PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES:
This time is reserved for members of the audience to address the City Council on items of interest that are both on the Agenda or not on the Agenda, and are within the subject matter jurisdiction of the City Council/Successor Agency. State Law prohibits any member of the Council from commenting or acting on matters not on the agenda. The Council asks that you keep your comments concise and respectful. Ginger Wallis, Avenal resident, requested that Ordinance 2025-03 and Ordinance 2025-02 be read clearly and that Closed Session be moved to the end of the meeting. She also asked why the contract with Kings County was not sent following the previous Council meeting. Additionally, she requested that the meeting minutes reflect public comments verbatim and inquired which other City departments had been established within a few months.
Dalila Barajas, Avenal resident, expressed concern regarding the proposed change from summary minutes to action minutes, stating it would reduce transparency and hinder the public’s ability to hold the Council accountable. She emphasized that the City October 9, 2025 Pg. 5
Council should support the community and noted that her previous comments were not accurately reflected in the minutes, as they were revised to appear more positive than intended.
Francisco Lopez, Avenal resident, shared an invitation to the upcoming Pistachio Festival and provided information about event activities. He also encouraged community members to participate in the talent show.
Richard Valle, Kings County Supervisor, stated that he had met with Mayor Preciado and urged him to sign the contract with the County. He noted that Mayor Preciado initially indicated support for a three-year contract with an 18-month termination clause and amended language. Mr. Valle explained that following a subsequent conversation, Mayor Preciado expressed preference for a six-month termination clause, after which the Kings County Board of Supervisors declined further assistance. He reported that during the Board’s meeting the following day, three options would be presented to the City, and that if no agreement is reached, Kings County Fire Department services in Avenal will end effective October 31, 2025. Mr. Valle stated that if the community is left without fire services, it would be the responsibility of the City Council.
John Chamberlain, Kings County Fire Chief, stated that he has no authority to receive or utilize funds from the City of Avenal and confirmed that he returned the checks and invoices after reviewing a letter from City Manager Antony López regarding prepayments for fire services.
Sheila Verdugo, Avenal resident, urged the Council not to approve the change from summary minutes to action minutes. She expressed that many residents feel unheard regarding fire services, and reducing detail in the minutes would further that concern.
She also requested that the item be pulled from the Consent Calendar and asked Councilmembers, as parents, to consider doing the right thing for the community.
Luther Wallis, Avenal resident, expressed concern about large semi-trucks near the landfill posing a safety hazard and described a recent incident. He also stated that the City should slow down efforts to establish a local fire department and continue providing updates to the community.
Kelly Guzman, Avenal resident (via Zoom), expressed solidarity with residents who feel there is a lack of transparency. She read portions of the recall statement and stated that public access to information should be simple and that residents’ statements should not be minimized. She also requested that the second reading of Ordinance 2025-03 not be waived.
Rita Wallis, Avenal resident, asked why the fire contract from the previous Council meeting had not been sent to Kings County and stated that this inaction is the reason Council is facing a recall, asserting that members are not fulfilling their responsibilities.

AGENDA ITEM NO. 10 – A
TO: The Honorable Mayor and City Council
FROM: Antony V. López, City Manager,
by Cecilio Velasco, Chief of Police
DATE: October 9, 2025
RE: Consider Ratification of the Urgent Purchase of a 2025 Ford Police Interceptor Utility and Authorization for Vehicle Upfitting INFORMATION:
The Avenal Police Department respectfully requests the City Council ratify the urgent purchase of one (1) 2025 Ford Police Interceptor Utility (Non EcoBoost) and approve the associated upfitting required to place the vehicle into operational service.
This vehicle purchase and outfitting are part of the City’s California Highway Patrol Cannabis Tax Fund Grant Program (CHP-CGU), which provides funding to support impaired-driving enforcement and education efforts. The grant stipulates that the Department must complete its Quarter 2 (Q2) vehicle procurement objective within the current project period.
To meet the grant’s deadline, the Department identified the immediate need to secure the 2025 Ford Police Interceptor Utility before model-year availability expired. Delaying the purchase would have resulted in the forfeiture of the current-year allocation and a significant delay, as the next eligible model year (2026) would not be deliverable within the project timeline.
On September 23, 2025, the Department received written approval from the California Highway Patrol Cannabis Grants Unit (CGU) authorizing the City to proceed with both the vehicle purchase and upfitting. The approval was issued by Gianne Ng, Associate Governmental Program Analyst, who confirmed the planned equipment and configuration are consistent with the Department’s current patrol fleet and therefore eligible for reimbursement under the grant.
The vehicle purchase quote was issued by Phil Long Ford of Denver in the amount of $49,805.60, inclusive of transportation to Avenal, under the TIPS cooperative purchasing contract #240901.
The upfitting—including installation of lights, sirens, partitions, consoles, weapons mounts, and electronics—was quoted by Airwave Communication Enterprises in the amount of $21,743.43.
The total project cost is $71,549.03.
The new patrol unit will replace an aging, high-mileage vehicle in the Department’s fleet to maintain operational readiness, safety, and compliance with state and federal grant requirements.

Good afternoon, Gianne,
Yes, I can confirm that the equipment and components listed are consistent with the standard outfitting currently used in our fleet. While the specific products or brands may vary, the outfitting follows the same build style and functionality as our existing vehicles.
We are using a different vendor in this instance due to time constraints in meeting our Q2 goal, as well as recommendations from allied agencies. While we do not have an in-house build department, we can provide comparisons with other vehicles in our fleet if it is required.
Please let me know if you need anything further.

Hi Chief Velasco,
I hope this email finds you well. May I please ask if the items listed on the outfitting quote from Airwave Communications are part of the standard outfitting for your existing vehicles in your department? If so, you may proceed with the purchase of the vehicle and outfitting. Please note at the time of seeking reimbursement, we may request for a letter from your built department to confirm all items are part of your current fleet.

Good Morning,
I’m following up to correct an error in my prior submission. The upfitting invoice included with my request was the wrong version. Please disregard the previously sent upfitting invoice.
Attached are the updated upfitting invoice and a revised memorandum that reflects the updated invoice and amount. All other supporting documents (vehicle quote, window sticker/specs, decal artwork/placement) remain unchanged.
For clarity:
Upfitting: updated invoice attached (supersedes the prior version) Memorandum: revised to reference the updated upfitting amount Vehicle purchase details and timeline: no change
We will not place the order or begin upfitting until CGU approval is received Please confirm receipt and let me know if you’d like me to resubmit the package in a particular format or portal.
Thank you, and my apologies for the mix-up.
Respectfully,

Disclaimer:
This quote is for the named party only and not for distribution. It is a standard quote provided without prior coverage testing. Airwave Communications reserves the right to charge for time and effort in gathering this information if intended for RFP/RFQ or similar purposes. We are not responsible for equipment failures due to testing, programming, or rebooting from age, wear, tear, or factors beyond our control. Additional charges apply for delays causing "stand-by-time" during the job. Monitoring provides a snapshot of frequency noise at the time of testing and does not guarantee against interference. Additional parts and work outside the Schedule of Work will be billed at time and material rates. The seller reserves the right to make design improvements to the goods without notice. Airwave reserves the right to correct any errors in prices or quantities for products or services. Prevailing Wage is assumed not required.
Delays in radio unit availability on programming day may result in extra charges.
Payment Terms:
One hundred percent (100%) of the balance is due as per the agreed net terms from the invoice date. For sales over ten thousand dollars ($10,000), thirty percent (30%) is due upon PO issuance, another thirty percent (30%) upon receipt of equipment or parts at our facility, and the remaining balance upon delivery or pickup. These terms may be modified in writing. Invoices not paid within the agreed net terms will incur a charge of 0.833% of the balance per month (equivalent to ten percent (10%) per annum), as permitted by California law. A seven (7) day grace period applies before late fees accrue.
Customers will be notified of late fees within ten (10) business days of their addition. Payments will first apply to outstanding late fees, then to the principal balance. Disputes over late fees must be submitted in writing within thirty (30) days. These terms are subject to change with thirty (30) days notice. Invoices unpaid for over ninety (90) days may be referred to a collection agency, and customers will be responsible for additional collection fees. These terms are governed by California law. A three-and-a-half percent (3.5%) service fee applies to credit card transactions.
Customer to Provide:
FCC frequency(s) and channel setting(s), 110 A/C power at the agreed equipment location, site access, shaded area, Wi-Fi access (if needed), clear radio placement instructions
(dash/console/desktop/rack, etc.), conduit between rooms or roof, and a lift (if required). For outfitting, vehicle drop-off and pickup must be as scheduled. All personal belongings, weapons, gear, etc., must be removed before delivery. We are not responsible for items left in vehicles. Stand-by time, waiting for POC, vehicles, or delays will be charged at time and materials rates.
Return:
A Return Authorization (RA) number must be requested and issued before returning any products to Airwave Communication. Most products may be returned within thirty (30) days of shipment without a restocking fee if in original packaging and condition for resale. After thirty (30) days, a twenty percent (20%) restocking fee will apply, with a net account credit but no refund unless agreed upon in writing in advance. Credits or refunds for returns will not include prior shipping or service charges. Special or custom orders are non-refundable.
Some parts may be substituted.
Cancellation:
Buyer may cancel an order only with the seller’s written consent, and the seller is entitled to reasonable cancellation charges, including but not limited to labor, material, and overhead expenses. The seller reserves the right to deduct cancellation charges from any advance payment received from the buyer.
Radio Repair:
The price includes parts and return shipping to the customer.
The customer is responsible for shipping the radios to Airwave's facility. If a radio is deemed unrepairable, it can either be returned to the customer or recycled by Airwave for a $65.00 fee, plus shipping and handling (based on actual cost). Any unclaimed units after 90 days will be recycled. This fee can be waived if a new radio unit is purchased as a replacement. A $65.00 diagnostic fee will apply if the in-house repair rate is not approved by the customer. There is a 90-day warranty on labor.
Both original and aftermarket parts may be used. A $25
shipping and handling fee applies to radios under manufacturer warranty. This rate does not cover liquid or physical damage, engraving, licensing, or accessories (batteries, antennas, mics, etc.). Programming is an additional fee if required. Prices are subject to change without notice.
Rentals:
A minimum 3-day rental charge applies. The quoted equipment is for general use. Specific building layouts, vehicle designs, or topological conditions may require additional equipment. FCC itinerant channels are shared commercial frequencies; Airwave does not guarantee service continuity or protection from interference. Prices and promotions are subject to expiration; please consult your Airwave representative for details.
Additional taxes, fees, and other charges may apply. Rental equipment reservations require a 30-day advance notice. The customer is solely responsible for the equipment. Service repairs or alterations to rental equipment are prohibited without prior written authorization from Airwave. The customer will be charged the full retail price for any lost, stolen, or damaged equipment. Additional charges apply for usage beyond the agreed rental period.
Basic Service Agreements:
Includes: Repairs for failures due to normal wear, one annual preventative service check per unit, software/firmware
upgrades, discounts on loaner radios, and services during normal business hours. Excludes: Tax, shipping & handling, pickup or delivery, batteries, antennas, accessories, and damage due to physical or liquid causes. For more details, please refer to the terms and conditions or contact your Airwave representative.
Data Privacy:
Airwave Communication will not share your personal data with any third party, except as necessary to provide and maintain services under these Terms and Conditions.
Important Pricing & Supply Chain Notice:
Recent changes in U.S. trade policy—including the
implementation of new tariffs on select foreign imports—have impacted the cost structure of components used across our product portfolio. Combined with ongoing volatility in the national supply chain, customers may experience extended lead times and price fluctuations for certain products and services. Airwave can only guarantee pricing for 30 days from the date the quote is issued. After 30 days, a new quote must be provided to reflect any manufacturer cost adjustments. For the most up-to-date pricing and availability, please consult your Airwave representative.
Modifications or Additions to Terms and Conditions:
No modifications, additions, or waivers of any of these terms and conditions shall be binding unless provided in writing and agreed upon by the Seller.
