TO AGREEMENT NO. 2023-077
THIS AMENDMENT NO. 2 TO AGREEMENT NO. 2023-077 is made and entered into on _____________________, by and between the CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY”), and CALIFORNIA WATER TECHNOLOGIES, LLC (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, on March 22, 2023, the CITY and CONTRACTOR entered into Agreement No. 2023-077 in the amount of $ 189,795.81 for the supply of ferric chloride; and
WHEREAS, on March 13, 2024, Council approved Amendment No. 1 to extend the agreement term one year to allow continuance of providing the supply of ferric chloride.
WHEREAS, the parties desire to enter into Amendment No. 2 to Agreement No. 2023-077 to extend the term by one year to continue the supply of ferric chloride.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows:
1. Section 4 of Agreement No. 2023-077 entitled “TERM” is hereby amended to read as follows:
4. TERM. Unless terminated sooner, as set forth herein, CONTRACTOR shall provide services for an additional one (1) year term beginning March 22, 2025. The agreement shall be renewable for two (2) consecutive one- year periods at the City’s option and upon mutually agreeable terms.
2. Except as amended herein, all provisions of Agreement No. 2023-077 shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. two (2) to Agreement No. 2023-077 to be executed the day and year first above written.
