SUBJECT: Contract Change Order No. 29 to Agreement No. 18-176 with Security Paving Company (increases compensation by $50,765.10; revised not to exceed $51,898,387.03), for the Bakersfield Freeway Connector Project. (Wards 1 & 2)
RECOMMENDATION:
Staff recommends approval of the change order.
BACKGROUND:
The Bakersfield Freeway Connector Project will construct improvements along westbound State Route (SR) 58 and southbound SR-99. The improvements include an additional auxiliary lane on westbound SR- 58, realignment of the westbound SR -58 to southbound SR -99 connector, construction of a branch connector for SR -58 to southbound SR -99 and construction of a collector d istributor along southbound SR-99 for the Ming Avenue off-ramps.
Change Order No. 29 provides compensation to the contractor for providing and installing the PG&E power service underground ducts and transformer pad per the PG&E design drawings for the loo p ramp lighting and Belle Terrace Pump Plant. The PG&E power service designs were completed after the project bid drawings were issued. This change order results in an increase of $50,765.10.
The Contractor has refused to sign this change order alleging additional time and money. However, the Contractor needs to substantiate the request for time and money. In a good faith effort to make payments to the Contractor, staff recommends unilateral approval of this change order using the engineer's calculated quantities and without the Contractor's signature. If the Contractor later submits acceptable justification for revisions to this change order, staff will review the additional information and, if changes are warranted, a supplemental change order may be in place on a future City Council Agenda.
FISCAL IMPACT:
The sum of all change orders to date on this project reflects a total cost increase of $3, 311,992.03 which results in a 6.82% increase of the original contract amount as illustrated below:
Original Contract Amount = $48,586,395.00
Previous Change Orders = $3,261,226.93
Current Change Order = $50,765.10
Amended Contract Agreement after CCOs = $51,898,387.03
Net Increase to date = $3,311,992.03
There is no General Fund impact associated with this change order.
