrant and all other temporary or emergency water service connections from the public potable water system.
(t) Water---Used. "Used water" means any water supplied by the City from the potable water system to a consumer's water system after it has passed through the point of delivery and is no longer under the sanitary control of the City.
6-4.20(C) Requirements.
(a) Water system.
(1) The water system shall be considered as made up of two (2) parts: the City system and the customer system.

September 25, 2025 Pg. 12
(2) The City system shall consist of the source facilities and the distribution system; and shall include all those facilities of the water system under the complete control of the City up to the point where the customer's system begins.
(3) The source shall include all components of the facilities utilized in the production, treatment, storage, and delivery of water to the distribution system. (4) The distribution systems shall include the network of conduits used for the delivery of water from the source to the customer's system.
(5) The customer's system shall include those parts of the facilities beyond the termination of the City distribution system which are utilized in conveying City delivered domestic water to points of use.

Installation Requirements:
1) Approval of Backflow Preventers. Only backflow preventers that have passed both laboratory and field evaluations by a recognized testing agency and accepted by both the city and the health agency shall be used; further defined under 6-4.20(H) Approval of Director of this Article. 2) For water connections, where backflow prevention is required, other than fire systems, a reduced pressure device (RP) shall be the minimum protection allowed. 3) Air-Gap Separation (AG). The air-gap separation should be located on the water user's side of and as close to the user connection as is practicable. All piping from the user connection to the receiving tank shall be above grade and entirely visible unless the city and health agency approve the burial of the line. Water take-offs between the user connection and the air-gap separation shall be protected in a manner approved by the health agency and city. 4) Reduced Pressure Principle Device (RP). The approved reduced pressure principle device should be installed on the user's side of and as close to the user connection as is practicable. The device should be installed not less than twelve (12) inches above grade and shall be readily accessible for maintenance and testing. Water take-offs between the user connection and the RP should be protected in a manner approved by the health agency and city. 5) Double-Check Valve (DC). The double-check valve should be located on the user's side of and as close to the user connection as is practicable. The double-check valve should be preferably above grade and readily accessible for maintenance and testing. Water supplied from any point between the user connection and the DC should be protected in a manner approved by the health agency and city.
6-4.20(D) Installation of water service connection---Maintenance.

No water service connection to any premises shall be installed or maintained unless the water supply is protected as required by State laws and regulations and this chapter. Service of water to any premises shall be discontinued if a prevention device required by this chapter is not installed, September 25, 2025 Pg. 13
tested and maintained, or if it is found that a backflow prevention device has been removed, bypassed, or if an unprotected cross-connection exists on the premises. Service will not be restored until such conditions or defects are corrected.
6-4.20(E) Inspection of customer's system.

The customer's system should be open for inspection at all reasonable times to authorized representatives of the Public Works Water Division to determine whether cross-connections or other structural or sanitary hazards, including violations of these regulations, exist. When such a condition becomes known, the Director shall deny or immediately discontinue service to the premises by providing for a physical break in the service line until the customer has corrected the condition(s) in conformance with State and City statutes relating to plumbing and water supplies and the regulations adopted pursuant thereto.
6-4.20(F) Backflow devices.

An approved backflow prevention device shall also be installed on each service line to a customer's water system at or near the property line or, with written approval of the Director, immediately inside the building being served; but in all cases, before the first branch line leading off the service line wherever the following conditions exist*. In all cases, customer must notify City and allow City to inspect the unburied water line between the City water meter and newly installed backflow prevention device.*
(a) In the case of premises having an auxiliary water supply which is not or may not be of safe bacteriological or chemical quality and which is not acceptable as an additional source by the Director, the City water system shall be protected against backflow from the premises by installing a backflow prevention device in the service line appropriate to the degree of hazard. (b) In the case of premises on which any industrial fluids or any other objectionable substance is handled in such a fashion as to create an actual or potential hazard to the City water system, the City system shall be protected against backflow from the premises by installing a backflow prevention device in the service line appropriate to the degree of hazard. This shall include the handling of process waters and waters originating from the City system which have been subject to deterioration in quality.
(c) In the case of premises having
(1) internal cross-connections that cannot be permanently corrected and controlled, or (2) intricate plumbing and piping arrangements or where entry to all portions of the premises is not readily accessible for inspection purposes, making it impracticable or impossible to ascertain whether or not dangerous cross-connections exist, the City water system shall be protected against backflow from the premises by installing a backflow prevention device in the service line.
6-4.20(G) Protective devices---Degree of hazard.

September 25, 2025 Pg. 14
The type of protective device required under subsections 6-4.20(F)(a), (b) and (c) shall depend upon the degree of hazard which exists as follows:
(a) In the case of any premises where there is an auxiliary water supply as stated in subsection

64.20(F)(a) of this chapter and it is not subject to any of the following rules, the City water system shall be protected by an approved air-gap separation or an approved reduced pressure principle backflow prevention device.
(b) In the case of any premises where there is water or substance that would be objectionable but not hazardous to health, if introduced into the City water system, the City water system shall be protected by an approved double check valve assembly.
(c) In the case of any premises where there is any material dangerous to health which is handled in such a fashion as to create an actual or potential hazard to the City water system, the City water system shall be protected by an approved air-gap separation or an approved reduced pressure principle backflow prevention device. Examples of premises where these conditions will exist include sewage treatment plants, sewage pumping stations, chemical manufacturing plants, hospitals, mortuaries and plating plants.
(d) In the case of any premises where there are "uncontrolled" cross-connections, either actual or potential, the City water system shall be protected by an approved air-gap separation or an approved reduced pressure principle backflow prevention device at the service connection. (e) In the case of any premises where, because of security requirements or other prohibitions or restrictions it is impossible or impractical to make a complete in-plant cross-connection survey, the City water system shall be protected against backflow or back-siphonage from the premises by the installation of a backflow prevention device in the service line. In this case, maximum protection will be required; that is, an approved air-gap separation or an approved reduced pressure principle backflow prevention device shall be installed in each service to the premises. (f) Except as noted in subsection (1) and (3) below, all fire sprinkler systems directly connected to the domestic water supply must have, at a minimum, a DC valve installed at the distribution system's point of connection or, with exception, the most practical location approved by the city, no later than July 1, 2035 (10 years after the adoption of the CCCPH). (1) A high hazard cross-connection fire protection system, including but not limited to fire protection systems that may utilize chemical addition (e.g., wetting agents, foam, anti-freeze, corrosion inhibitor, etc.) or an auxiliary water supply, must have no less than RP protection. (2) For existing fire protection systems that do not meet Section 3.2.2 (e)(3) of the CCCPH, or cannot install DC protection within ten years of adoption of the CCCPH, the city may propose (A) an alternative date or,
September 25, 2025 Pg. 15
(B) an alternative method of backflow protection that provides at least the same level of protection to public health in an amended cross-connection control plan submitted for and in compliance of CCCPH Section 3.1.4.
(3) A backflow prevention device is not necessary for a low hazard fire protection system on a residential user premises if the following criteria are satisfied:
(A) the user premises has only one service connection to the PWS; (B) a single service line onto the user premises exists that subsequently splits on the property for domestic flow and fire protection system flow, such that the fire protection system may be isolated from the rest of the user premises;
(C) a single, water industry standard, water meter is provided to measure combined domestic flow and fire protection system flow;
(D) the fire protection system is constructed of piping materials certified as meeting NSF/ANSI Standard 61; and
(E) the fire protection system's piping is looped within the structure and is connected to one or more routinely used fixtures (such as a water closet) to prevent stagnant water. (g) Use of Fire Hydrants. The city allows the use of water directly from fire hydrants for flushing storm and sanitary sewers and similar uses. When this is permitted, it is mandatory that a portable RP be provided by the user to protect the city water system. 6-4.20(H) Approval of Director.

Any backflow prevention device required herein shall be of model and size approved by the Director. "Approved backflow prevention device" means a device that has been manufactured in full conformance with the standards established by the American Water Works Association entitled:

Backflow preventers which may be subjected to back pressure or back siphonage that have been fully tested and have been granted a certificate of approval by said qualified laboratory and are listed on the laboratory's current list of "Approved Devices" may be used without further test or qualifications.
6-4.20(I) Inspection and tests.

It shall be the duty of the customer-user at any premises where backflow prevention devices are installed to have certified inspections and operational tests made at least once per year. In those instances where the Director deems the hazard to be great enough, he may require certified inspections at more frequent intervals. These inspections and tests shall be at the expense of the water user and shall be performed by the device manufacturer's representative, by Public Works Water Division personnel or by a certified tester approved by the Director. It shall be the duty of the Director to see that these timely tests are made.

The backflow prevention assembly test shall be performed and results reported to the city within thirty (30) days of written notice by the city that testing is required. City personnel and a designated private certified tester will inspect and test backflow prevention devices of those customers who refuse to hire a certified tester on their own. Charges for said inspection and testing shall be equal to the city's cost including overhead and will be borne by the customer The customer shall be responsible for maintenance and repair costs of the backflow prevention device. The customer shall at all times maintain the device in proper working order as a condition of continued water service. If a backflow prevention device should fail to pass inspection and, the customer shall, within thirty (30) days after notification of test results, provide for repair of the device. Records of such test, repairs and overhauls shall be kept and made available to the Director.
6-4.20(J) Presently installed devices.

All presently installed backflow devices which do not meet the requirements of this section but were approved devices for the purpose described herein at the time of installation and which have been properly maintained shall, except for the inspection and maintenance requirements under Section 64.20(I), be excluded from the requirements of these rules so long as the Director is assured that they will satisfactorily protect the City system. Whenever the existing device is moved from the present location or requires more than minimum maintenance or when the Director finds that the maintenance constitutes a hazard to health, the unit shall be replaced by a backflow prevention device meeting the requirements of this section.

In addition to the rights granted the city in this article, the city may terminate water services to any premises served if a required backflow prevention device is removed by the customer or if the city finds evidence that an installed backflow prevention device has been bypassed, made or allowed to remain ineffective.

RE: Consider Transition from Summary Minutes to Action Minutes for City Council Meetings
RECOMMENDATION:
(This Staff Report was originally prepared for the May 8th 2025 City Council Meeting) Staff recommends that the City Council approve the transition to action minutes for all future City Council meetings, with specific modifications to include brief topic headers and documentation of important or pressing comments or announcements.

BACKGROUND:

The City of Avenal currently prepares summary minutes for all City Council meetings, which provide a shorthand written account of discussions, presentations, and comments made by Council and the public.

Informative, summary minutes can be time consuming to prepare and review, often requiring several hours of staff time per meeting to ensure discussion details are correct With the City’s meetings now being livestreamed and archived via the official City of Avenal Facebook page and soon YouTube page, the public has direct access to a complete audiovisual record of all proceedings.

This advancement in transparency offers an opportunity to modernize our minute taking process.

DISCUSSION:

Action minutes, as opposed to summary minutes, record only essential actions taken during a meting such as motions made, names of movers and seconders, votes cast, and results of each vote. They do not include detailed summaries of discussions or public comments. This approach is currently in use by several cities, including the City of Taft and the City of Coalinga. These cities rely on their recorded video streams to provide supplemental context while maintaining official written minutes limited to actions taken. Staff proposes a modified approach to action minutes for Avenal that includes:
• Brief topic headers to provide context for each agenda item; • Documentation of important or notable public or Council comments, such as urgent community concerns or announcements of significance;
• Continued inclusion of all official motions, votes, and actions. • Link to the audio/video record of the meeting.

This approach preserves transparency and public access while improving administrative efficiency.

ANALYSIS:
• Advantages of Modified Action Minutes:
• Maintains legal compliance with the Brown Act
• Public access to full meeting content remains available through archived video • Reduces staff time while still capturing essential context • Increases timeliness in publishing minutes
• Reflects current practices in similar cities, with added flexibility for local needs September 25, 2025 Pg. 34

FISCAL IMPACT:

No direct fiscal impact. The change is anticipated to result in staff time savings that may be reallocated to other departmental tasks and responsibilities.

CONCLUSION:

Given the availability of recorded Council meetings and the successful implementation of action minutes in other jurisdictions, staff recommends the City Council authorize the adoption of modified action minutes to include topic headers and key comments or announcements.

Organizational Priorities
I. Leadership Stability
• Commander Rij continues to provide invaluable support in many areas of the department. He oversees the Field Training Program, ensuring new officers are given every opportunity to succeed while still holding them to high standards. This month, another officer successfully completed the program. Commander Rij also assists with internal investigations and department procurement, including the recent purchase of nine vehicles from the City of Fresno that will strengthen our fleet. He is also coordinating grant-funded purchases for two new patrol vehicles and managing several other projects to improve operations. • Corporal Van Deursen contributed by delivering in-house training for officers on traffic collision reports. His instruction has standardized practices and reinforced best methods for accurate documentation.
• Sergeants Gracida and Gonzalez continue to excel as first-line supervisors while also serving as Field Training Officers, directly guiding and mentoring new officers through the transition to solo status.
• Our records staff also made significant strides. All members completed POSTcertified Public Records Act training, and Records Clerk Karen Celis successfully finished the POST-certified Records Course, ensuring professional and compliant records management.

II. Recruit and Retain the Best
• The department has welcomed two new officers with prior law enforcement experience—Officer Sergio Climaco and Officer Paul Navarro. Both bring valuable skills and perspectives to our team and are currently in the Field Training Program.

Another officer candidate with previous law enforcement experience is in the hiring process, while one lateral applicant is in the background phase and another in the interview stage.

September 25, 2025 Pg. 36

• Officer Christopher Drake successfully completed the Field Training Program this month and is now serving as a solo officer.
• Detectives and the Property & Evidence team continue to strengthen their partnership, enhancing the management of complex cases. Detectives also supported the Department of Justice and the Kings County Sheriff’s Office during a recent human trafficking operation. Looking forward, one of our Detectives is scheduled to attend the ICI Core Investigators Course in October, which will expand our investigative capacity and reinforce collaboration with regional partners.

III. International Model of Community Trust
• Community outreach remains a high priority. Our Community Service Officer has been developing new pamphlets and flyers to support upcoming CHP and SCIP grant presentations.
• Staff participated in several community initiatives this month, including the Suicide Awareness Walk and the CHP Senior Driving Course. Recruitment efforts for the Police Explorer Program are continuing, with a dedicated event scheduled at the Avenal Theatre on October 1st at 5:30 PM, led by Sgt. Gracida. • In addition, we are preparing to host National Night Out on October 7th, 2025, in the form of a neighborhood block party, which will further strengthen ties with our community.

IV. Among the Safest Cities in America
• Part I crimes continue to trend downward, reflecting proactive enforcement and diligent investigative work. The department is actively managing several complex cases and is making progress toward resolution.
• The Flock Safety Camera system remains 50% installed as we await Caltrans permitting. Although delayed, the cameras already in operation have proven highly effective in supporting investigations and identifying criminal activity. • We are also moving forward with the procurement of a new case management system designed to streamline reporting and administrative processes. This upgrade will allow officers to spend more time in the field and less time completing paperwork, enhancing both efficiency and community presence.

September 25, 2025 Pg. 37

V. Embrace Wellness Among Our Employees
• The department continues to prioritize a positive and supportive work culture.

Leadership remains engaged with staff through open communication, regular checkins, and active participation in daily operations. These efforts ensure that team members feel valued, connected, and encouraged to contribute ideas that improve our mission.
• We also emphasize balance by supporting staff involvement in community events, which promotes both professional engagement and personal fulfillment. Moving forward, we will continue to foster an environment where wellness, growth, and teamwork are central to our success.

The CrisCom Company –
City of Avenal Update
September, 2025
State Update – California Legislative Session
As of September 12, 2025, the California State Legislature has officially concluded its legislative activity for the year, marking the final day for the passage of bills during this session. No additional legislative proposals may advance beyond this date. Governor Gavin Newsom now has until October 12, 2025, to either sign or veto the measures that reached his desk. These bills encompass a wide range of significant policy areas, including climate change, health care reform, labor protections, data privacy, and immigration. The Governor’s forthcoming decisions will be instrumental in shaping the state’s policy trajectory for 2026 and beyond.

Federal Update – Avenal Water Storage Tank Project and Budget Outlook Our $4 million federal funding request for the Avenal Water Storage Tank Project remains on track and under active consideration. We continue to work closely with Congressman David Valadao’s office to ensure that the project remains prioritized as part of the broader fiscal year 2026 appropriations process. At present, there is no indication that individual community project funding requests, including ours, will be removed from the final budget package.

On a broader level, Congress is currently working to avert a federal government shutdown. Last week, House Republicans introduced a continuing resolution aimed at maintaining federal funding at current levels through November 21, 2025. On Friday, the House narrowly passed H.R. 5371, the Continuing Appropriations and Extensions Act, 2026, by a vote of 217–212. This temporary funding measure includes an additional $30 million allocation for congressional security and is designed to provide lawmakers with additional time to finalize a comprehensive, full-year appropriations package.

While this continuing resolution represents a step toward maintaining government operations, several uncertainties remain. Congressional Democrats have proposed a number of amendments, including the extension of healthcare subsidies, and continue to call for more robust bipartisan negotiations. As such, the potential for a government shutdown later this year cannot yet be ruled out.

Donor State Context – California’s Federal Fiscal Balance In response to prior inquiries regarding the flow of federal funds to and from California, it is important to note that the state continues to function as a "donor state" within the federal September 25, 2025 Pg. 40
system. This means that California residents, businesses, and governmental entities contribute more in federal tax revenue than the state receives in federal expenditures.

In federal fiscal year 2022, California paid approximately $48 billion more in federal taxes than it received back in the form of federal spending. This imbalance positioned California last among all 50 states in terms of net federal return. Although temporary federal COVID19 relief funds improved this ranking in 2023—moving California to 26th place—that improvement was not structural and is unlikely to persist. When one-time pandemic relief is excluded, California has been a donor state in eight of the past nine years. The gap has reached as high as $101 billion in a single fiscal year, underscoring the consistent nature of this imbalance.

Several structural factors contribute to this phenomenon. California’s comparatively high incomes result in disproportionately high federal tax contributions, while federal allocation formulas tend to favor states with higher poverty rates, older populations, or significant federal installations (such as military bases). As a result, despite being the largest contributor to federal revenues, California frequently receives a smaller share of federal expenditures relative to other states.

Sacramento Snapshot:

As you may know, we currently distribute a bi-weekly Sacramento Snapshot that provides updates on key state legislation. Antony is already receiving this update, and we would be happy to add any City Council members who are interested as well. If you would like to be included on the distribution list, please let us know.

Economic Development Update:

During the month of September, The CrisCom Company’s economic development efforts have centered on two key priorities: the attraction of retail businesses and the advancement of industrial development opportunities. These parallel initiatives reflect a comprehensive strategy to diversify Avenal’s economic base and foster long-term growth.

On the retail front, our Team is currently developing a Franchise Opportunity Flyer intended to support outreach efforts to both national franchise corporations and local entrepreneurs seeking ownership opportunities. The flyer will emphasize Avenal’s competitive advantages, including its untapped consumer demand, the strength of its regional trade area, and the City’s commitment to supporting new business ventures. This tool will serve as a foundational element in marketing Avenal as a viable and attractive location for franchise expansion and investment.

Concurrently, our Team is expanding its industrial outreach to include real estate developers, site selectors, and corporate leaders in the logistics and supply chain sectors.

Avenal’s strategic location along major transportation corridors in the Central Valley makes it particularly well-suited for warehouse and distribution operations. Outreach efforts have begun with targeted communications designed to highlight the City’s regional accessibility, labor force potential, and cost advantages. These discussions are intended to position Avenal as a competitive option for companies seeking to establish or expand logistics facilities in California’s central region.

Together, these initiatives represent a coordinated and deliberate approach to economic development. By pursuing retail attraction, supporting local franchise ownership, and engaging industrial stakeholders, our Team is laying the groundwork for increased private investment, a broader tax base, and the creation of new employment opportunities. This strategy ensures that both small businesses and national enterprises have the tools and support necessary to thrive in Avenal’s growing economy.

City of Avenal Update
August, 2025
State Update: California Legislative and Budget Outlook Economic and Revenue Context
California remains in a period of fiscal caution as slower economic growth and lower-thanexpected tax receipts continue to put pressure on the state budget. While the budget passed in June helped stabilize short-term gaps, updated revenue data this summer points to continued uncertainty heading into 2026.

Key Themes Shaping Sacramento Policy
The state is operating in a tight spending environment, with most new funding directed toward protecting schools, healthcare, and wildfire mitigation. Discretionary funding for smaller capital projects remains limited. Infrastructure and water policy remain a priority, with continued investment in drought resilience, water storage, and clean drinking water projects, particularly in disadvantaged rural communities. On housing and homelessness, legislative leaders are focusing on streamlining housing approvals and extending support for homelessness programs. However, funding levels for these initiatives remain flat or lower compared to prior years.

Summer Recess
The California Legislature is currently on summer recess and will reconvene on August

18. During this break, no legislative hearings or floor sessions are being held, but members are meeting with constituents and preparing bills for action when the session resumes.

Federal Update: Budget and Policy Landscape
In Washington, Congress is working toward the Fiscal Year 2026 budget while continuing to debate federal spending caps and the national debt limit. These negotiations have slowed progress on appropriations bills, especially those related to infrastructure, transportation, and community development programs.

Congress is currently in its annual August recess, with the House out from late July through September 1 and the Senate on break from August 1 through September 1.

During this time, lawmakers are back in their districts meeting with constituents, attending events, and engaging locally. Behind the scenes, negotiations on spending bills continue, with many measures still unresolved and expectations that final decisions will come later in the fall.

Avenal Water Storage Tank Project - $4M
We are pleased to share that Avenal’s $4 million Water Storage Tank Project has officially cleared the House Appropriations Committee, marking a major milestone in the federal funding process. While this is a significant step forward, final approval will depend on Congress passing a full-year FY26 funding bill. As we experienced last year, projects that advanced this far were ultimately removed when Congress opted for a series of shortterm Continuing Resolutions instead of a comprehensive funding package. While another CR is still a possibility, we’re hopeful that Congress can come together this time to pass an omnibus funding bill that includes our CPF request.

Sacramento Snapshot:

As you are aware, we currently distribute a bi-weekly "Sacramento Snapshot" that provides updates on important state legislation. Antony already receives this update, and we would be happy to add any City Council members who would like to get it as well. If you are interested in being included on the distribution list, please let us know.

Economic Development Update:

Our team has made significant progress aimed at strengthening Avenal’s position as a destination for business growth. We are actively conducting targeted outreach to retail and restaurant operators, with a particular focus on franchise-based models that align with the City’s long-term economic vision. These efforts are not only geared toward attracting well-known brands to our community, but also toward creating meaningful opportunities for local ownership and investment.

To support this strategy, we developed and have updated a Franchise Opportunity Flyer that showcases the advantages of opening a franchised restaurant in Avenal. The flyer includes information on available commercial properties, a step-by-step guide to becoming a franchise owner, and details on the support available from both the City and our team. This resource is being shared with prospective investors, distributed through local networks, and made available to residents who are interested in launching their own business.

Attracting corporate and franchise businesses offers a range of benefits for Avenal. These include expanding the local job market, drawing in customers from surrounding areas, and increasing local spending. The resulting growth in sales tax revenue enhances the City’s ability to invest in public services and infrastructure. Importantly, our approach is designed to complement—not compete with— existing small businesses. The increase in foot traffic and consumer options supports local entrepreneurs, helping to build a more balanced, resilient, and thriving economy.
