ADMINISTRATIVE REPORT

MEETING DATE: July 9, 2025 AGENDA CATEGORY: Consent - Bids TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: June 2, 2025
SUBJECT: Pavement Rehabilitation 24 -25 RSTP: California Avenue between Stockdale Highway to Real Road

1. Accept Bid and approve contract with Griffith Company ($6,377,155) for the project.

2. Authorize staff to approve, as necessary, up to $200,000 in City-controlled contingency for unforeseen conditions encountered during construction of project. (Ward 2, 6)

RECOMMENDATION:

Staff recommends acceptance of low bid, approval of contract, and approval of City -controlled contingency.

BACKGROUND:

The work to be performed consists, in general, of pavement rehabilitation on California Avenue from Stockdale Highway to Real Road. Work shall include full-depth reconstruction of the existing pavement.

Other items include roadway excavation, construction of new pavement using Rubberized Hot Mix Asphalt (R-HMA) and Hot Mix Asphalt (HMA), installation of pavement striping and markings, including MMA Green Bike Lane striping, traffic detector loops, modification of existing curbs and gutters, access ramps to meet current ADA standards, adjustment of water valves, and adjustment of manholes, and monument encasements.

This project was reviewed and designed a t the highest level of consistency with the City’s Complete Streets Policy.

Item No. 1. This project is predominantly federally funded through the Regional Surface Transportation Program (RSTP), which provides up to 88.53% of the funding, while Gas Tax Funds (GTF) provides the remaining 11.47% as local match requirement.

The Engineer’s Estimate for this project is $5,833,219.25.

On June 10, 2025, the City received three (3) bids for this project. All three bids were deemed acceptable.

Those acceptable bids are as follows:

Griffith Company
1128 Carrier Parkway Ave.

Bakersfield, CA 93308

in the amount of

$6,377,155.00
Bowman Asphalt Inc.
3333 Gibson Street
Bakersfield, CA 93308

in the amount of

$6,507,700.00

Granite Construction Co.
3005 James Rd
Bakersfield, CA 93308

in the amount of

$7,276,864.00

Staff recommends acceptance of the bids and approval of the construction contract to the lowest responsive and responsible bidder, Griffith Company.

Item No. 2. Bakersfield Municipal Code section 3.20.105(E) authorizes Public Works Contract Amendments to be executed via Change Order, provided that Change Orders which exceed $10,000 must be approved by the City Council. Staff is requesting pre -approval of up to $ 200,000 for City-controlled contingency for unforeseen conditions encountered during construction of this proje ct, to be executed via authorized Change Order(s). Any costs which exceed the City Council approved contingency, cumulative or otherwise, would require action and approval from the City Council. This City-controlled contingency will save staff time by not having to prepare multiple Council reports for individual routine change orders throughout the project, should they arise. All remaining contingency funds not used will be returned to the fund balance at the end of the project.

There are sufficient funds available in the project account to award this project. However, in order to maximize the federal reimbursement for this project, a budget transfer in the amount of $558,066 will be necessary. This budget transfer will come from the other federal RSTP pro ject on Ming Avenue, which received favorable bids, and has significant savings. $556,066 total, $494,055 is federal RSTP funds and the remaining $64,011 in local Gas Tax Funds (GTF). Staff is working diligently with Caltrans and Kern Council of Government s (Kern COG) to transfer the federal project savings into this project . Staff has received concurrence from Kern COG that they support the transfer of $558,066 ($494,055 federal; $64,011 local) for this project. Staff has submitted all the necessary documentation to Caltrans to complete the transfer of funds. Once Caltrans approves the transfer and issues a new Finance Letter, staff will work on the budget transfer.

FISCAL IMPACT:

This project is funded with Regional Surface Transportation Program (RSTP) federal funds and local Gas Tax Funds (GTF); therefore, there is no general fund impact associated with the award of this contract.

There are sufficient funds available for the award of this agreement and contingencies. Once the budget transfer is completed, there will be sufficient funds for construction engineering.

COUNCIL GOAL:
