RESOLUTION NO. _____________
A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
ADOPTING A MITIGATED NEGATIVE DECLARATION
PERTAINING TO THE CONSOLIDATION OF OLD RIVER MUTUAL
WATER COMPANY (ORMWC) & SOUTH KERN MUTUAL WATER
COMPANY (SKMWC) INTO CITY OF BAKERSFIELD’S
MUNICIPAL WATER SYSTEM
WHEREAS, pursuant to certain State issued mandatory consolidation orders, the City of Bakersfield intends to consolidate the South Kern and Old River Mutual Water Companies (“MWC”) into the City of Bakersfield Water System AR 6060 Prop l (“Project”) that would allow construction extending the City of Bakersfield's water system to the areas served by the MWCs; and
WHEREAS, an initial study was conducted, and it was determined the Project would not, with implementation of mitigation, have a significant effect on the environment: therefore, a Mitigated Negative Declaration (“MND”) was prepared in accordance with the California Environmental Quality Act (“CEQA”); and
WHEREAS, on June 05, 2025, the Planning Commission recommend ed adoption of a MND for the Project; and
WHEREAS, the Clerk of the City Council set Wednesday, July 23, 2025 at 5:15 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place before the City Council to consider the proposed MND; and
WHEREAS, during the hearing, the City Council considered all facts, testimony, and evidence concerning the staff report, MND and the Planning Commission’s deliberation, and action.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield as follows:
1. The above recitals and findings are true and correct and are incorporated herein by reference.
2. The Planning Commission's findings as contained in its Resolution No. 28- 25 are hereby adopted.
3. The MND for the Project is hereby adopted subject to the mitigation measures in Exhibit “A” for the Project located on the map as shown in Exhibit B, both of which are incorporated herein.
