RESOLUTION DECLARING REAL PROPERTY EXEMPT
SURPLUS LAND AND SURPLUS TO THE NEEDS OF THE CITY
WHEREAS, on March 19, 2025, the City acquired fourteen properties conveyed to the City by the County of Kern through Tax Deeds to Purchaser of Tax-Defaulted Property (“Properties”); and
WHEREAS, the City desires to transfer the Properties (attached hereto as Exhibit “A” ), which are all less than one -half acre in area, to the Bakersfield Community Land Trust for the development of affordable housing; and
WHEREAS, Bakersfield Municipal Code Section 3.20.125 authorizes the negotiated sale of City property deemed to be “exempt surplus”; and
WHEREAS, the Surplus Land Act, Government Code sections 54220 et seq. (“Act”) applies when a local agency disposes of “surplus land,” as that term is defined in Government Code section 54221; and
WHEREAS, pursuant to Government Code Section 54221(f)(1)(J)(i), the Act exempts certain surplus land from its requirements, including, the disposition of land that is less than one -half acre in area pursuant to Government Code Section 37364 qualifies as “exempt surplus land”; and
WHEREAS, for the purposes of Government Code Section 54221(f)(2), the Property is not: (i) within a coastal zone, (ii) adjacent to a historical unit of the State Parks System; (iii) listed on, or determined by the State Office of Historic Preservation to be eligible for, the National Register of Historic Places; or (iv) within the Lake Tahoe region as defined by Government Code Section 66905.5; and
WHEREAS, the City Council desires to transfer ownership of said Properties to the Bakersfield Community Land Trust for one dollar ($1.00).
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. The foregoing findings and recitals are true, correct, and incorporated herein.

2. Pursuant to Bakersfield Municipal Code Section 3.20.125 “exempt surplus”, the City Council finds and declares that the Properties are exempt surplus land.
3. Pursuant to Government Code Section 54221(f)(1)( B), the City Council finds and declares that the Propert ies are exempt surplus land because each property is less than on e-half acre in area and is not contiguous to land owned by a state or local agency that is used for open -space or low- and moderate- income housing purposes.
4. The Properties are hereby declared surplus to the City’s needs , and the Finance Director is authorized to transfer said properties to the Bakersfield Community Land Trust for one dollar ($1.00).
