ADMINISTRATIVE REPORT

MEETING DATE: February 12, 2025 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: January 21, 2025
SUBJECT: Resolution to add Area T-31 (Parcel Map 12514) to the Traffic Signal Maintenance District and approving, confirming, and adopting the Public Works Director’s Report (Ward 5)

RECOMMENDATION:

Staff Recommends adopting the resolution.

BACKGROUND:

On January 8, 2025, the City Council adopted Resolution of Intention No. 2223 to form a Traffic Signal Maintenance District as required by section 13.04.021 of the Municipal Code. Formation of the Traffic Signal Maintenance District will provide for the operation and maintenance of a convenience traffic signal. A "convenience" traffic signal is a traffic signal not required by the Traffic Authority to regulate traffic flow, but is a traffic signal installed solely at the discretion of the developer of a commercial site.

Under the "user-pay" concept, the private property deriving benefit bears the costs of maintenance and operation of convenience traffic signals through assessments collected by the Kern County Tax Collector.

Maintenance and operation of these traffic signals is performed by City forces or by private contractor.

Staff is recommending the formation of a new Traffic Signal Maintenance District.

The City of Bakersfield has received a letter from the owner(s) of the property described above which waives the public hearing concerning inclusion in the Traffic Signal Maintenance District. This allows the City to expedite the maintenance district process to satisfy the subdivision requirement. The owner(s) also have submitted a Proposition 218 ballot indicating their consent to the assessments.

In order to provide future property owners with disclosure regarding the inclusion of land in the Traffic Signal Maintenance District and the estimated maximum annual cost per equivalent dwelling unit, a covenant has been drafted and will be recorded with the Kern County Assessor-Recorder’s Office upon approval of this Resolution.

FISCAL IMPACT:

The revenue from Traffic Signal Maintenance Districts partially supports ongoing maintenance in the districts for the year. There is some General Fund support on an annual basis for the shortfall in the TSMD revenue collected citywide.

COUNCIL GOAL:

Reliable Infrastructure
