ADMINISTRATIVE REPORT
MEETING DATE: July 9, 2025 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Jennifer M. Byers, Economic & Community Development Director DATE: June 18, 2025
SUBJECT: Termination of Agreement 2024-140 with Locked-In Mindset LLC to perform American Rescue Plan Act funded workforce development services.
RECOMMENDATION:
Staff recommends termination of the subrecipient agreement.
BACKGROUND:
In January 2024, the City released a Notice of Funding Availability for the Pathways to Innovation Workforce Development Program. The objective of the program was to assist workers that suffered negative economic impacts because of the Covid-19 public health emergency by providing job training, workshops, and other resources.
On June 12, 2024, the City entered into Agreement No. 2024-140, with Locked-In Mindset LLC in the amount of $39,400 to implement the City’s Pathways to Innovation Workforce Development Program.
Section 6 of the Agreement provided that either party may terminate the Agreement with written notice. For the past 12 months, City staff have made multiple attempts to contact the vendor to discuss the contracted scope of work without response. Therefore, due to lack of performance and failure to comply with the provisions of the agreement, staff requests that City Council terminate Agreement No. 2024-140. To date, no funds have been reimbursed to the vendor.
As an American Rescue Plan Act (ARPA) funded program, the funding is already obligated per the approved ARPA framework, this funding must go to another vender to perform the same Workforce Development scope of work. Terminated funds may not be moved to the General Fund nor other projects. Terminated funds would therefore be reprogrammed to another eligible ARPA Workforce Development Program.
FISCAL IMPACT:
No fiscal impact; this program is funded through the American Rescue Plan Act.
COUNCIL GOAL:
Innovative and Efficient City Government
