MEETING DATE: June 11, 2025 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Virginia Gennaro, City Attorney
DATE: May 30, 2025
SUBJECT: Amendment No. 3 to Agreement No. 2022 -185 with the Bakersfield Society for the Prevention of Cruelty to Animals
(SPCA) (extend term until June 30, 2028) to manage and operate the City of Bakersfield Animal Care Center (CBACC)

RECOMMENDATION:

Staff recommends approval of the Amendment.

BACKGROUND:

On September 25, 2013, the City entered into an agreement with the Bakersfield Society for the Prevention of Cruelty to Animals (SPCA) to manage and operate the City of Bakersfield Animal Care Center (CBACC), most recently pursuant to Agreement No. 2022-185 approved by the City Council and executed on September 21, 2022. The SPCA is an independent non -profit organization founded in 1949, which advocates for and is an expert regarding the general welfare and humane treatment of animals and prevention of pet overpopulation.

The current term for the Agreement (2022 -185) is set to expire on June 30, 2025. The City believes the SPCA is in the best position to identify needs, evaluate options, purchase goods, and contract for various facility and maintenance need s of CBACC due to SPCA’s day -to-day role in managing and operating the facility, and is likewise better equipped to retain necessary staff for successful operations. The proposed amendment will extend the existing agreement until June 30, 2028.

The agreement is currently structured to provide payments to the SPCA as follows: a Management Fee of $125,000 annually, and an Operations and Maintenance Fee of $1,613,872 annually. Both fees are paid on a quarterly basis and are subject to CPI adjustments each fiscal year.

Extension of the agreement will authorize continuing payments to SPCA as set forth in the agreement. For fiscal year 25/26, with applicable CPI adjustments, these fees will total $1,844,769.32 annually.

FISCAL IMPACT:

Funding for this agreement has been budgeted in the Police Department’s annual Fiscal Year 2025-2026 budget, no additional General Funds are needed.

COUNCIL GOAL:

Innovative and Efficient City Government
