Mitigation Monitoring and Reporting Program for the South Kern and Old River Project

MITIGATION MONITORING AND REPORTING PROGRAM
810-1: Pre~Construction Surveys and Worker Environmental Awareness Training To avoid irppacts to nesting birds, all ground disturbing activity and all vegetation clearing, including f,emoval of trees and shrubs, shall be completed between September 1 and January 3:il, iffeasible.
' If vegetati~n removal and grading activities begin during the nesting season (February 1 to August 31), a qualified biologist shall conduct a pre-construction survey of the project footprint ~or active nests. Additionally, the surrounding 500 feet should be surveyed for active rapior nests, where accessible. A windshield survey for potential Swainson's hawk I
nests shall! be conducted within 0.25 mile of the footprint as part of the survey. The pre- constructi~n survey shall be conducted within 14 days before the commencement of ground-dis,turbing activities. If the pre-construction survey shows that there is no evidence of active n¢sts, a letter report shall be prepared to document the survey, and no additional measures ~re recommended. If construction does not commence within 14 days of the pre-constr~ction survey, or halts for more than 14 days, an additional survey is required before st~rting work. If active nests are identified, the following measure shall be implemenied:
• A species-specific buffer shall be established by a qualified biologist around active nJsts and no construction activities within the buffer shall be allowed until a I qu:alified biologist has determined that the nest is no longer active (i.e., the n~stlings have fledged and are no longer reliant on the nest, or the nest has failed).

En~roachment into the buffer may occur at the discretion of a qualified biologist.

A~y encroachment into the buffer shall be monitored by a qualified biologist to de~ermine whether nesting birds are being impacted.

A qualified! biologist shall conduct environmental awareness training to all project-related personnel ~efore the initiation of work within the nesting season (February 1-August 31).

CULTURA~RESPURCES
CUL-1: Accidental Discovery of Cultural Resources
In the ev~nt that cultural resources are exposed during ground-disturbing activities, constructi~n activities should be halted within 100 feet of the discovery. Cultural HELIX!

resources :could consist of but are not limited to stone, bone, wood, or shell artifacts, or features i~cluding hearths, structural remains, or historic dumpsites. If the resources cannot be! avoided during the remainder of construction, an archaeologist who meets the Secretary of the Interior's Professional Qualifications Standards should then be retained, l,n coordination with the City to assess the resource and provide appropriate managem¢nt recommendations. If the discovery proves to be CRHR- or NRHP-eligible, additional! work, such as data recovery excavation, may be warranted and should be discussed }n consultation with the City
CUL-2: Acqidental Discovery of Human Remains
Although ~onsidered highly unlikely, there is always the possibility that ground disturbing activities quring construction may uncover previously unknown human remains. In the event of ~n accidental discovery or recognition of any human remains, PRC Section 5097.98 ~ust be followed. Once project-related earthmoving begins and if there is a discovery pr recognition of human remains, the following steps shall be taken:

1. Th'ere shall be no further excavation or disturbance of the specific location or any n~arby area reasonably suspected to overlie adjacent human remains until the cdunty Coroner is contacted to determine if the remains are Native American and if ~n investigation of the cause of death is required. If the coroner determines the retnains are Native American, the coroner shall contact the NAHC within 24 hours, l
ari,d the NAHC shall identify the person or persons it believes to be the "most likely d~scendant" of the deceased Native American. The most likely descendant may m~ke recommendations to the landowner or the person responsible for the ex~avation work, for means of treating or disposing of, with appropriate dignity, th~ human remains, and any associated grave goods as provided in PRC Section 5097.98, or

2. W~ere the following conditions occur, the landowner or their authorized representative shall rebury the Native American human remains and associated gr~ve goods with appropriate dignity either in accordance with the rebommendations of the most likely descendent or on the project area in a I
Iodation not subject to further subsurface disturbance:

I
a. The NAHC is unable to identify a most likely descendent or the most likely descendent failed to make a recommendation within 48 hours HELIX

b. The descendent identified fails to make a recommendation; or T~e landowner or his authorized representative rejects the recommendation of th~ descendent, and the mediation by the NAHC fails to provide measures acf~table to the landowner.

GEOLOGYfAND SOILS
GE0-1: Avpid and Minimize Impacts to Paleontological Resources In the eveht paleontological or other geologically sensitive resources {such as fossils or fossil for~ations) are identified during any phase of project construction, all excavations within 100 feet of the find shall be temporarily halted until the find is examined by a qualified paleontologist, in accordance with Society of Vertebrate Paleontology standards.! The paleontologist shall notify the appropriate representative at the City who shall coor~inate with the paleontologist as to any necessary investigation of the find. If the find is determined to be significant under CEQA, the City shall implement those measures !which may include avoidance, preservation in place, or other appropriate measures,i as outlined in Public Resources Code Section 21083.2.

HAZARDS !AND H~A"bOU$ IVIA'F~~l~LS
HAZ-1: Tr~ffic Management Plan
If lane clo~ures or speed restrictions are necessary to allow adequate space for project constructi~>n, a Traffic Management Plan shall be developed for the proposed project to manage tr~ffic during temporary lane closures along Old River Road, SR-119, and Beam Street. The Traffic Management Plan shall be prepared by the applicant and shall be reviewed ~nd approved by the City before the commencement of construction activities.

HYD"OLOGY AND WATER·q.~~l:i'.'fY •
HYD-1: Pr~pare and Implement Dewatering and Shoring Plans In the eve~t that dewatering activities are implemented for any construction activities, a dewaterin~ plan shall be submitted to the City for approval before the issuance of a grading p~rmit. At a minimum, the dewatering plan shall include dewatering methods, location df dewatering activities, equipment, groundwater sampling, disposal, and discharge eoint in accordance with the applicable waste discharge requirements of the Central va;lley Regional Water Quality Control Board. In the event that shoring methods are implemented for any excava!ions, shoring plans shall be prepared and submitted to HELIX
