ADMINISTRATIVE REPORT

MEETING DATE: May 28, 2025 AGENDA CATEGORY: Consent – Resolutions TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: May 6, 2025
SUBJECT: Resolution of Intention No. 2235 for 2025 -2026 CMD Budget for Park Landscaping Assessments.

Preliminarily adopting, confirming, and approving the Public Works Director’s Report for the Consolidated Maintenance District (“CMD” herein) and the 2025-2026 CMD budget and setting the time and place for hearing protests regarding the amount of park landscaping assessments to be levied throughout the CMD

RECOMMENDATION:

Staff recommends adoption of the resolution of intention.

BACKGROUND:

On January 12, 2005, the City Council passed Resolution No. 019 -05 adopting the City Council policy on Park Maintenance and Street Landscaping Assessments which enables the City to collect additional revenue for the maintenance of street and median landscaping and park maintenance within the CMD.

Assessment rates for all existing developments prior to that were not increased and the rates remain at the 2004-2005 level. Since January 12, 2005, all new territories added to the CMD that benefit from public parks and/or street landscaping have been assessed and will continue to be assessed, consistent with the requirements of Proposition 218, those amounts set forth in Resolution No. 019 -05. Said amounts shall be increased annually by the cost -of-living increase reflected in the Los Angeles – Long Beach – Anaheim/All Urban Consumers Consumer Price Index.

This resolution of intention preliminarily approves the Public Works Director’s Report, attached and hereto as Exhibit 1, which includes the benefit formula and proposed 2025 -2026 budget for the CMD in its entirety. The benefit formula and proposed budget are attached to the Public Works Director’s Report as Exhibit A and B respectively. The 2025-2026 benefit formula notes that the Consumer Price Index (CPI) was calculated to be 3.02%. This percentage is based on the calculated CPI increased from the March 2024 CPI and the March 2025 CPI. The 2025-2026 proposed CMD budget for park landscaping is $4,428,948.12.

This is a 5.43% increase over the previous year’s budget of $4,200,464.14. Per Resolution No. 63 -96, the city shall subsidize 66% ($2,923,105.76) of the park landscaping budget. Therefore, the 2025-2026 amount of the park landscaping budget to be assessed to property owners is $1,505,842.36.

Each territory currently within the CMD was added by City Council resolution at a prior date. The legal description, map and assessment diagram, benefit formula, and Assessor’s Roll for each territory within the CMD are on file in the City Clerk’s Office with its respective Council resolution.

This resolution of intention sets the protest hearing for the Council meeting on Wednesday, June 11, 2025, at 5:15 P.M.

FISCAL IMPACT:

The revenue from Maintenance Assessment Districts supports ongoing maintenance in the districts for the year. The General Fund subsidizes the CMD cost due to the amount of fees collected falling short, however this is consistent with the resolution and policy enacted by City Council in prior years.

COUNCIL GOAL:

Reliable Infrastructure
