ADMINISTRATIVE REPORT

MEETING DATE: May 14, 2025 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Jennifer M. Byers, Economic and Community Development Director DATE: April 29, 2025
SUBJECT: Resolution declaring various real property as exempt surplus land

Resolution declaring fourteen (14) city-owned properties as “exempt surplus land” per Government Code Section 54221(f)(1)(B) (Wards 1 & 2)

RECOMMENDATION:

Staff recommends adoption of the resolution.

BACKGROUND:

On July 24, 2024, the Bakersfield City Council adopted Resolution No. 106-2024, authorizing the purchase of tax defaulted real properties from the Kern County Treasurer-Tax Collector. On October 8, 2024, the City approved Agreement No. 2024-202(C) with the Kern County Board of Supervisors, outlining the final list of tax defaulted properties available for purchase.

The City of Bakersfield acquired fourteen (14) properties using American Rescue Plan Act (ARPA) State and local Fiscal Recovery Funds (SLFRF) with the intent of repurposing the properties for affordable housing. City staff proposes to transfer these assets to the Bakersfield Comm unity Land Trust (BCLT) to develop long-term affordable housing.

Pursuant to Government Code Section 54221(f)(1)(B), the properties must be declared “surplus land” or “exempt surplus land” prior to selling or leasing the properties to the BCLT. Pursuant to Government Code Section 54221(f)(1)(B) the City-owned Properties are “exempt surplus land” because each property is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open-space for low - and moderate-income housing purposes. Government Code Section 37364 authorizes cities to sell, lease, or otherwise dispose of real property to provide affordable housing to persons or families of low- or moderate-income.

Therefore, staff recommends the City Council adopt the resolution declaring the fourteen (14) properties as “exempt surplus land” to allow staff to move forward with the transfer of the properties to the BCLT.
