ADMINISTRATIVE REPORT

MEETING DATE: 1/22/2025 AGENDA CATEGORY: Consent – Agreements TO: Honorable Mayor and Council
FROM: Zachary Meyer, Public Works Director
DATE: 1/8/2025
SUBJECT: Contract Change Order Nos. 12, 25, 51, 64, 71, 87, and 88 to Agreement No. 18-176 with Security Paving Company
(increase compensation by $69,590.41; revised not to exceed $51,847,621.93) for the Bakersfield Freeway Connector Project (Wards 1 & 2).

RECOMMENDATION:

Staff recommends approval of the change orders.

BACKGROUND:

The Bakersfield Freeway Connector Project will construct improvements along westbound State Route (SR) 58 and southbound SR-99. The improvements include an additional auxiliary lane on westbound SR- 58, realignment of the westbound SR-58 to southbound SR-99 connector, construction of a branch connector for SR-58 to southbound SR-99 and construction of a collector distributor along southbound SR-99 for the Ming Avenue off-ramps.

Change Order No. 12 provides compensation to the contractor to design, install, and remove shoring at W58/99 Separation (Widen) Abutments 1 and 4 wingwalls and to remove all the wingwall at these locations. This change order results in an estimated increase of $35,000.00.

Change Order No. 25 provides compensation to the contractor for the installation of cable railing above the stairwell of the Belle Terrace Pump Plant which was not included in the original plans. This change order results in an estimated increase of $9,880.

Change Order No. 51 provides stations for the locations of two extinguishable message signs along the westbound 58 to southbound 99 connector. This change order does not result in any additional costs.

Change Order No. 64 provides compensation to the contractor for modifications to the anchor block, concrete barrier, and metal beam guard rail at the northwest corner of the Belle Terrace Overcrossing on the MI5 alignment. This modification was to resolve a conflict with drain inlets at the same location.

This change order results in an estimated increase of $17,850.00.

Change Order No. 71 provides for a change in the falsework traffic opening along the southbound 99 to Ming off-ramp. The opening was reduced from 30’ wide to 22’ wide which also reduces the lanes from 2 to 1. This change order does not result in any additional costs.

Change Order No. 87 provides compensation to the contractor to close a gap between soundwall and cable railing along Retaining Wall No. 48. This change order results in an estimated increase of $1,485.00.

Change Order No. 88 provides compensation to the contractor for incurred costs because of having to

stop work on November 1, 2022. The contractor was ready to install loop detectors and piezo sensors per plan on southbound 99 until it was discovered that the loops were to be installed along a lane shift which would result in the piezo sensors straddling the longitudinal joint. Caltrans requested to not install the loops and sensors until they determine a more ideal location with new striping plans. The contractor incurred costs related to lodging and labor and equipment being on standby. This change order results in an estimated increase of $5,375.41.

The Contractor has refused to sign these change orders alleging additional time and money. However, the Contractor needs to substantiate the request for time and money. In a good faith effort to make payments to the Contractor, staff recommends unilateral approval of these change orders using the engineer's calculated quantities and without the Contractor's signature. If the Contractor later submits acceptable justification for revisions to this change order, staff will review the additional information and, if changes are warranted, a supplemental change order may be in place on a future City Council Agenda.
