BACKGROUND:

The Recreation and Parks Department needs to install a new restroom facility at Stiern Park located at 5201 Monitor Street and to replace the restroom facility at Jefferson Park located at 801 Bernard Street.

Council approved Stiern Park Restroom Project (P3C136 00) and Jefferson Park Restroom Project (P3C14400) collectively “Project” in the FY 2022-23 Capital Improvement Program. On November 6, 2024, Council approved Resolution 156 -2024, authorizing Staff to purchase two pre -engineered and pre - manufactured flush toilet restroom buildings for the Project.

On February 4, 2025, Staff issued a Bid Proposal for the site preparation and i nstallation of the pre - engineered and pre-manufactured flush toilet restroom buildings for the Project. The Engineer’s Estimate for this Project is $460,546.00.

On February 27, 2025, six bids were received for this Project:

Ken E. Smith Construction Inc. $334,387.00
Proffitt Construction Inc. dba Superior
Construction
$371,707.40
SW Construction $379,047.82
JL McDaniels Companies Inc. dba McDaniels
Construction
$461,400.00
Panico Excavation Inc. $648,700.00
Derrick D Enterprise Inc. $864,810.00

Staff reviewed the bid proposals submitted by each vendor and all were deemed responsive. Staff finds the bid proposal submitted by Ken E Smith Construction Inc. (Contractor) in the amount of $334,387.00, was deemed acceptable and recommends approval of an agreement for a not to exceed amount of $334,387.00.

Staff is requesting the approval of $ 50,000.00 for City-controlled contingency for unforeseen conditions encountered during the Project. Any exceedance of the City Council approved contingency, cumulative or otherwise, would require the action and approval of the City Council. This City -controlled contingency saves staff time by not having to prepare multiple Council reports for individual change orders throughout the project, which can typically cause delays in completion of the project. All remaining contingency funds not used will be returned to the fund balance at the end of the Project.

FISCAL IMPACT: This Project is funded by Public Safety and Vital Services funds within the Capital Improvement Program and no additional funding is needed at this time.
