MEETING DATE: 1/8/2025 AGENDA CATEGORY: Consent – Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: 12/12/2024
SUBJECT: Contract Change Order Nos. 91, 97, 104, 124, 154, and 161 to Agreement No. 19-069 Contract Change Orders with Security Paving Company (increasing compensation by $21,870.83; revised not to exceed $151,852,659.29) for the Centennial Corridor Mainline Project. (Wards 1, 2, & 3)
RECOMMENDATION:
Staff recommends approval of the change orders.
BACKGROUND:
The Centennial Corridor Mainline Project (Project) proposes to extend State Route 58 (SR -58) from the current terminus as a freeway at State Route 99 (SR -99) to the Westside Parkway. At the SR -58/SR-99 interchange, the Project adds a collector -distributor on the northbound SR -99 and constructs a new northbound to westbound connector. The Project also includes various local road improvements including; realignment and introducing cul-de-sacs at the end of local roads along the corridor, widening and realignment of Chester Avenue at SR -58, and construction of a traffic signal at the eastbound SR-58 ramps/Brundage Lane intersection (which is part of the SR -58/Cottonwood Road interchange). This Project was awarded in July of 2019 and has an estimated completion date of summer 2024.
Change Order No. 91 provides compensation to th e contractor to modify the temporary striping on the northbound 99 lanes. An adjacent Caltrans project to the north had the freeway reduced to 3 lanes. This change order accommodates for the 3 lanes instead of 4 called out per plans. This change order results in an estimated increase of $15,000.00.
Change Order No. 97 decreases compensation to the contractor for an adjustment of the shoulder structural section and cross -slope at Retaining Wall 569. The shoulder section on top of the footing for this wall could not be constructed as shown on the plans, given that the top of the footing ended up being into the shoulder structural section. The height of drain inlet also increased by 0.2 feet for this change.
This change order results in an estimated decrease of $270.15.
Change Order No. 104 provides compensation to the contractor for incurred costs for different site conditions. An existing streetlight at the intersection of Ford and Morrison was in the way of Drainage System No. 14. The light had to be removed and reinstalled. In addition, the overhead wires feeding this light were removed by PG&E, which in turn resulted in having the contractor look for other means of powering this light. Lastly, the plans show a point of connection for the soffit lighting at Ford and Dunlap Street, but this service turned out to belong to a telecommunication company. The contractor installed additional wiring not shown on the plans to connect to this point before it was discovered that the service did not belong to the City. This change order results in an estimated increase of $10,000.00.
Change Order No. 124 decreases compensation to the contractor as a result of eliminating the pedestrian bridge item from the scope of work. In the interest of closing this project out, this work has been removed but will be completed under a separate contract . This change order results in a net decrease of $76,859.02.
Change Order No. 154 provides compensation to the contractor for the installation of traffic stripe on the (1) N99 to E58 connector, (2) S99 to E58 connector, and (3) E58 alignment. The project final striping plans showed the connector t ying two lanes of traffic into two existing lanes of traffic , however, the existing conditions had only one lane of traffic to tie to. Previous projects reduced the number of lanes to one and did not put back the two lanes. Caltrans has requested that the two lanes of traffic on the connector be restored and that a fourth lane on Hwy 58 be striped passed Chester Avenue. This change order results in an increase of $64,000.00.
Contract Change Order No. 161 provides compensation to the contractor for the removal of buried manmade objects encountered during excavation activities throughout the project. The original funds allocated for the removal of manmade objects under Change Orders No s. 2 ,75 , and 93 have been depleted. This change order results in an increase of $10,000.00.
The Contractor has refused to sign these change orders alleging additional time and money. However, the Contractor needs to substantiate the request for time and money. In a good faith effort to make payments to the Contractor, staff recommends unilateral approval of these change orders using the engineer's calculated quantities and without the Contractor's signature. If th e Contractor later submits acceptable justification for revisions to this change order, staff will review the additional information and, if changes are warranted, a supplemental change order may be in place on a future City Council Agenda.
