ADMINISTRATIVE REPORT

MEETING DATE: January 8, 2025 AGENDA CATEGORY: Consent - Resolution TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: December 3, 2024
SUBJECT: Resolution of Intention 2223 to add Area T-31 to the Traffic Signal Maintenance District.

Resolution of Intention No. 2223 to form Traffic Signal Maintenance District designated as TS-31 (Parcel Map 12514) and preliminarily adopting, confirming, and approving the Public Works Director’s Report.

RECOMMENDATION:

Staff recommends adoption of the resolution of intention.

BACKGROUND:

City of Bakersfield Resolution No. 161-94 instituted the collection of maintenance and operating costs for convenience traffic signals through maintenance districts. A “convenience” traffic signal is a traffic signal not required by the Traffic Authority to regulate traffic flow but is a traffic signal installed solely at the discretion of the developer of a commercial site. Under the user -pay concept, the private property deriving benefits bear the costs of maintenance and operation of convenience traffic signals through assessments with the Kern County Tax Collector. Maintenance and operation of these traffic signals is performed by City forces or by private contractor(s).

A written request has been received by the City Engineer from the owner(s) of the parcels to form a Traffic Signal Maintenance District (TSMD) as required by section 13.04.021 of the Municipal Code. Formation of this TSMD will provide for the operation and maintenance of a convenient traffic signal. The owner(s) of the parcels have submitted a signal synchronization study that shows that the proposed traffic signal will not significantly degrade signal coordination and that the location meets current or future signal warrants.

The City Engineer has also received a letter from the owner(s) of the property described above which waives the public hearing concerning the formation of a TSMD. This allows the City to expedite the maintenance district process to satisfy the subdivision requirement. The owner(s) also have submitted a Proposition 218 ballot indicating their consent to the assessments.

In order to provide future owners with disclosure regarding the formation of a TSMD, a covenant has been drafted and will be recorded with the Kern County Assessor -Recorder’s Office upon approval of this resolution. Staff is recommending the TSMD be formed at the next City Council meeting.

FISCAL IMPACT:

The revenue from Traffic Signal Maintenance Districts partially supports ongoing maintenance in the districts for the year. There is some General Fund support on an annual basis for the short fall in the TSMD revenue collected citywide.

COUNCIL GOAL:

Reliable Infrastructure
