ADMINISTRATIVE REPORT
MEETING DATE: May 28, 2025 AGENDA CATEGORY: Consent – Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: May 13, 2025
SUBJECT: Consultant Agreement with Group Delta
(not to exceed $151,750.00) for Westside Parkway Route Adoption Environmental Services
RECOMMENDATION:
Staff recommend approval of the agreement.
BACKGROUND:
Group Delta is currently working with the City for environmental services in connection with the route transfer of the Westside Parkway to the California Department of Transportation (Caltrans). The City has been required to clear two propertie s within the freeway alignment through the Department of Toxic Substances Control (DTSC).
These properties were acquired by the City several years ago for the construction of the Westside Parkway. An initial site assessment for the route transfer was perf ormed and showed that these properties had potential for the presence of petroleum by-products as they were part of the old Conoco Phillips oil refinery located in the vicinity of the Westside Parkway. Caltrans, as the recipient of these properties, required an official clearance from the DTSC prior to the transfer of the Westside Parkway into the State Highway System. Group Delta has assisted the City with this requirement and the City entered into a Voluntary Cleanup Agreement (VCA) with DTSC, which establishes the required process to clear the properties. Group Delta has submitted a Supplementary Site Assessment which DTSC has reviewed and in response requires additional data sampling and reporting.
Additional funding is needed for further testing and re porting, required by Caltrans and DTSC. Group Delta had been performing these services in good faith under the terms of Agreements PW20 -070 and 2020-237. When staff began processing an amendment for Agreement 2020-237, it was discovered that the term date had inadvertently lapsed. The existing agreement had remaining available budget funds in the amount of $72,000, so staff is requesting a de -obligation of these funds and re -obligation into this new agreement. Also, additional funding in the amount of $79,750 will be added to the new agreement for a total compensation not-to-exceed $151,750, with a date of completion of June 30, 2026.
FISCAL IMPACT:
Funding for this agreement is available in Project TRCC29, Westside Parkway Route Adoption. There is no General Fund impact associated with this amendment.
