ADMINISTRATIVE REPORT

MEETING DATE: August 13, 2025 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: July 22, 2025
SUBJECT: Resolutions of Intention 2242, 2243, and 2244 to add Areas 4-307, 2-92, and 3-124 to the Consolidated Maintenance District
Resolutions of Intention (ROI) to add the following territories to the Consolidated Maintenance District and preliminarily approving, confirming, and adopting the Public Works Director’s Report for each:

ROI No. 2242 adding Area 4-307 (911, 915, & 931 18th Street): Street Tier = 4; Park Tier = 1 – Ward 2
ROI No. 2243 adding Area 2-92 (4520-4616 New Horizon Blvd): Street Tier = 1; Park Tier = 0 – Ward 6
ROI No. 2242 adding Area 3-124 (VTTM 7418-8235 Stine Rd): Street Tier = 1.5; Park Tier = 1.5 – Ward 7

RECOMMENDATION:

Staff recommends adopting the resolutions of intention.

BACKGROUND:

Written requests have been received by the City Engineer from the owners of the parcels to be included into the Consolidated Maintenance District (CMD) as required by section 13.04.021 of the Municipal Code.

Inclusion in the C MD will provide for the maintenance of parks and/or street landscaping. For an area where a park has been constructed and/or street landscaping has already been installed, the area will be under the park and streetscape zones of benefit and will be assigned appropriate tier levels during the next annual update to the consolidated maintenance district. For an area where a park and/or street landscaping has not been installed, the area will be assigned appropriate tier levels when improvements are constructed.

The City of Bakersfield has received a letter from the owners of the properties listed above which waived the public hearing concerning inclusion in the C MD. This allows the City to expedite the maintenance district process to satisfy subdivision requirem ents. The owners have also submitted a Proposition 218 ballot indicating their consent to the assessments.

In order to provide future property owners with disclosure regarding the inclusion of land in the CMD and the estimated maximum annual cost per equi valent dwelling unit, a covenant has been drafted and will be recorded with the Kern County Assessor‐Recorder's Office upon approval of these Resolutions.

Staff recommends the new territories be added to the CMD at the next City Council meeting.

FISCAL IMPACT:

The revenue from Maintenance Assessment Districts partially supports ongoing maintenance in the districts for the year. There is some General Fund support on an annual basis for the short fall in the CMD revenue collected citywide.

COUNCIL GOAL:

Reliable Infrastructure
