SUBJECT: Pipeline Crossing License Agreement with Union Pacific Railroad Company (not to exceed $47,530)
to allow the construction of a sewer pipeline from South Allen Road (Ward #5).

RECOMMENDATION:

Staff recommends approval of the Pipeline Crossing Agreement.

BACKGROUND:

Bolthouse Land Company, LLC is proposing to develop a parcel of land along the future South Allen Road alignment, north of the Union Pacific Railroad tracks. As a condition of app roval for the project, the developer is required to extend the existing sewer line along South Allen Road, south of the railroad tracks.

Upon completion, this sewer pipeline will be maintained by the City of Bakersfield.

To obtain approval for the propose d improvement plans, the developer must secure an easement from Union Pacific Railroad. Union Pacific has drafted a Pipeline Crossing License Agreement, which must be executed between the City and Union Pacific to facilitate the necessary improvements.

The Public Works Department has reviewed the proposed improvement plans and agreements and is recommending that the City Council approve the Pipeline Crossing License Agreement. This agreement, which outlines the terms for the sewer pipeline installation, is necessary to ensure compliance with project conditions and to allow the developer to proceed with the required improvements.

FISCAL IMPACT:

There will be no financial impact to the City. The proposed sewer line will be bonded for by the developer and they will pay all required fees to Union Pacific Railroad for processing this agreement.

COUNCIL GOAL:

Reliable Infrastructure.
