AMENDMENT NO. 3 TO
AGREEMENT NO. 2021-242
This AMENDMENT NO. 3 TO AGREEMENT NO. 2021-242 is made and entered into on ________________, by and between the CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY”), and RINCON CONSULTANTS, INC. a Corporation authorized to do business in California (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, on October 20, 2021, CITY and CONTRACTOR entered into Agreement No. 2021- 242, wherein CONTRACTOR agreed to perform the tasks outlined therein in preparation of the General Plan Update, for a total not to exceed the amount of $2,766,189.00; and
WHEREAS, on November 2, 2022, CITY and CONTRACTOR entered into Amendment No. 1 to Agreement No. 2021- 242, to expand the Scope of Work and increase compensation by $296,798.00 for purposes of completing a zoning ordinance update to accompany the General Plan Update, for a new not to exceed the amount of $3,062,987.00; and
WHEREAS, on August 9, 2023, CITY and CONTRACTOR entered into Amendment No. 2 to Agreement No. 2021-242, to decrease total compensation by $24,428.00 for a revised amount not to exceed the amount of $3,038,559.00; and
WHEREAS, CITY and CONTRACTOR would like to extend the term of the Agreement by 21 months in order to complete the General Plan Update.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows:
1. Section 3 of Agreement No. 2021- 242 entitled “ TERM.” is hereby amended to read as follows:
3. TERM. Unless terminated sooner, as set forth herein, this Agreement shall terminate on December 31, 2026.

2. Except as amended herein, all provisions of Agreement No. 2021 - 242 shall remain in full force and effect.
