ORDINANCE AMENDING SECTION 12.36.010 AND
ADDING SECTION 12.36.015 OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO CONSTRUCTION BY
BUILDER.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Section 12.36.010 of the Bakersfield Municipal Code is hereby amended to read as follows:
12.36.010 Construction by builder. Definitions.
Whenever used in this chapter, unless a different meaning clearly appears from the context, the words set out in this section shall have the following meanings:
“New Construction” means a site where a new or modified structure is constructed on a site without complete built out offsite improvements. “Existing Construction” means a site where a new or modified structure is constructed on a site with complete built out offsite improvements to a current or previous standard.
“Offsite Improvements” are physical improvements made outside of a property’s boundaries to support a development or address infrastructure issues. They can include roads, sidewalks, sewer lines, storm drain systems, utilities, and landscaping.
12.36.015 Construction by builder.
A. New Construction
Any owner, lessee or agent constructing or arranging for the construction of any of the following:

2. Any property required to be used for off-street parking as set forth in Sections
17.58.010 through 17.58.050 within the city, shall also provide concrete curbs, gutters, sidewalks, streetlights, driveway approaches, alleys, connecting pavement and canal fencing in accordance with approved “City of Bakersfield Standard Drawings and Specifications” on file in the office of the director of Public Works and dedication of all required street rights -of-way or as required by the City Engineer. Compliance with current Americans with Disabilities Act regulations is mandatory. The foregoing is applicable in all zones of the city as established by Title 17 of this code.
B. Existing Construction
Any owner, lessee or agent constructing or arranging for the construction of any of the following:

Any building altered or expanded that exceeds 75% of the valuation threshold as defined in Section 11B -202.4, Existing Building Facilities of the current California Building Code, as may be amended from time to time; in excess of twenty-five percent of the value of such building, as indicated by the assessed valuation;
2.3. Any building in which there is a change in occupancy use (i.e., new owner-occupant or new tenant office to a restaurant) where a building permit is required;

Any property required to be used for off -street parking as set forth in Sections 17.58.010 through 17.58.050 within the city, shall also provide concrete curbs, gutters, sidewalks, streetlights, driveway approaches, connecting pavement and canal fencing in accordance with approved “City of Bakersfield Standard Drawings and Specifications” on file in the office of the director of public works and dedication of all required street rights -of-way or as required by the Ci ty Engineer, unless the public works director or its designee determines that the above requirements are already adequately satisfied along all street frontage adjoining the lot or lots on which the building is currently located. Compliance with current Americans with Disabilities Act regulations is manda tory. The foregoing is applicable in all zones of the city as established by Title 17 of this code.

SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the Bakersfield Municipal Code and shall become effective thirty (30) days from and after the date of its passage.
