REGULAR CITY COUNCIL/SUCCESSOR AGENCY/PF
A MEETING MAY 28, 2026; 5:15 P.M.

AVENAL THEATER & EVENT CENTER, 233 E. KINGS ST., AVENAL, CA Minutes
CALL TO ORDER & PLEDGE OF ALLEGIANCE: by Mayor Preciado 5:28 P.M.

Councilmember Verdugo read a statement prior to Roll Call. He stated that it is his understanding that the Kings County Elections Office has certified the recall results and that, as of this morning, it is now official for four councilmembers. He further stated that there is currently no court order or injunction preventing that certification from taking effect. He also referenced election code provisions regarding the procedure for a vacant council seat. He requested that the City Attorney explain the specific law that authorizes recalled City Council members to continue serving in their seats, directing staff, authorizing expenditures, and taking action on agenda items. He further stated that he objects to the recalled councilmembers participating in votes, expenditures, contracts, closed sessions, litigation matters, or staff direction. He also stated that his attendance should not be interpreted as consent to, waiver of, or validation of any action taken by individuals whose offices have been vacated by law.

Legal Counsel Moses Diaz stated that it is his understanding that information was transmitted by the Kings County Elections Office today. He stated that the matter is not currently on the agenda and therefore must be reviewed and scheduled for a future City Council meeting in accordance with the procedures established by the Legislature in the Elections Code. He stated that on January 14, he requested that the Kings County Registrar of Voters provide an agreement, ordinance, resolution, state law, or other documentation demonstrating that Lupe Villa, Kings County Registrar of Voters, had been delegated authority to conduct any municipal recall election functions or the election itself, and that he has still not received such documentation. He also clarified what he described as another misconception presented by the County, stating that while there had been court proceedings, there was no ruling on the legal merits of the matter. He stated that the Fifth District Court of Appeal indicated that it did not wish to issue an advisory opinion and that, at this point in time, there has been no ruling on the merits and no judgment issued. He further stated that he understands there are individuals in the audience who may have a different view regarding the sitting councilmembers; however, there is a process, and the courts declined to issue a ruling on the merits. It is his understanding that these matters should be discussed at a future City Council meeting.

Mayor Preciado issued a first warning to the audience for disruption pursuant to California Government Code Section 54957.95.

Councilmember Verdugo again restated that he objects to any actions taken by the recalled councilmembers.

ROLL CALL: Councilmembers: Ricardo Verdugo, Pablo Hernandez; Mayor Pro Tem Gamez; Mayor, Alvaro Preciado.

Councilmember Verdugo left the City Council meeting at 5:50 P.M.

Councilmember Hernandez arrived at City Council meeting at 6:03P.M.

ABSENT: Councilmember David Reynosa.

STAFF: McAfee, Morales, Rij, Velasco, Curiel, López.

June 11, 2026 Pg. 5
LEGAL COUNSEL: Moses Diaz.

CITY CLERK:

Government Code Section 54952.3: Members of the City Council/Successor Agency are entitled to receive a total of $450.00 per month due to their serving on the City Council. They receive no other compensation for serving as members of the Successor Agency.

PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES:

This time is reserved for members of the audience to address the City Council on items of interest that are both on the Agenda or not on the Agenda, and are within the subject matter jurisdiction of the City Council/Successor Agency. State Law prohibits any member of the Council from commenting or acting on matters not on the agenda. The Council asks that you keep your comments concise and respectful. Criticism, concerns, or support are welcome, provided they are expressed with appropriate courtesy. Each speaker will be allowed three minutes. A timer will notify you when your time is expired.

Please begin your comments by stating your name and place of residence.

Frank Lopez, Avenal resident, shared information regarding Avenal Rotary Club events, including a recent food distribution event. He stated that up to 250 people participated in the food pickup. He also invited the community to attend Cruise Night, which will be held on the first Tuesday of every month near the theater and will include free food. He further expressed his excitement about the new Avenal Fire Department and stated that he believes they will exceed the community’s expectations.

Lupe Villa, Kings County Registrar of Voters, stated that he was present regarding the results of the April 28 recall election. He stated that the canvass of the recall election had been completed and that the results had been certified in accordance with the Elections Code. He further stated that the certified documents are available online and were electronically provided to the City of Avenal. Mr. Villa explained that, under the Elections Code, when a majority of votes cast on a recall measure for a local officer are “Yes,” the officer is removed and the office becomes vacant until filled according to law. He stated that the certified results show that the four councilmembers received majority “Yes” votes on the recall measure and that those seats are therefore deemed vacant. He also referenced an email he had sent to City staff yesterday, stating that it is customary practice for a City Council to accept certified election results through the adoption of a resolution; however, the City is not legally required to take any additional action for the certification to become effective or to be part of the official record. He further stated that the recall materials will remain part of the public record at the County Elections department and may be viewed online.

Legal Counsel Moses Diaz asked whether Lupe Villa had time to answer questions. Mr. Villa provided his phone number and stated that he would be available to discuss the matter the following day.

Legal Counsel Moses Diaz asked whether Mr. Villa had signed a declaration under penalty of perjury stating that he did not receive a fax from Mr. Diaz on December 25, 2025, that the fax has gotten stuck. Lupe Villa, Kings County Registrar of Voters, stepped away and declined to answer the question. Mr. Diaz asked Mr. Villa to come up, as a public official, and to provide public information.

At the same time, Keith Jackson, who had submitted comments at the previous meeting, stood up, and approached Councilmember Verdugo, and handed him napkins that had been written on.

Kelly Guzman, Avenal resident, stated that she was speaking on behalf of several individuals, at which time members of the audience stood. She stated that they do not acknowledge the meeting as a lawful City Council meeting because it is being conducted with recalled members whose authority, in her view, ended upon certification of the recall results. She further stated that they do not recognize the recalled members as having authority to make decisions unless the City can provide a valid court order allowing them to continue acting after certification. She also stated that the added material on page 11 of the agenda does not reference a valid law. Ms. Guzman stated that she understands the recall results have been certified and that the City Attorney should identify the legal authority being relied upon and place it in writing as part of the public record. She further stated that, without such authority, actions taken by the recalled members may be subject to challenge. Directing her comments to Legal Counsel Moses June 11, 2026 Pg. 6
Diaz, she stated that the judge did not agree with his argument. She also requested that the recalled councilmembers step aside and stated that, if they fail to do so, the community will seek a higher authority to resolve the issue.

Legal Counsel Moses Diaz stated that the document on page 11 of the agenda was added at the request of a member of the public. City Manager López clarified that it has been added at the request of Mr. Keith Jackson. He further stated that, regarding the assertion that the certified results are automatically effective, the Elections Code provides that recall elections are conducted using the same process as a general election, which requires the results to be certified by the City Elections Official to the governing body, and that this has not yet occurred.

Without any comment, Councilmember Verdugo left the City Council meeting at 5:50 P.M.

Recess called at 5:50 PM by Mayor Preciado.

City Council returned to Regular Session at 6:05 P.M. by Mayor Preciado.

To: Avenal City Council
From: Teslla Ramirez, Planning Consultant
Subject: Second Reading of Zoning Text Amendment No. 2026-01 SUMMARY/ RECOMMENDTIAONS:

On May 14, 2026, the City Council approved Zoning Text Amendment (ZTA) No. 2026- 01 and adopted Resolution No. 2026-30. ZTA 2026-01 amends Table 9.08.030-1 of the Avenal Municipal Code to allow "Parking Facility, Off-Site" uses within the Community Commercial (CC) zoning district subject to approval of a Conditional Use Permit.

It is recommended that the City Council conduct the second reading and adopt Zoning Text Amendment No. 2026-01.

BACKGROUND:

ZTA 2026-01 was initiated to amend Table 9.08.030-1 of the Avenal Municipal Code to allow "Parking Facility, Off-Site" uses within the Community Commercial (CC) zoning district subject to approval of a Conditional Use Permit.

The amendment was proposed in conjunction with a request to develop an off-site parking facility intended to support parking demand associated with the nearby Aria Community Health Center. The proposed amendment establishes a discretionary review process for future off-site parking facilities through approval of a Conditional Use Permit and ensures future projects remain subject to Planning Commission review and applicable development standards of the Avenal Municipal Code.

On May 14, 2026, the City Council reviewed ZTA 2026-01, considered all testimony and evidence presented, and adopted Resolution No. 2026-30 approving the amendment and making the required findings.

DISSCUSION AND ANALYSIS:

No changes have been made to ZTA 2026-01 since the City Council's action on May 14, 2026.

The amendment remains consistent with the goals, objectives, and policies of the Avenal General Plan and Title 9 (Zoning Ordinance) of the Avenal Municipal Code. The June 11, 2026 Pg. 11
Report to Avenal City Council (06/11/2026)

amendment will continue to require Conditional Use Permit approval for future off-site parking facilities within the Community Commercial (CC) zoning district.

The item is presented to the City Council for second reading and final adoption.

ENVIRONMENTAL FINDINGS
ZTA 2026-01 is exempt from review for environmental impacts as a “common sense” exemption pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines because the proposed Zoning Text Amendment does not authorize physical development and it can be seen with certainty that there is no possibility the amendment would have a significant effect on the environment. Any future development proposals would remain subject to separate discretionary review and environmental analysis, as applicable.

CONCLUSION
The City Council previously approved ZTA 2026-01 and adopted Resolution No. 2026-

30. No changes have been made since the prior action. Staff recommends the City Council conduct the second reading and adopt ZTA 2026-01.

AGENDA ITEM NO. 6.- 1
TO: The Honorable Mayor and City Council
FROM: Karla Curiel, Deputy City Clerk
DATE: June 11, 2026
RE: Consideration of County of Kings Certification of April 28, 2026 Recall Election Results RECOMMENDATION:

Provide direction and take such action as the City Council deems appropriate regarding the County of Kings' certification of the April 28, 2026 recall election results.

BACKGROUND:

On May 28, 2026, the Kings County Registrar of Voters appeared before the City Council and delivered documentation relating to the certification of results from the April 28, 2026 recall election conducted by the County of Kings.

As the Council is aware, the legality of the recall process, election administration, certification procedures, and implementation of any resulting vacancies has been disputed by the City and remains the subject of ongoing legal disagreement. Attached is a resolution summarizing the factual background, legal concerns, and findings presented for Council consideration.

DISCUSSION:

The City Council may consider several potential courses of action:

Option 1 – Accept the County's certified results.

Under this approach, the City Council would recognize the County’s certified recall results as the official election results for the City and direct the City’s Elections Official to enter and implement those results in the City’s official election records. The City Attorney advises that adoption of this approach may be interpreted as waiving objections to procedural and legal irregularities identified by the City and its legal counsel, including objections concerning the authority of the County to conduct and certify a municipal recall election absent City authorization.

Additionally, because State law no longer provides for the election of successor candidates as part of a recall election, and City Ordinance 2026-04, adopted pursuant to Government Code section 36512(c)(1) requires Council vacancies to be filled by special election, this approach would result in the loss of a Council quorum for months and create legal uncertainty to the City’s ability to conduct future municipal business. The City Attorney has further advised that implementation of the County’s certification may conflict with Elections Code sections 10262, 10263, 10264, and 11328, which assign duties relating to municipal election results to the City’s Elections Official and governing body.

The Council should also consider that acceptance and implementation of the County’s actions may create precedent and be viewed as recognition that a county may initiate, administer, certify, and implement a municipal recall election without a request, authorization, or participation by the affected city. Such a conclusion raises broader legal questions regarding municipal autonomy, local control, and the authority vested in cities and their designated elections officials under State and local law.

919 Skyline Blvd.

Avenal, CA 93204
Phone: (559) 386-5766
AGENDA ITEM NO. 6.- 1
Option 2 – Decline to accept the County's purported recall election results.

Under this approach, the Council would adopt the attached Resolution 2026-37, and decline to recognize the purported recall election results for the reasons stated therein.

This approach would preserve continuity of government while legal disputes regarding the recall process are resolved. Two Council seats are scheduled to appear on the November 2026 ballot. A quorum is necessary to conduct City business, adopt resolutions and ordinances, approve contracts and expenditures, call and consolidate future elections, and ensure the continued operation of municipal government during the pendency of this dispute.

Staff, City officers, and City consultants have continued to perform their duties in good-faith reliance upon legal advice and direction from the City Council during this dispute. Adoption of the attached resolution would provide clear direction regarding the City’s position while preserving continuity of municipal operations and services.

This option would not prevent further review and resolution by the courts, based upon the June 4, 2026 letter from Attorney General Rob Bonta to the County (attached), suggesting that the in quo warranto process to contest the right of Councilmembers to continue to serve would be appropriate.

Option 3 – Take no action and continue review.

Under this approach, the Council could defer action pending additional legal review, court proceedings, or other developments.

While this option would preserve the status quo in the immediate term, it may also prolong uncertainty regarding governance and the status of the disputed recall process. Therefore, I do not recommend it unless the Council needs more information or more time to consider its options.

CONCLUSION/RECOMMENDATION
As the City’s Acting Elections Official, I present the foregoing options for City Council consideration. The decision regarding whether and how to respond to the County's certification of the purported recall election results rests solely with the City Council.

CITY OF AVENAL
IN THE MATTER OF:

Unauthorized and purported municipal recall
election as to council member seats, funded

Kings.

RESOLUTION 2026-_38__
WHEREAS, the CITY OF AVENAL (“City”) is an autonomous municipal corporation and local government entity organized and created by its residences under the authority of article 11 of the California Constitution and the California Government Code; WHEREAS, pursuant to Government Code § 34000, the governing and legislative body of the City is the City Council, and pursuant to Article 11, Section 7 of the California Constitution, the City may make and enforce within its limits all local, police, sanitary and other ordinances and regulations not in conflict with general laws; WHEREAS, pursuant to Elections Code §§ 10400 and 11240, the Legislature of the State of California vested in the governing City Council (“Council”) of the City the authority to call and order municipal elections, including recall elections; WHEREAS, the Legislature in Elections Code § 11002(b) expressly made the City Clerk the “city elections official” for purposes of Elections Code §§ 11000-11386 (“Division 11”), including for purposes of handling recall functions and, as she has recused herself, her deputy serves in that role as to this matter; WHEREAS, the Legislature in Elections Code § 10262 granted authority only to the City Clerk as the city elections official, to certify election results to the City Council; WHEREAS, under Elections Code 11328, the results of a recall election must be declared in substantially the manner provided by law for a regular election for the office; WHEREAS, the Legislature in Elections Code § 10263 granted authority only to the City Council to recite the facts of a municipal election, and to declare the results of a municipal election;
WHEREAS, pursuant to Elections Code § 10002, and only if inclined to do so, the governing body of a city may by resolution choose to request that the board of supervisors of the county to permit the county elections official to render specified services to the city June 11, 2026 Pg. 21

relating to the conduct of a municipal election and, whenever such a choice to outsource is made, said resolution of the city must specify the services requested; WHEREAS, by ordinance, which is partially codified in Avenal Municipal Code (“AMC”) § 2-6.102, the City Council has assigned the City Clerk to be the City’s elections official, and requires adoption of a resolution in order to request the County Clerk to render specific elections services to the City, echoing state law; WHEREAS, the City Council of the City has never adopted a resolution outsourcing to the county elections official of the County of Kings, any of the city elections office functions preceding, leading to or carrying out any municipal recall election, including post-election canvassing or other functions for such a recall election; WHEREAS, Elections Code § 11220(a) provides that “A recall petition shall be submitted to the elections official for filing in his or her office during normal office hours…”;
WHEREAS, no recall petition was ever submitted to the City’s elections official for filing, and accordingly the City’s elections official never found any municipal recall petition to be sufficient under Elections Code § 11224 and never submitted any certificateof-sufficiency to the City Council pursuant to Elections Code § 11227; WHEREAS, on or about November 21, 2025, the Registrar of Voters (“KINGS ROV”) appointed by the Board of Supervisors (“BOS”) of the County of Kings (“COUNTY”), contacted City staff to request, for the first time, to be placed on the agenda of the City Council of the City of Avenal in regard to purported petitions to recall four members of the City Council;
WHEREAS, the KINGS ROV’s activities in furtherance of a municipal recall were motivated by the underlying events which were the subject of the City Council’s findings in Avenal City Council Resolution No. 2026-02;
WHEREAS, in connection with the KINGS ROV’s request to appear on the City Council’s December 11, 2025 agenda, the KINGS ROV claimed that 2,438 of 2,585 total recall petition signatures filed only eight (8) business days earlier, were all manually reviewed and validated by the KINGS ROV, during a time when the KINGS ROV informed a city official that the KINGS ROV’s office was busy completing the canvass of the results of the November 5, 2025State election on Proposition 50 in which the County had a 50% turnout, 90% of which was by mailed ballot, requiring labor-intensive tabulation;
WHEREAS, the KINGS ROV was notified of the lack of a quorum at least an hour before the December 11, 2025 City Council meeting was to begin, but he decided to travel June 11, 2026 Pg. 22

Page 3 of 7 ends

to Avenal anyway and proceeded to proclaim that he effected a delivery of four certificatesof-sufficiency to the “City Council” during a “meeting” where a quorum was lacking under Government Code § 54952.2(a);
WHEREAS, at 6:44 P.M. on December 11, 2025, the KINGS ROV sent an email to the City Manager and the City Council, in which he concluded that “…the delivery of the certificates of sufficiency starts the 14-day period in which the council must call the election… The resolution calling for the recall election should be delivered via electronic email and followed with a hardcopy via USPS. If the City of Avenal fails to submit the resolution by the deadline of December 26, 2025, at 5:00PM, I will have five days to call the recall election.”; WHEREAS, on December 25, 2025, and during the busy holiday season, the City Attorney of the City of Avenal faxed and mailed a cease-and-desist letter to the KINGS ROV, which explained why the KINGS ROV lacked authority, without receiving any official authorization from the City of Avenal, to assert control over municipal recall petitions, citing the relevant statutes;
WHEREAS, the KINGS ROV did not call an election in the five days following the December 26, 2025 — the legal deadline claimed in the KINGS ROV’s December 11, 2025 email to the City Manager;
WHEREAS, the KINGS ROV attempted to submit purported certificates-ofsufficiency to the City Council on January 8, 2026, containing the signature and title of the KINGS ROV, and not the signature and title of the City’s election official, as required by Elections Code § 11227;
WHEREAS, on January 27, 2026, the BOS, and not the KINGS ROV, purported to schedule and call a municipal recall election, citing no authority to do so and, State law, including Elections Code §§ 11240-11241 gives that authority only to the City Council; WHEREAS, under Elections Code § 10002 the BOS only had authority to agree to allow the KINGS ROV to provide services requested by the City Council in a resolution; WHEREAS, the municipal recall election which the BOS purported to call was a stand-alone election the BOS scheduled for April 28, 2026, even though State law disfavors stand-alone elections because they tend to depress voter turnout and the state-wide primary election was to occur just weeks later;
WHEREAS, on Saturday, March 28, 2026, the Board of Supervisors of the County of Kings issued the first of numerous press releases focused on the City of Avenal, indicating that the BOS made a 5-0 decision earlier that day to declare their own public safety emergency and to terminate the Avenal Fire Services Contract under which residents of the City of Avenal had received fire protection services from the County of Kings Fire June 11, 2026 Pg. 23

Page 4 of 7 ends

Department, giving the City only two hours of notice of that decision and denying 13,000 city residents and their unincorporated neighbors essential life safety services for weeks until the City obtained a court order restoring service pending a responsible transition to City service;
WHEREAS, the City’s decision to seek its own fire service was the primary motivation stated by recall proponents;
WHEREAS, the aforementioned March 28, 2026 press release coincided with the arrival of the vote-by-mail ballots the KINGS ROV sent Avenal voters; WHEREAS, the COUNTY continued to issue an unprecedented number of press releases focused upon Avenal leading up to a purported April 28, 2026 municipal recall election called and conducted by the County of Kings, without any authorization from the City of Avenal or under State law;
WHEREAS, based upon votes cast in the COUNTY’s purported April 28, 2026 municipal recall election, approximately 714 ballots were cast from among approximately 2,346 registered voters within the City, resulting in voter participation of approximately 30 percent, just more than half than participation in the November 2024 general municipal election, when City voters cast approximately 1,364 ballots; WHEREAS, under Elections Code § 11242(b) the COUNTY’s purported recall election could have easily been consolidated with the June 2, 2026 statewide primary election, which was likely to attract much greater participation by voters; indeed, as this resolution is drafted, County-wide turnout in the June 2nd election was nearly 37% even as the KINGS ROV’s work to tally the vote continues;
WHEREAS, Councilmembers Alvaro Preciado, Leticia Gamez, Pablo Hernandez, and David Reynosa, who were the subjects of the purported recall, were each elected in regularly scheduled municipal elections conducted pursuant to State and municipal law, following publicly noticed election cycles that included candidate filing periods, public campaigning, voter outreach, and substantially greater voter participation than typically occurs in stand-alone special elections;
WHEREAS, the COUNTY’s arrogation of authority over the City’s municipal election and recall petition process, during the ongoing fire services dispute between those public entities, had the effect of allowing a minority of City voters to purport to recall officials previously elected into office by a greater number of voters and the COUNTY to impose its will in an economic dispute under a smaller, but independent government; WHEREAS, COUNTY’s purported April 28, 2026 municipal recall election was not only without statutory authority, it was a poor measure of the will of Avenal voters for June 11, 2026 Pg. 24

Page 5 of 7 ends

numerous reasons, including low voter turnout, as well as the COUNTY’s editorials as to the fire services dispute in the COUNTY’s numerous press releases leading up to the purported April 28, 2026 municipal recall election and apparent voter confusion as to the motivation and effect of the election on fire services to the community; WHEREAS, pursuant to Elections Code § 10260, the supplies and records of the election shall be returned to the city elections official and shall be disposed of by him or her in accordance with the provisions of the Elections Code, so far as they may be applicable;
WHEREAS, the City’s records reflect that, at least since 2008, whenever the City has requested the County to perform elections-related services pursuant to Elections Code § 10002, such requests have been authorized by formal resolution of the City Council specifying the services requested;
WHEREAS, the City’s elections official has never received the supplies and records of any municipal recall election, and no City recall election has ever occurred under the authority of the City; and
WHEREAS, the City Council, City Manager, City staff, City officers, and City consultants have acted at all relevant times in good-faith reliance upon the advice of legal counsel concerning the unresolved legality of the purported recall process, election, certification, and implementation thereof, and have continued to carry out their lawful duties and responsibilities in order to ensure uninterrupted municipal operations and services to the residents of Avenal;
WHEREAS, abrupt disruption to the continuity of municipal governance through loss of a City Council quorum, would materially impair the City’s ability to provide essential governmental services, including fire protection, police services, public works, utilities, parks and recreation, infrastructure projects, and other ongoing municipal operations conducted for the benefit of Avenal residents; WHEREAS, until such time as a court of competent jurisdiction issues a final order resolving the disputed legal questions concerning the purported recall election and its implementation, the City has a duty to preserve continuity of government and maintain uninterrupted municipal services for the residents of Avenal; WHEREAS, because of the lack of authority of the KINGS ROV and the COUNTY, arising from their failure to timely seek and obtain prior authorization from the City Council under AMC § 2-6.102 and Elections Code § 10002, as well as their coordinated attempts to influence the outcome of the purported April 28, 2026 municipal recall election undertaken solely by the COUNTY, that purported election was not June 11, 2026 Pg. 25

legitimate, and any attempt to ratify it would unlawfully disregard the legitimate votes of all of Avenal voters who previously chose the incumbents during authorized elections, and by larger percentages than those purportedly cast in the COUNTY’s illegitimate municipal recall election granting the differences between a yes/no vote on a recall and the allowance of multiple votes in a multi-candidate field for Council seats.

NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL:

1. Found that the foregoing recitals are true and correct;

2. Found that the COUNTY’s purported April 28, 2026 municipal recall election was not conducted under any of the authority of the City of Avenal and State laws;

3. Declared that the COUNTY’s purported April 28, 2026 municipal recall election was unlawful and ineffective;

4. Found that the City would otherwise be at risk of losing a quorum of members on its City Council, if the purported April 28, 2026 municipal recall election were somehow valid, which it is not, and the incumbents to the four seats at issue on the City Council should holdover as required by Government Code § 1302, until the November 3, 2026 election when two of the affected seats will be contested for full, four-year terms;

5. Authorized and ordered all City staff and consultants to continue to recognize the five incumbents on the City Council, who were previously elected in lawful elections called and ordered by the City Council, as continuing to serve in such June 11, 2026 Pg. 26

RE: City of Avenal 2026 Recall Election
I write on behalf of the Office of the Attorney General regarding recent events related to the recall election held in the City of Avenal on April 28, 2026. That recall election concerned four of the five seats on the Avenal City Council and resulted in a majority voting to recall each of those four members. The Kings County Registrar of Voters certified the election results on May 28, 2026.

Based on court filings and other publicly available information, we understand that, prior to the election, the City of Avenal challenged the election as unlawful under state law.

Specifically, the City alleged that authority to conduct the recall election was vested exclusively with the City’s elections official, its City Clerk. In that suit, the City alleged the recall election was illegal because the proponents of the recall election submitted pertinent documents initiating the recall process to Kings County, not the City, and the City did not expressly delegate its authority to conduct the recall election to the County pursuant to a formal City Council June 11, 2026 Pg. 28

resolution, as provided for in California Elections Code section 10002. The County, by contrast, asserted that the City had a long history of delegating the administration of all municipal elections to the County, and that the City had repeatedly directed the recall proponents to lodge their documents with the County, before actively cooperating and coordinating with the County on preparations for the County’s administration of the election. Only once the pre-election certification process was complete and it became apparent that a recall election would go to the City’s voters did the City withdraw from coordinating with the County, refusing to accept the certification or set a date for the election. The County determined that it was therefore obligated to set an election date pursuant to California Elections Code section 11241. The County maintained that its administration of the recall election was rendered lawful by the City’s affirmative participation and acquiescence in the County’s pre-election process.

On April 23, 2026, after the City filed suit against the County, and sought a preliminary injunction to halt the forthcoming election, the Kings County Superior Court issued an order denying the City injunctive relief. The Court held that the City’s conduct, including referring the recall proponents to the County and participating with the County’s pre-election administrative work, evidenced “substantial compliance” with the requirement in California law that the City delegate its municipal elections authority to the County. The City then sought relief in the Court of Appeal, Fifth Appellate District. After issuing an interim order that permitted the election to go forward but temporarily barred the County from tallying the votes, the Court of Appeal denied the City’s petition on May 13, 2026, explicitly permitting the Registrar of Voters to tally and certify the results. Shortly thereafter, the City voluntarily dismissed its action in the Superior Court.

We also understand that on May 28, 2026, the same day that the Kings County Registrar of Voters certified the results of the recall election, the Avenal City Council held a regularly scheduled council meeting. Three of the four councilmembers who were subjects of the recall and whom the certified results showed had been recalled, took their seats as councilmembers and conducted City business at the meeting (the fourth councilmember did not attend).

The dispute regarding the legality of the April 28, 2026, recall election, and whether the four councilmembers at issue in that election are lawful members of the Avenal City Council, is best resolved by interested local officials or residents through the quo warranto process. Under California law, the exclusive way to challenge an official’s legal right to hold public office is ordinarily through a quo warranto lawsuit. California Code of Civil Procedure section 803 provides that a quo warranto action is available “against any person who usurps, intrudes into, or unlawfully holds or exercises any public office . . . within this state.” Before filing a quo warranto lawsuit against a public official, a party must receive approval from the Attorney General. To obtain the Attorney General’s approval, any person or entity may file an application pursuant to the rules and regulations issued by the Attorney General. (See Cal. Code Regs., tit. 11, §§ 1-11.) An application must include a proposed verified complaint; a verified statement of facts; a memorandum of points and authorities; a notice to the proposed defendant; and proof of service on the proposed defendant. (Id. § 2.) If “leave to sue” is granted and the applicant files a quo warranto suit, the matter is an ordinary judicial proceeding, subject to the procedures and June 11, 2026 Pg. 29
June 4, 2026

rules of the court. However, the applicant must proceed under the direction and supervision of the Attorney General throughout the action. (Id. §§ 7, 8.) Additional information about quo warranto lawsuits and how to apply for leave to file such an action may be found on the Attorney General’s website, here:
https://oag.ca.gov/opinions/quo-warranto. The Office of the Attorney General stands ready to review and issue decisions on any quo warranto applications.

Update from the Chief’s Desk 06/05/2026
The City of Avenal continues to make significant progress in establishing and operating an independent municipal fire department. This initiative remains focused on improving local control, enhancing emergency response capabilities, and building a sustainable, community-centered public safety organization. While much of our early efforts focused on planning, staffing, equipment procurement, and operational readiness, I am pleased to report that the department has now been actively providing fire and emergency services to the community since June 1, 2026. • ORGANIZATIONAL DEVELOPMENT:

Currently, all eight full-time paid professional firefighters are on board and providing service to the City of Avenal. At the same time, we are in the process of adding two additional firefighter interns and have begun onboarding reserve firefighter candidates.

The department has received 18 volunteer firefighter applications and 12 reserve firefighter applications. These positions will play a critical role in expanding service delivery, increasing daily staffing levels, supporting seasonal up-staffing efforts, and creating a more resilient public safety system for the community. I have completed implementation and development of the Fire Resource Management System (RMS) and Learning Management System (LMS) to ensure proper fire reporting, logistical accountability, fire prevention and fleet records management, and training documentation.

The department has also begun development of a SAFER grant application seeking funding for eight firefighter positions. If awarded, the grant would allow the department to transition to a fully paid 4-0 staffed engine company 24 hours per day, 365 days per year. Additionally, work continues on an Assistance to Firefighters Grant (AFG) application focused on fire prevention, life safety, training, operations, and a Type III wildland fire apparatus.

In partnership with Workforce Connection and Calterra, the Avenal Fire Department is developing the Valley Build Disaster Recovery Training Program. This approximately threemonth workforce development program will provide local residents, prospective volunteer firefighters, and community members with industry-recognized certifications and training in emergency response, wildfire mitigation, disaster recovery, emergency management, and public safety.

The program will include certifications such as Emergency Medical Responder (EMR), Community Emergency Response Team (CERT), FEMA Incident Command System courses, OSHA certifications, HAZWOPER, wildland firefighting courses, Search and Rescue Awareness, FAA Part 107 Drone Pilot certification, and numerous additional workforce development certifications.

The Avenal Fire Department's role in the program includes providing classroom space at Fire Station 30, instructional support, and specialized fire service training. I will be teaching the confined space rescue component, while Assistant Chief Morales will provide Emergency Medical Responder instruction. Workforce Connection and Calterra will provide all remaining instructors, equipment, transportation assistance, childcare assistance, supportive services, and program administration at no cost to the City.

June 11, 2026 Pg. 35
Participants who successfully complete the program may also be eligible for a one-month paid work experience assignment funded through the program. This will allow participants to work alongside Avenal Fire Department personnel while earning approximately $20.00 per hour and gaining valuable operational experience. This component will be particularly beneficial for future reserve and volunteer firefighters.

Completion of the program will also certify participants as Community Emergency Response Team (CERT) members. The Avenal Fire Department intends to establish and manage a CERT program within the City to further enhance community preparedness and resilience. • STAFFING AND DEPLOYMENT MODELING: The vision of the Avenal Fire Department remains unchanged: to operate as a professional and progressive combination fire department. The department's minimum daily staffing model consists of a Fire Captain and Fire Engineer assigned to Engine 31. Additional staffing is provided through firefighter interns, reserve firefighters, and volunteers as available.

Since becoming operational on June 1, 2026, Engine 31 has served as the department's primary first-out apparatus and has maintained staffing levels above minimum staffing for the majority of operational periods.
• From June 1 through June 11, Engine 31 staffing consisted of:
o4-0 staffing for four days (Captain, Engineer, Firefighter, Firefighter) o3-0 staffing for five days (Captain, Engineer, Firefighter) o2-0 staffing for one day (Captain, Engineer)
Since beginning operations, the department has responded to approximately 18 incidents.

Incident breakdown includes:
o Medical Illness/Injury Calls: 11 incidents (61%)
o Traffic Collision Responses: 1 incident (6%)
o Vegetation/Outside Fire Responses: 1 incident (6%)
o Other Responses, Cancelled Calls, and Calls Pending Final Documentation: 5 incidents (28%)
Additional response statistics, response time analysis, and performance measures are currently being compiled and will be included in future • FINANCIAL AND BUDGET PLANNING: Comprehensive financial planning has been conducted to ensure long-term sustainability. Operational budgets have been forecasted through Years 1 and 2, and staff continues to explore innovative partnerships, workforce development opportunities, grants, and revenue-generating initiatives designed to improve service levels while minimizing fiscal impacts to the City. • APPARATUS AND EQUIPMENT PROCUREMENT: Existing fleet capabilities continue to be assessed and enhanced. The department has partnered with Fire Apparatus Solutions (FAS) to provide contracted apparatus repair and maintenance services. The 2010 engine is anticipated to arrive shortly, with the 2011 engine expected later this summer. The department has also secured buyers for one Type I engine and the Type III apparatus, with anticipated sales occurring in July. These sales will support the department's fleet realignment strategy and improve long-term fiscal sustainability. Department vehicle graphics and identification markings have been installed throughout the fleet, with minor revisions and additional markings currently being completed.

The department expects delivery of newly ordered structural personal protective equipment (PPE) this week, including complete structural firefighting ensembles, hose, hand tools, June 11, 2026 Pg. 36
power tools, and additional operational equipment necessary to support emergency response operations. Mobile Data Terminal (MDT) computers have been fully programmed, tested, and placed into service. The MDTs are currently operational, and the department is working with Cook's Communications to complete permanent mounting installations within apparatus. • COMMUNICATIONS AND DISPATCH PLANNING: Communications services continue to be provided through Fresno County EMS Communications. The department has been successfully operating on its assigned radio frequencies since June 1 and has completed installation of station alerting systems. Active911 has also been implemented to improve emergency notification and situational awareness capabilities. • POLICY, COMPLIANCE, AND RISK REDUCTION: Organizational policies and fire prevention procedures continue to be developed and implemented. The department has begun receiving requests for business inspections and daycare inspections and is actively scheduling those inspections. Community risk reduction initiatives continue to expand and currently include occupancy inspection programs, weed abatement strategies, fireworks permitting and inspections, construction plan review, public education initiatives, smoke alarm installation programs, and future wildfire mitigation efforts. To improve operational readiness and community familiarity, suppression personnel have been directed to conduct at least one business walkthrough or pre-incident plan each day while on duty. These visits help firefighters become familiar with local occupancies, identify hazards, develop emergency response plans, and strengthen relationships with local businesses. • COMMUNITY ENGAGEMENT AND TRANSPARENCY: Community engagement, public education, workforce development, and community risk reduction remain central components of the department's mission and transition process. Department personnel participated in the Avenal High School Graduation Ceremony, provided standby coverage for graduation and fireworks-related events, attended the Adult School Graduation Ceremony, and continue to participate in community activities throughout the City.

The Fire Department has also partnered with Community Development and local educational programs to establish recurring Friday Fire Department visits and public safety activities throughout summer youth programs. These activities provide opportunities for fire and life safety education, career exploration, emergency preparedness education, and positive engagement with local youth.

The department also conducted a fire and evacuation drill at the Avenal Veterans Hall as part of its ongoing public education and emergency preparedness efforts. The exercise provided an opportunity to evaluate evacuation procedures, reinforce fire and life safety practices, improve occupant preparedness, and strengthen coordination between facility occupants and emergency responders.

Staff is currently developing a Community Emergency Response Team (CERT) Program and Volunteer Firefighter Program to further expand community involvement in emergency preparedness and public safety. To support these efforts, the department is planning a community town hall and meet-and-greet event. The purpose of the meeting will be to provide prospective volunteers and interested community members with information regarding program requirements, expectations, training opportunities, timelines for implementation, and ways to become involved with the Fire Department.

The town hall will also provide an opportunity to discuss the Valley Build Disaster Recovery Training Program partnership and explain how the program can serve as a pathway into June 11, 2026 Pg. 37
volunteer service, CERT participation, workforce development opportunities, and future public safety careers.

To improve transparency and keep the community informed, the department is also finalizing its first community newsletter. The newsletter will provide updates on department operations, staffing, apparatus, community risk reduction efforts, public education programs, future initiatives, and other information important to the residents of Avenal. The newsletter is expected to be distributed electronically, made available on the City's website, shared with community groups, and distributed at public events and meetings.

Public communication materials, including newsletters, community meetings, and future town halls, will continue to be utilized to keep the community informed regarding department progress, service delivery, operational accomplishments, and future initiatives.

I would also like to recognize Captain Alonso Gutierrez, who recently received an Instructor Recognition Award from Fresno City College in recognition of his contributions to firefighter training and service within the Fire Academy program. This recognition reflects the professionalism and dedication of our personnel both within Avenal and throughout the regional fire service community.
• REGIONAL COORDINATION AND MUTUAL AID: Finally, efforts have been initiated to establish regional coordination and mutual aid agreements with surrounding agencies.

Operational procedures for requesting and providing mutual aid within California’s coordinated response system have been reviewed to ensure seamless integration into the broader emergency response network.

We have a lot happening, I will try to keep you informed as changes occur. Think Safe & Be Safe, have a great weekend.

RE: Fire Department Update- Valley Build 14-Week Disaster Recovery Training Program Partnership and Master Fee Schedule
BACKGROUND: Valley Build Workforce Development Partnership The Avenal Fire Department is exploring a partnership with Workforce Connection to host the Valley Build Disaster Recovery Training Program in the City of Avenal. Valley Build is a workforce development initiative that provides participants with training and certifications related to emergency response, disaster recovery, wildfire mitigation, public safety, construction, and community resilience. The program is provided at no cost to participants and is designed to prepare individuals for careers in high-demand fields throughout California.

As a newly established Fire Department, Avenal has an opportunity to do more than simply provide emergency response services. The Department can serve as a regional leader in training, workforce development, and community preparedness. Hosting a Valley Build cohort would bring educational opportunities directly to local residents while creating pathways into careers in public safety, emergency management, construction trades, and related professions.

Beyond workforce development, the program offers tangible benefits to the community.

Participants may assist with projects such as vegetation management, fuel reduction, wildfire mitigation, community beautification, disaster preparedness, and other public safety initiatives.

These efforts support the City’s long-term goals of reducing community risk, improving neighborhood conditions, and increasing overall resilience.

The program also aligns with the Department’s goal of developing a future pipeline of reserve firefighters, volunteers, interns, and public safety professionals. By introducing participants to emergency services and community response concepts, the City can help cultivate future leaders while strengthening local emergency preparedness.

Staff is currently working with Workforce Connection to determine program logistics, participant capacity, scheduling, and facility needs. Potential classroom locations include the Community Center Theater or Technology Center, depending on enrollment and operational requirements. Additional details, including any required agreements, program schedules, and implementation recommendations, will be presented to the City Council at a future meeting.

NEXT STEPS
• Continue discussions with Workforce Connection.
• Identify classroom, training locations, start date.
• Develop program schedule and enrollment process.
• Present any required agreements to the City Council for consideration.

DISCUSSION: Fire Department Master Fee Schedule
Following the establishment of the Avenal Fire Department, staff is evaluating the development of a Fire Department Master Fee Schedule. Prior to June 2026, fire services were provided through Kings County Fire under a contract-for-service model. Under that arrangement, most fire prevention costs were incorporated into the City’s overall contract and not separately identified to the public. Other fees such as inspection, permit, plan review, and standby services (such as for fireworks for the Independence Day show) would incur a separate cost billed to the City.

As the City transitions to operating its own municipal fire department, staff believes it is appropriate to review how specialized services are provided and whether certain activities should be supported through cost recovery when legally permissible. The purpose of a Master Fee Schedule is not to create new taxes or charge residents for routine emergency response services.

Rather, it establishes a framework for identifying services that primarily benefit specific individuals, businesses, contractors, developers, or event organizers and determining whether recovery of associated costs is appropriate.

Examples may include plan review, fire permits, standby services for special events, fireworks standby coverage, re-inspections, false alarm responses, weed abatement administration, and other specialized fire prevention services. Like many neighboring fire agencies, Avenal may determine that some services should remain subsidized by the City while others are appropriate for cost recovery. By having our own municipal department, many of these costs are incorporated into the budget, and will not be charged to the regular resident. However this provides a mechanism should the burden of any of these services take a toll on staff time.

In addition to fiscal responsibility, a fee schedule provides valuable operational information.

Tracking specialized services allows the Department to better understand where staff time and resources are being utilized, identify service demands within the community, and improve future planning and budgeting efforts. As a new department, this information will be important in evaluating service levels and ensuring resources are allocated effectively.

At this time, staff is not recommending adoption of any specific fees. Rather, staff seeks Council direction regarding the development of a proposed Master Fee Schedule and the general policy considerations that should guide its creation. Any proposed fees would be supported by a detailed cost analysis, noticing, and future Council consideration before implementation. Staff hopes to complete this work by the June 25th Council meeting.

NEXT STEPS
• Discuss Fire Department services suitable for cost recovery. • Conduct cost and legal analysis.
• Develop a phased implementation strategy.
• Return to Council with a proposed fee schedule and recommendations.

TO: The Honorable Mayor and City Council
FROM: Griselda Price, Director of Administrative Services DATE: June 11, 2026
RE: Consider Proposed City of Avenal Budget for FY 2026/27; Consider Avenal Successor Agency/RDA Debt Obligation Fund FY 2026/27 Budget; and Consider Proposed Public Financing Authority (PFA) FY 2026/27 Budget INFORMATION:

The City is currently undergoing one of the most active periods of operational transition and capital investment in its recent history. Over the past several months, staff has been focused on the successful establishment and implementation of the Avenal Fire Department, procurement and deployment of fire apparatus and facilities, transition of fire services from Kings County, opening of the new Community Center, major infrastructure and capital improvement projects, and implementation of new financial management and investment strategies.

In addition, the City has recently experienced personnel changes and onboarding of new staff in several key positions. Staff continues to work closely with the City’s financial consultants, Price & Paige, LLP, and the City’s independent auditor, Brett of Van Lant & Fankhanel, LLP, to complete both the Fiscal Year 2023/24 and Fiscal Years 2024- 2025 audits simultaneously in order to bring the City fully current on its financial reporting obligations.

Staff is also actively engaged in several ongoing legal matters requiring coordination with special counsel, the City Attorney, outside consultants, and City leadership. While these matters continue to be managed responsibly and do not impact day-to-day City operations, they have required a significant amount of staff time and administrative resources.

As a result of these competing priorities, staff believes it is in the best interest of the City to adopt an interim operating budget rather than rush adoption of a comprehensive annual budget before all financial information, audit data, departmental projections, and operational assumptions have been fully reviewed and incorporated.

The proposed Operating Budget would authorize expenditures necessary to continue normal City operations, including payroll, contractual obligations, public safety services, utilities, debt obligations, and other routine operating expenses beginning July 1, 2026. The Operating Budget is generally based upon approximately fifty percent (50%) of the prior fiscal year’s adopted budget, adjusted as necessary for contractual obligations, inflationary impacts, personnel costs, and operational needs.

RE: SB 1 Project Funding Commitment: Adopt Resolution No. 2026-38, approving the list of projects for Fiscal Year 2026-27 to be funded by SB 1 – The Road Repair and Accountability Act of 2017.

RECOMMENDATION:

Staff recommends the City Council of the City of Avenal adopt Resolution No. 2026-38, approving the list of projects for Fiscal Year 2026-27 to be funded by SB 1 – The Road Repair and Accountability Act of 2017.

BACKGROUND:

Senate Bill 1 (SB 1), also known as the Road Repair and Accountability Act of 2017, was signed into law in April 2017. The bill provides a significant increase in funding to address California’s transportation infrastructure needs, including local streets and roads. As part of SB 1’s accountability and transparency requirements, each eligible city must annually adopt a resolution listing the specific projects proposed for funding with SB 1 revenue allocated from the Road Maintenance and Rehabilitation Account (RMRA). The resolution must include a project description, location, schedule, and estimated useful life. The City of Avenal is projected to receive $384,167 in RMRA funding for Fiscal Year 2026-27. In accordance with state requirements, a project must be relisted each year if it continues to utilize RMRA funds, even if it was adopted and approved in a prior year.

INFORMATION:

In preparation for this year’s funding allocation, City staff has utilized the City’s Pavement Management System to evaluate and prioritize street improvement projects based on need, costeffectiveness, and community input. The identified project aligns with the City’s goals to enhance roadway safety, improve pavement conditions, and extend the useful life of public infrastructure.

The project identified for Fiscal Year 2026-27 SB 1 funding is a relisting of a previously approved project. Fiscal Year 2026-27 represents the final year in which this project will be programmed for RMRA funding:

TO: The Honorable Mayor and City Council
FROM: Diego Corvera, Contract City Engineer, A&M Consulting Engineers DATE: June 11, 2026
RE: ATP Grant Applications - Adopt Resolution No. 2026-39 authorizing the City Manager to submit funding applications for the Active Transportation Program Cycle 8 to the California Transportation Commission for one infrastructure project and one non-infrastructure project.

RECOMMENDATION:

City Council to authorize the City Manager to submit two (2) funding applications for the Active Transportation Program (ATP) Cycle 8. The following projects are intending to improve safety and promote active modes of transportation and will be submitted for funding to the California Transportation Commission (CTC), for a statewide selection.

1. Oasis on Skyline: Avenal’s Safer Connected Corridor - Infrastructure Project $3.5 million

2. Safer walking and Biking Campaign – Non-infrastructure Project estimated $500K BACKGROUND:

The ATP is a state grant program created to encourage increased uses of active modes of transportation. The purpose of and goals of the ATP include the following:
- Increase the proportion of trips accomplished by biking and walking. - Increase the safety and mobility of nonmotorized users. - Advance the active transportation efforts of regional agencies to achieve greenhouse gas reduction.
- Enhance public health, including reduction of childhood obesity. - Ensure that disadvantaged communities fully share in the benefits of the program. - Provide a broad spectrum of projects to benefit many types of active transportation users.

Cycle 8 of the ATP is funded from various federal and state funding sources to include funds from the federal Transportation Alternative Program, the federal Highway Safety Improvement Program and state funds from the State Highway Account and the SB 1 Road Maintenance and Rehabilitation Account. Approximately $619 million will be available for award to active transportation projects during this funding cycle. The ATP is a competitive statewide program with a funding application deadline of June 22nd to the CTC for funding consideration in the statewide component of the program.

AGENDA ITEM NO. 10. B
ATP funds will be distributed for award into three components: fifty percent (50%) to projects awarded by the Commission on a statewide basis, forty percent (40%) to Metropolitan Planning Organizations (MPO) in urban areas with populations greater than 200,000 (projects awarded by the MPO’s), and ten percent (10%) to small urban rural areas with populations of 200,000 or less awarded by the Commission. Project scores for the statewide component will be announced on November 2, 2026.

The City of Avenal along with the City of Hanford, Lemoore, & Corcoran, and several adjacent unincorporated communities in Kings County are part of the Small, Urban and Rural category of the ATP. This is positive as local agencies within Kings County, qualify under the Small, Urban and Rural Category gaining access to ten percent (10%) of ATP funds beyond the fifty (50%) statewide component. Projects not selected for award under the first round of the statewide component have a second opportunity of receiving an award of ATP funds the Small, Urban and Rural Category.

In preparation to submit projects to the ATP Cycle 8, A&M Consultant Engineering staff referenced the Regional Active Transportation Plan, this plan identified projects to improve nonmotorized forms of transportation, which was finalized in 2025. The plan identifies Skyline Blvd as a primary pedestrian corridor and designates the corridor to incorporate more protected bike lanes.

A&M Engineering Staff conducted an extensive public outreach campaign to gather input and feedback from the community which included outreach meetings, incorporated survey questions online, and created an online website for to residents to gather information on the project and fill out survey questions. Conducting public outreach and engaging with the community is required as part of developing the project to demonstrate the proposed project improvements meet the needs of the community based on the feedback received.

A&M Engineering Staff is currently developing the applications to make them as competitive as possible and the cost for each project may be further refined. For projects successfully awarded for funding, staff will return to Council to request authorization to accepted awarded ATP projects.

RE: Surface Water Treatment Plant (SWTP) Replacement Project – Adopt Resolution No. 2026-40, authorizing the City Manager to submit a Financial Assistance Application to the State Water Resources Control Board for funding to plan, design, and construct the SWTP Replacement Project.

RECOMMENDATION:

City Council to adopt the attached Authorizing Resolution authorizing the City Manager, as the Authorized Representative, to sign and file a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for the planning, design, and construction of the City of Avenal Compliance Evaluation Project (the Surface Water Treatment Plant Replacement Project). Adoption of the resolution will enable the City to pursue funding assistance necessary to deliver the SWTP Replacement Project, the City’s preferred direction to return the water system to compliance with the Total Trihalomethanes (TTHM) Maximum Contaminant Level.

BACKGROUND:

The City of Avenal owns and operates the public water system (Public Water System ID No. 1610002) serving approximately 13,218 consumers through 2,019 connections in southwest Kings County near Interstate 5. The City’s drinking water is supplied entirely by surface water from the California Aqueduct and is treated at two parallel conventional surface water treatment plants (SWTPs) with a combined capacity of 5.3 million gallons per day (MGD). SWTP 1 was originally constructed in 1971 and expanded in 1984, and SWTP 2 was constructed in 1987, making the facilities between, approximately 40 and 50 years old.

In 2022, the City received a Compliance Order from the State Water Resources Control Board, Division of Drinking Water (DDW), for violation of the Total Trihalomethanes (TTHM) Maximum Contaminant Level. The Compliance Order requires the City to take corrective action to return the water system to compliance. The City retained Provost & Pritchard Consulting Group to prepare a Corrective Action Plan (CAP), which was accepted by DDW in 2022. Following acceptance of the CAP, the City applied for and received funding on May 27, 2024 to perform the tasks identified in the CAP.

AGENDA ITEM NO. 10. C
As the first phase of the project, a Preliminary Engineering Report (PER) – the TTHM Compliance Evaluation, dated November 2024 – was prepared to evaluate alternatives to resolve the water quality issues. The PER documented that the existing SWTPs are well beyond their anticipated service life and increasingly vulnerable: clarifier coatings have failed, the Plant 2 headworks screen is out of commission with a single aged bypass valve serving the plant’s entire capacity, and the SCADA control system runs on unsupported servers for which replacement parts are no longer available. Any one of these conditions could impair the City’s ability to supply water.

The PER evaluated five alternatives, ranging from supplementing the source with new groundwater wells and various pre-treatment and ultraviolet disinfection upgrades, to complete replacement of the existing treatment plants. The alternatives are summarized below:
• Alternative A – Supplement source water with new groundwater well(s). • Alternative B – Pre-treatment oxidation.
• Alternative C – UV disinfection for primary disinfection. • Alternative D – UV disinfection for primary disinfection (bacteria only). • Alternative E – Surface Water Treatment Plant replacement.

The preferred project direction is Alternative E, complete replacement of the existing surface water treatment plants with a new package-style treatment plant. Unlike the other alternatives, which would only improve disinfection by-product performance for as long as the aging interconnected facilities continue to operate, the replacement plant addresses TTHM compliance while also restoring reliability, providing full process redundancy, optimizing total organic carbon removal, and reducing long-term operations and maintenance costs. The new plant can be constructed on a separate site without interrupting the existing facilities, which must remain in service throughout construction. For this reason, land acquisition of property adjacent to the existing plant site is required, and the City is currently in the process of securing that property.

The project has since advanced to the 30-percent design level. Based on the 30-percent submittal, the Engineer’s Opinion of Probable Construction Cost is approximately $48.5 million (escalated to the anticipated 2029 construction midpoint), and the Engineer’s Opinion of Probable Project Cost – including engineering, construction management, owner’s contingency, administration, and land acquisition – is approximately $61.6 million. The preferred project is therefore currently estimated at approximately $60 million.

Funding assistance is available through the State Water Resources Control Board’s Drinking Water State Revolving Fund. Approximately $50 million in funding is currently available, leaving an estimated funding gap of approximately $10 million between available funding and the estimated cost of the preferred project. Authorizing the application now allows the City to secure the June 11, 2026 Pg. 78

available funding and continue pursuing additional funding sources to fully fund the project. To submit the Financial Assistance Application, the State Water Resources Control Board requires the City Council to adopt an authorizing resolution designating an Authorized Representative empowered to sign and file the application and to execute the resulting financing agreement on behalf of the City.

FISCAL IMPACT:

Adoption of the Authorizing Resolution commits no City funds; it authorizes the City Manager to submit a Financial Assistance Application and to execute a financing agreement with the State Water Resources Control Board. The preferred project is currently estimated at approximately $60 million, while approximately $50 million in funding assistance is available, resulting in an estimated funding gap of approximately $10 million. Staff will continue to pursue additional funding to close this gap and will return to Council prior to accepting any financing agreement or appropriating project funds.

The Operating Budget reflects and recycles the exact same 2025/2026 City Budget, (with the addition of Avenal Fire Department’s budget as approved on May 14th, 2026, Resolution 2026-32) of the prior fiscal year’s adopted budget, necessary for contractual obligations, inflationary impacts, personnel costs, and operational needs.

AGENDA ITEM NO. 8. A
Staff anticipates returning to the City Council later this summer with a comprehensive Fiscal Year 2026/27 Budget once the audit process, departmental budget review process, and ongoing financial evaluations have been completed.

RECOMMENDATION:

The City, Successor Agency/RDA, and Public Financing Authority are required to have appropriations in place by July 1, 2026, in order to continue normal operations.

Accordingly, staff recommends the following:

1. Open and continue the Public Hearing(s) regarding the Fiscal Year 2026/27 Budget; (No Fees at this time).

2. Adopt FY 2026/27 Operating Budgets by Resolution for the City, Successor Agency/RDA, and Public Financing Authority;

3. Authorize continued expenditures necessary for payroll, contractual obligations, public safety operations, utilities, debt service, and other essential governmental functions;

4. Continue working with Price & Paige, LLP and Van Lant & Fankhanel, LLP to complete the Fiscal Year 2023/24 and Fiscal Years 2024 - 2025 audits and incorporate those findings into the final budget document;

5. Direct staff to return with a comprehensive Fiscal Year 2026/27 Budget for consideration and adoption during the first quarter of the fiscal year. **Resolutions for consideration to adopt Operating Budgets are attached.
