ADMINISTRATIVE REPORT
MEETING DATE: September 24, 2025 AGENDA CATEGORY: Miscellaneous TO: Honorable Mayor and City Council
FROM: Virginia Gennaro, City Attorney
DATE: September 12, 2025
SUBJECT: Acknowledgment of budgetary exception to enterprise fund.
[Document Description]
RECOMMENDATION:
Staff recommends Council acknowledge/approve budgetary exception to enterprise fund.
BACKGROUND:
The City Attorney desires to flex one of its attorneys from a Deputy City Attorney I to a Deputy City Attorney II. The individual has demonstrated exceptional performance over the last evaluation period (September 2024-2025) which includes legal work that has resulted in over $235,000 savings to the City.
This type of “flex” promotion does not typically go to City Council; rather, it is normally recommended and approved by the relevant department head with input from human resources. However , during the most recent City budget cycle, the City Manager announced a hiring freeze of certain positions. This generally includes flexed positions; therefore, the City Attorney and Water Resources Director felt it appropriate to get Council consent for the budget exception. In this case, the particular attorney counts as a position on the City Attorney’s compliment, yet is assigned to the Water Department and thus, has a salary budgeted under the Water department enterprise fund. Accordingly, awarding a flex in this instance will not impact the General Fund and will continue to be allocated to the enterprise fund which has future water rates to cover the increase in annual salary of $11,350.00 or approximately $2,800 through the end of this fiscal year.
FISCAL IMPACT:
Fiscal impact is noted above in the background.
COUNCIL GOAL:
