AGREEMENT NO.
AMENDMENT NO. ONE [1] TO
AGREEMENT NO. 2023-147
THIS AMENDMENT NO. ONE (1) TO AGREEMENT NO. 2023-147 is made and entered into on ________________, by and between the CITY OF BAKERSFIELD, a charter city and a municipal corporation (referred to herein as “CITY ”), and SAN DIEGO LANDSYSTEMS, LLC. a Corporation authorized to do business in California (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, on June 28 , 2023, the CITY and CONTRACTOR entered into Agreement No. 2023- 147, wherein CONTRACTOR would provide maintenance at designated public landscape areas in the form of streetscape and median landscape maintenance for $543,600.00 at an initial 3-year period; and
WHEREAS, there are areas of streetscape and median pockets that are currently not maintained within the existing maintenance of Zone 4 as listed on Exhibit C; and
WHEREAS, the CITY now desires to expand the maintenance of Zone 4 to encompass the streetscape and median pockets as listed in Exhibit C through the end of the current three (3) year period; and
WHEREAS, CITY and CONTRACTOR have agreed to expand the streetscape and median maintenance of Zone 4 by doing the following: increase compensation by $71,200.00, to a new not to exceed amount of $614,800.00.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree to amend Agreement No. 2023-147 as follows:
1. Section 2 of Agreement No. 2023- 147 entitled “ COMPENSATION” is hereby amended to read as follows:
2. COMPENSATION. Compensation for all work, services
or products called for under this Agreement shall consist of an increase of $ 71,200.00 for a new total NOT TO EXCEED $614,800.00. The compensation set forth in this section shall be the total compensation under this Agreement including, but not limited to, all out -of-pocket costs and taxes. shall pay only the compensation listed unless otherwise agreed to in writing by the parties.
2. Except as amended herein, all other provisions of Agreement No. 2023- 147 shall remain in full force and effect.
