A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING CITY ENT ER INTO A
TRANSPORTATION ART MAINTENANCE AGREEMENT FOR
MURAL PROJECTS 06-1E700 GARCES CIRCLE, 06-1E770 SR
204, SR 178 AND Q ST REET, AND 06 -1E810 CALIFORNIA
AVENUE AND SR 99 WITH THE CALIFORNIA DEPARTMENT
OF TRANSPORTATION
WHEREAS, the California Department of Transportation (“Caltrans”) manages California’s highway and freeway lanes, and among other duties, has a Transportation Art Program; and
WHEREAS, Caltrans’ Transportation Art Program allows for visual expression that reflects local communities’ unique aesthetic, environmental, scenic, historical and cultural values; and
WHEREAS, the Transportation Art Program can include graphic or sculptural artwork, either free standing or placed upon a required engineered transportation feature; and
WHEREAS, the City of Bakersfield proposed three artwork projects to Caltrans through its Transportation Art Program and Caltrans accepted said proposals; and WHEREAS, specifically, Caltrans allowed the following City of Bakersfield projects:
1. Night and Day in Bakersfield Circle 06-1E770 SR204, SR178, and Q Street;
2. Kern River Dreams 06-1E810 California Avenue and SR 99, and
3. Flora + Fauna 06-1E700 Garces Circle
WHEREAS, as part of their process, Caltrans requires a Transportation Art Maintenance Agreement for purposes of the City of Bakerfield maintaining the three artwork projects; and
WHEREAS, the Transportation Art Maintenance Agreement requires the City of Bakersfield be in charge of regular maintenance of the three artwork projects and has a mutual indemnification clause; and

WHEREAS, the City of Bakersfield will enter into the Transportation Art Maintenance Agreement with Caltrans in order to maintain the three artwork projects.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield as follows:
1. Approves and appoints the Public Works Director as agent to execute the Transportation Art Maintenance Agreement; and
2. Certifies that the City of Bakersfield understands and agrees to the maintenance obligations and standards contained in the Transportation Art Maintenance Agreement; and
3. Delegates the authority to the Public Works Director or designee to conduct all designated maintenance under the Transportation A rt Maintenance Agreement; and
4. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines; and
5. The above recitals are true and correct and are incorporated herein by reference.
