FROM: Zachary Meyer, Public Works Director
DATE: May 20, 2025
SUBJECT: Public Hearing to consider Fiscal Year 2025-2026 Budget, Park Landscape Assessment and Tax Collection.
Resolution approving and adopting the Public Works Director’s Report for the Consolidated Maintenance District (CMD) and the 2025-26 CMD budget confirming the park landscaping assessments and authorizing the collection of assessments by the Kern County Tax Collector.
RECOMMENDATION:
Staff recommends receiving protest statements (if any), overriding protests (if any) and adopting the resolution.
BACKGROUND:
On January 12, 2005, the City Council passed Resolution No. 019 -05 adopting the City Council policy on Park Maintenance and Street Landscaping Assessments which enables the City to collect additional revenue for the maintenance of street and median landscaping and park maintenance within the CMD.
Assessment rates for all existing developments prior to that were not increased and the rates remain at the 2004-2005 level. Since January 12, 2005, all new territories added to the CMD that benefit from public parks and/or street landscaping have been assessed and will continue to be assessed, consistent with the requirements of Proposition 218, those am ounts set forth in Resolution No. 019 -05. Said amounts shall be increased annually by the cost -of-living increase reflected in the Los Angeles – Long Beach – Anaheim/All Urban Consumers Consumer Price Index.
On May 28, 202 5, City Council approved Resoluti on of Intention No. 2235, preliminarily confirming, approving, and adopting the Public Works Director’s Report and the fiscal year 2025 -2026 park landscaping budget for the CMD. The resolution of intention sets the protest hearing date for June 11, 2025. N otice of the protest hearing has been published in accordance with Chapter 13.04 of the Bakersfield Municipal Code in manner required by law.
This hearing is to consider protests only on the following: the fairness of the benefit formula; a factual and compelling argument against the amount of the assessment; the zone of the benefit (including tier levels); the amount of the park landscaping assessment on any parcel of property to be assessed; and the reservation by the City of right to elect whether to proceed to perform work by City forces or by a private contractor. As of the date of this administrative report, City staff has not received any protests regarding the above-noted conditions.
This resolution confirms the 2025 -2026 park landscaping assessm ents and authorizes collection of the assessments by the Kern County Tax Collector.
FISCAL IMPACT:
The revenue from Park and Landscape Maintenance Assessment Districts supports ongoing maintenance in the districts for the year. While the General fund also provides partial support for park and landscape maintenance, there is no General Fund impact associated with this action to authorize a consumer price index increase of 3.02%, which is allowed by Resolution No. 019 -05 and represents the “Los Angeles – Long Beach – Anaheim/All urban Consumers Consumer Price Index.” The total cost of Park and Landscape maintenance is borne by the properties that are within the assessment districts and the general fund contribution.
