A RESOLUTION OF THE CITY OF BAKERSFIELD AUTHORIZING
APPLICATION FOR FINANCIAL ASSISTANCE THROUGH THE STATE
WATER RESOURCES CONTROL BOARD’S EXPEDITED DRINKING
WATER GRANT FUNDING PROGRAM AND AUTHORIZING
REPRESENTATIVES TO ACT ON THE CITY’S BEHALF
WHEREAS, in November 2016, the State Water Resources Control Board (SWRCB) ordered the City of Bakersfield to “negotiate consolidation with” South Kern and Old River Mutual Water Companies (MWC) into the City’s drinking water system; and
WHEREAS, in September 2018, the SWRCB issued two consolidation orders ordering the City of Bakersfield to consolidate the Mutual Water Companies; and
WHEREAS, in April 2019, the City of Bakersfield submitted a Draft Consolidation Plan to the SWRCB for their review; and
WHEREAS, the SWRCB contracted with Sacramento State to provide Technical Assistance, procuring Carollo Engineering to develop a Preliminary Engineering Report; and
WHEREAS, the City of Bakersfield intends to consolidate the South Kern and Old River Mutual Water Companies (MWC) into the City of Bakersfield Water System AR 6060 Prop 1 project that would allow construction extending the City of Bakersfield’s water system to the areas served by the MWCs; and
WHEREAS, the City of Bakersfield received a preliminary funding award notification letter from the State Water Resources Control Board’s Division of Financial Assistance for the South Kern and Old River Mutual Water Consolidation Projects dated January 17, 2025; and
WHEREAS, in order for the City of Bakersfield to apply for financial assistance under the Expedited Drinking Water Grant Funding Program, it must submit a resolution authorizing a representative to submit the financial assistance application and all responsibilities associated with carrying out the City of Bakersfield’s responsibilities under the financial assistance agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows:
1. The above recitals and findings are true and correct and are incorporated herein by reference.
2. The Water Director (the “Authorized Representative”) or designee hereby authorized and directed to sign and file, for and on behalf of the Entity, a financial assistance application for a financial assistance agreement from the State Water Resources Control Board for the planning, design and construction of South Kern and Old River Mutual Water Companies Consolidation Project (the “Project”).
3. This Authorized Representative, or his/her designee, is designated to provide the -- Page 2 of 2 Pages --
assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes thereto.
4. The Authorized Representative, or his/her designee, is designated to represent the Entity in carrying out the Entity’s responsibilities under the financial assistance agreement, including certifying disbursement requests on behalf of the Entity and compliance with applicable state and federal laws.
