AMENDMENT NO. (3) TO
AGREEMENT NO. 2022-099
This AMENDMENT NO. (3) TO AGREEMENT NO. 2022-099 is made and entered into on ________________, by and between th e CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY” ), and BDM INC., a corporation authorized to do business in California (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, on June 1, 2022, CITY and CONTRACTOR entered into Agreement No. 2022-099 in the amount of one hundred twenty-five thousand seven hundred eighty-five dollars ($125,785) with a termination date of June 1, 2023, for CONTRACTOR to furnish and install five (5 ) A/C units at the Police Property Room located at 3425 Truxtun Avenue, Bakersfield, CA; and
WHEREAS, on May 24, 2023, Council approved Amendment No. 1 to Agreement No. 2022-099 to increase compensation by ninety thousand dollars ($90,000), for a new total not to exceed amount of two hundred fifteen thousand seven hundred eighty-five dollars ($215,785) and extended the term to June 1, 2024, to cover the additional electrical costs associated with the project; and
WHEREAS, on April 10, 2024, Council approved Amendment 2 to Agreement No. 2022-099 to extend the term of the Ag reement to June 1, 2025, to allow for additional time to complete the “Scope of Work”; and
WHEREAS, due to continued electrical issues CONTRACTOR need s additional time to complete the Scope of Work; and
WHEREAS, City and Contractor are now requesting to extend t he term of the agreement to December 31, 2025, to complete the installation of the five (5) A/C units at the Police Property Room.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows:
1. Section 3 of Agreement No. 2022-099 entitled “TERM ” is hereby amended to read as follows:
3. TERM . Unless terminated sooner, as set forth herein, th is Agreement shall terminate on December 31, 2025.

2. Except as amended herein, all provisions of Agreeme nt No. 2022- 099 shall remain in full force and effect.
