ADMINISTRATIVE REPORT

MEETING DATE: September 24, 2025 AGENDA CATEGORY: Consent Calendar Public Hearings TO: Honorable Mayor and City Council
FROM: Jennifer M. Byers, Economic & Community Development Director DATE: September 19, 2025
SUBJECT: Public Hearing to consider Action Plan Amendment to HUD Action Plan Fiscal Year 2025- 26 Fiscal Year (FY) 2025-26 Amendment No.1: Transfer funds from New Construction Assistance ($1,205,825.33 HOME), FY24-25 CHDO Set Aside ($214,187 HOME), FY 25-26 CHDO Set Aside ($223,873 HOME), and FY 25-26 Additional Program Income ($956,114.67) for a total allocation of $2,600,000 for the Eye Street Project (Ward 2)

RECOMMENDATION:

City staff recommends the approval of the Action Plan Amendment.

BACKGROUND:

City receives annual entitlement funds from the U.S. Department of Housing and Urban Development (HUD) annually through the submission of an Action Plan, which describes all HUD -funded projects and activities to be undertaken with HUD funds and how they meet community housing, homelessness, and community and economic development needs. Each Action Plan is tied to the funding of the Fiscal Year (FY) in which the grant funds were received by the City of Bakersfield. The addition of a new project to an Action Plan requires staff to process a Substantial Amendment including a 30 -day public notice period.

Staff is proposing a Substantial Amendment for the HOME Improvement Partnership Program (HOME) grant, which is part of the City’s annual HUD Action Plan process.

Additionally, the City of Bakersfield receives an annual entitlement of HOME funds to invest in quality affordable housing for low-income residents.

On April 18, 2025, the City distributed a Notice of Funding Availability (NOFA) for the development of affordable housing through the Affordable Housing Trust Fund (AHTF), which inc luded HOME funds as a funding source. The requested amendment will add the following project submitted by the Housing Authority of the County of Kern:

- 1302 Eye Street Apartments: HOME funds would be used to develop a 16-unit affordable housing complex located at 1302 Eye Street (APN No. 006-412-05). The Proposed amendment would commit $2,600,000 in HOME funding from the FY 25-26 Action Plan.

Public Notice:

A public notice for this Action Plan Amendment was published in English in the Bakersfield Californian, and in Spanish in El Popular on August 22, 2025, initiating a 30-day public comment period and providing a 30-day notice of the public hearing. As of the date of this report, no comments have been received. Staff concludes the proposed Action Plan Amendment meets all regulatory and public noticing requirements and recommends Council approve the Amendment. I f approved, staff will amend the Action Plan to incorporate the 1302 Eye Street Affordable Housing Project.

FISCAL IMPACT:

The total City contribution is from HOME Funds in $2,600,000 to the 1302 Eye Street affordable housing project has already been allocated toward the development of new affordable housing and is an approved HUD activity in the FY 2025-26 HUD Action Plan. Therefore, there will be no fiscal impact to the City General Fund because these are all Federal Entitlement funds as a result of this Amendment.
