RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BAKERSFIELD
ESTABLISHING THE COMMUNITY LAND TRUST FUND.
WHEREAS, on March 11, 2021, President Joseph R. Biden signed into law the U.S. Senate-amended H.R. 1319 (P.L. 117 -2), known as the American Rescue Plan Act (hereinafter “ARPA”); and
WHEREAS, ARPA established the Coronavirus State Fiscal Recovery Fund and Coronavirus Local Fiscal Recovery Fund, which together make up the Coronavirus State and Local Fiscal Recovery Funds (hereinafter “SLFRF”) program; and
WHEREAS, CITY received $94,000,000 in SLFRF funding to address the negative impacts of COVID-19; and
WHEREAS, CITY has committed approximately $6,500,000 in SLFRF to create housing opportunities for low- and moderate-income families within CITY limits; and
WHEREAS, in October 2023, City Council created the Bakersfield Community Land Trust (“BCLT”) to eventually be a self -sustaining entity to help facilitate the development of affordable housing within CITY; and
WHEREAS, on November 20, 2024, City Council approved Agreement No. 2024-305 with Self-Help Enterprises for the implementation and administration of the Bakersfield Community Land Trust; and
WHEREAS, the City Council desires to place the $6,500,000 of SLFRF funds into a separate trust fund to ensure that such monies are properly designated for the implementation, administration, and maintenance of the BCLT.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. The above recitals and findings are true and correct and are incorporated herein by reference.

2. The City Council of the City of Bakersfield directs the City Manager/Finance Director to establish and create a Community Land Trust Fund into which SLFRF and other revenues are deposited for the purpose of implementing and administering the Bakersfield Community Land Trust.
