Subject: FY 2026-27 Transportation Development Act Fund Claims Dear Antony:

This letter is to advise claimants of Transportation Development Act (TDA) funds of their area apportionments of the Local Transportation Fund (LTF) for FY 2026-27. The estimate of LTF funds is provided by the Kings County Auditor, and KCAG provides the apportionments based on population percentages of each jurisdiction with the most current Department of Finance population estimate.

Attached is a summary of the “Estimated FY 2026-27 Transportation Development Act Shares”.

Please note that the population percentages will be adjusted when the Department of Finance estimates are released on May 1st. Minor adjustments are also expected as the final budgets for KCAG and Kings County Area Public Transit Agency (KCAPTA) are adopted.

Provided are claim forms for Article 3 and Article 8 funds. Required attachments (signed resolution with County stamped environmental document for street projects, project budgets) must be submitted with your claims to KCAG. Please note the requirement to conduct a public hearing for the purpose of soliciting comments on any unmet transit needs that may exist within your jurisdiction (Corcoran only). KCAPTA will conduct public hearings on member agencies’ behalf on February 25 and March 25, 2026. Each KCAPTA member agency must conduct a public meeting in order to approve their TDA claims. Please refer any public transit requests to KCAPTA and/or KCAG following your public meeting. KCAG will hold public hearings for unmet transit needs on April 22 and May 27, 2026. For information, please see attached KCAG Resolution No. 224 for the procedure for the submission of claims and KCAG Resolution No. 99-06 describing the definitions of “unmet transit needs” and “reasonable to meet”.

Please mail or email your original signed and completed claim forms no later than April 1, 2026 by 5:00 p.m. to KCAG or electronically to [email protected]. State law requires that the claims be filed with the RTPA before that deadline.

If you have any questions or need assistance in this matter, please call me at your convenience at (559) 852-2657.

RE: Consider Approval of Chief of Police Employment Agreement, Amendment #1 INFORMATION:

Chief Cecilio Velasco was appointed and started as Chief of Police on February 12, 2024. Over the past two years, he has demonstrated strong leadership and a clear ability to advance and stabilize operations within the department.

During this time, the department has seen measurable progress, including the successful recruitment and onboarding of multiple new officers, the establishment of a Detective Unit, and improved investigative outcomes, including the timely resolution of serious cases. These efforts have contributed to strengthening public safety services and organizational capacity.

In addition to his leadership of the department, Chief Velasco has continued to invest in his own professional development, obtaining a Bachelor’s degree and completing the POST Executive Certificate Program.

Following a successful two-year performance evaluation, it is recommended that the City Council consider amending the Chief’s employment agreement to reflect his performance and continued leadership. The proposed amendment includes an adjustment to base salary up to $175,000 annually.

Additionally, the amendment includes provisions intended to promote organizational stability and continuity of leadership, including revisions to employment protections and an extension of the agreement term from 2029 to 2031.

The proposed amendment has been prepared in coordination with the City Attorney and is presented for City Council consideration.

RECOMMENDATION:

Approve by resolution an amendment to the Chief of Police Employment Agreement reflecting updated compensation and revised terms, and authorize the Mayor to execute the amendment on behalf of the City.

POLICE CHIEF EMPLOYMENT AGREEMENT
AMENDMENT NO. 1
This Amendment is made and entered into and is effective as of April 1, 2026, between the City of Avenal (“CITY”) and Cecilio Velasco (“EMPLOYEE”), both of whom understand and agree as follows:

WHEREAS, the CITY and EMPLOYEE entered into an employment agreement which became effective on or about January 26, 2024 (“Agreement”), and which was set to expire on or about February 28, 2029;
WHEREAS, EMPLOYEE recently received a favorable annual employment evaluation and CITY desires to continue to employ the services of EMPLOYEE as Chief of Police; WHEREAS, EMPLOYEE recently received an offer from another California municipality to become its Chief of Police, and declined said offer of employment in order to enter into this Amendment to the Agreement (“Amendment No. 1”); and WHEREAS, in light of a recent recall effort, the CITY desires to assure EMPLOYEE’s continued service to the CITY and its residents, and thereby promote stability in public safety services to the public, by entering into this Amendment No. 1 to extend and amend the Agreement only as to those terms provided for herein.

NOW THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows:

1. Section 2, subsection (A) shall be replaced with the following:

Section 2: Term of Agreement.

A. This Agreement shall be effective commencing on February 12, 2024, and the term of this Agreement shall automatically expire at the end of the calendar day (11:59:59 P.M. local time) on February 28, 2031. If a new Chief of Police is not yet selected or sworn in, the CITY shall have the option to extend the term of this Agreement for an additional two (2) years, provided that written notice of the extension is provided to EMPLOYEE no later than sixty (60) days before end of the term or extended term.

2. Section 3, subsection (A) shall be replaced with the following:

Section 3: Compensation and Benefits.

A. CITY agrees to pay EMPLOYEE, for his/her services rendered under this Agreement, a gross annual base salary of one hundred seventy-five thousand U.S. dollars ($175,000 USD) per year. Salary shall be earned and payable on a pro rata basis at the close of each pay period, and paid to EMPLOYEE at the same times, and in the same manner, as full-time salaried 2 of 5
employees of the CITY are paid, and shall be subject to all applicable taxes and withholdings, which may include without limitation Social Security, FICA and employee contributions for the Public Employee Retirement System (“PERS”). In addition to salary, EMPLOYEE shall be eligible to qualify for all of CITY’s differential pay incentives, including but not limited to Bilingual Skills Differential pay.

3. Section 4, subsection (C) shall be replaced with the following:

Section 4: At-Will Employment.
…
C. Termination Without Cause:
(i) The CITY may without cause terminate EMPLOYEE upon thirty (30) days written notice. At the end of said thirty (30) day period, EMPLOYEE’s service to the CITY shall automatically terminate. EMPLOYEE shall be allowed to use accrued vacation, not to exceed ten (10) working days, during said thirty (30) calendar day notification period. If separation hereunder occurs within the first six (6) months of this Agreement, EMPLOYEE shall thereupon be entitled to receive a lump sum severance pay equal to six (6) months salary only (i.e. without any benefits), plus any salary earned as of the final date of employment, and accrued vacation leave. After the first six (6) months of service but before a full twelve (12) months of service, EMPLOYEE shall thereupon be entitled to receive a lump sum severance pay equal to ten (10) months salary only (i.e. without any benefits), plus any salary earned as of the final date of employment, and accrued vacation leave.

If separation hereunder occurs any time after the first twelve (12) months of this Agreement severance pay shall be the same, except that the base salary component shall instead be twelve (12) months. Upon payment of said lump sum, all other obligations of both CITY and EMPLOYEE under this Agreement shall cease. Notwithstanding the foregoing, the limits of Government Code § 53260(a) shall be complied with to the extent applicable. (ii) This subdivision (C)(ii) shall be in effect for two (2) years commencing from the signing of this Amendment No. 1 by both parties, notwithstanding any other provision of the Agreement. In order to be terminated by CITY either with or without cause, three (3) or more Council members (regardless of the number of Council members participating in the vote and regardless of whether or not any vacancies on the Council exist at the time of the vote) must affirmatively vote in favor of consenting to EMPLOYEE’s termination at a regular and duly noticed City Council meeting. Unless otherwise required by law, and notwithstanding any other provision within this Agreement, the parties agree that EMPLOYEE shall not be terminated without cause within twelve (12) months after two or more new members are sworn-in and seated on the City Council, whether by election, 3 of 5
appointment or otherwise, except upon a Council vote of at least four-fifths (4/5) in favor of consenting to termination. It is agreed that the vote of any abstaining Council member shall not count as an affirmative vote for termination even if counted toward a quorum.
(iii) This subdivision (C)(iii) shall be in effect for two (2) years commencing from the signing of this Amendment No. 1 by both parties.

Notwithstanding any other provision within this Agreement, the parties agree that if, within twelve (12) months after two or more new members are swornin and seated on the City Council, whether by election, appointment or otherwise, the City Council decides to terminate EMPLOYEE without cause, then EMPLOYEE shall upon the effective date of such termination be entitled to severance pay of sixteen (16) months of salary only (i.e. without any benefits), subject to the terms and limits established under Government Code § 53260, plus any salary earned as of the final date of employment, and accrued vacation leave.

4. Section 7 shall be replaced with the following:

RE: Consider Approval of Clarification of Differential Pay Incentives for Bargaining Unit 4
INFORMATION:

The City of Avenal currently provides certain differential pay incentives to employees, including but not limited to bilingual pay, educational attainment incentives, and compensation for professional certifications. These incentives are administered at the discretion of the City Manager, based on organizational needs and employee qualifications.

Historically, such incentives have been applied across various employee groups. However, prior Memoranda of Understanding (MOUs) and employment frameworks do not clearly or consistently articulate their applicability to employees in Bargaining Unit 4 (Management).

This item is being brought forward to clarify and formalize that these differential pay incentives may be applied to Management employees, consistent with how they are administered to other City staff. This clarification ensures internal consistency, promotes transparency, and aligns current administrative practices with City policy.

Approval of this item does not create new categories of compensation but affirms the City Manager’s existing authority to administer such incentives on a discretionary basis.

DISCUSSION:

Providing clarity regarding compensation practices is important to ensure equitable treatment across employee groups and to maintain a competitive and transparent organizational structure.

Management employees often possess specialized skills, certifications, and qualifications that align with the intent of existing incentive programs. Clarifying eligibility for these incentives supports recruitment, retention, and organizational effectiveness.

This action also reduces ambiguity in the City’s compensation framework and aligns Management practices with those already applied to other bargaining units.
