AMENDMENT NO. 1 TO
AGREEMENT NO. 2024-249
THIS AMENDMENT NO. 1 TO AGREEMENT NO. 2024-249 is made and entered into on ______________________, by and between the CITY OF BAKERSFIELD , a chartered City and municipal corporation (referred to herein as “CITY”), and Accenture Infrastructure & Capital Projects (I&CP), LLC (Accenture) , formerly known as Anser Advisory Management, LLC, (referred to herein as “MANAGER”).
R E C I T A L S
WHEREAS, CITY and MANAGER entered into Agreement No. 2024-249 on September 25, 2024, wherein MANAG ER would provide Construction Management Services ("CM Services" herein) for the Centennial Corridor EB58 to NB99 Loop Connector (the “PROJECT”) for an amount not to exceed $3,491,589.00; and
WHEREAS, Accenture acquired and integrated with Anser Advisory Management, LLC, resulting in the chan ge to certain corporate naming and branding; and
WHEREAS, Accenture desires to accept, undertake and perform all of Anser Advisory Management, LLC’s obligations and responsibilities as MANAGER under Agreement No. 2024-249 and City consents and agrees to such assignment/transfer; and
WHEREAS, notwithstanding Section 39.4 of Agreement No. 2024-249, CITY and Accenture hereby agree to amend the Agreement to reflect the assignment of all rights and obligations of MANAGER from Anser Advisory Management, LLC to Accenture Infrastructure & Capital Projects (I&CP), LLC.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and MANAGER mutually agree as follows:
1. Section 8 of Agreement No. 2024-249 entitled “CONTRACT ADMINISTRATOR” is amended as to the MANAGER’s Construction Manager, to read as follows:

2. Section 39.3 of Agreement No. 2024-249 entitled "Notices" is amended as to the address for MANAGER, to read as follows:

3. Except as amended herein, all provisions of Agreement No. 2024-249 shall remain in full force and effect.
