ADMINISTRATIVE REPORT

MEETING DATE: June 25, 2025 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: June 13, 2025
SUBJECT: Amendment No. 2 to Agreement No. PW20-150
with the Department of Toxic Substances Control ($28,637; revised not to exceed $160,262) to provide additional environmental sampling and assessment for a portion of land within the Westside Parkway right-of-way (Wards 3 & 4)

RECOMMENDATION:

Staff recommends approval of the amendment.

BACKGROUND:

Construction of the Westside Parkway includes a stormwater detention area between Coffee Road and Mohawk Avenue, where residuals of polynuclear aromatic hydrocarbons (PAHs) were once stored at the former ConocoPhillips Petroleum Coke Storage. On October 7, 2020, the Department of Toxic Substances Control (DTSC) and the City entered into Agreement PW20 -150 for $32,906 to set parameters for initial testing and evaluation of the site. On February 2, 2022, the agreement was amended to add sufficient funding for additional sampling and testing is required along with the development of an Operations Manual that will be used to identify protective measures for maintenance workers when performing work within this section of the freeway. This is an important step before officially transferring the property from the City to Caltrans State Highway System for long-term operation and maintenance.

In Spring of 2025, the City’s consultant performed sampling and testing as required by DTSC. The findings were not significant and DTSC will proceed with reviewing the Human Health Risk Assessment and drafting deed restrictions and Land Use Covenants of the property. This amendment provides funds for DTSC’s to perform these additional tasks which were not included in the original agreement.

FISCAL IMPACT:

Sufficient local Transportation Development Funds are budgeted in the Westside Parkway Route Adoption project to fund this amendment. Therefore, no impact to the General Fund.

COUNCIL GOAL:

Reliable Infrastructure
