AMENDMENT NO. [1] TO
AGREEMENT NO. 2022-034
This AMENDMENT NO. 1 TO AGREEMENT NO. 2022-034 is made and entered into on ________________, by and between the CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY”), and PHASE II SYSTEMS , a corporation organized and existing under the laws of the State of California, doing business as PUBLIC AGENCY RETIREMENT SERVICES (PARS) (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, CITY and CONTRACTOR entered into Agreement No. 2022-034 for trust administration services; and
WHEREAS, the parties desire to amend Agreement No. 2022-034 to extend the term of the Agreement for three (3) additional years; and
WHEREAS, the parties desire to amend Agreement No. 2022-034 to replace the word “CONSULTANT” with “CONTRACTOR” throughout the entire agreement.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows:
1. Section 24 of Agreement No. 202 2-034 entitled “TERM” is hereby amended to read as follows:
24. TERM. Unless terminated sooner, as set forth herein, this Agreement shall terminate on June 30, 2028.
2. Agreement No. 2022 -034 is amended to replace the word “CONSULTANT” with “CONTRACTOR” throughout the entire
agreement.
3. Except as amended herein, all provisions of Agreement No. 2022-034 shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 1 to Agreement No. 2022-034 to be executed the day and year first above written.
