ADMINISTRATIVE REPORT

MEETING DATE: October 8, 2025 AGENDA CATEGORY: Consent – Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: September 24, 2025
SUBJECT: Agreements for On Call Services for Maintenance, Repair and Abatement for City Facilities

1. Asbestos Services, Inc. for Asbestos/Lead Abatement (Not to Exceed $450,000)

2. Central Cal Surveys, LLC. for Asbestos/Lead Sampling and Testing (Not to Exceed $100,000)

RECOMMENDATION:

Staff recommend approval of agreements.

BACKGROUND:

Currently, Public Works staff does not have the license or training to abate asbestos and/or lead to meet the requirements of Cal OSHA and industry standards. In addition, the Public Works Department needs a third party to sample and test for asbestos and/or lead in City facilities prior to City staff begin demo and construction.

In June of 2025, the Public Works Department conducted a Request for Qualifications (RFQ) to provide on call services for each of the following: asbestos/lead abatement and asbestos/lead sampling and testing.

The RFQ was advertised through the City’s website, PlanetBids and The Bakersfield Californian . In addition, Public Works staff contacted local contractors to participate in the RFQ.

The Public Works Department received the following statement of qualifications for each service:

One submittal for asbestos/lead abatement
Two submittals for asbestos/lead sampling and testing

The Public Works Department’s evaluation committee ranked the proposer’s Qualification Based Score (QBS) and reviewed their fee schedule for conformance with ranges determined to be acceptable in our independent cost estimate. The committee determined that all submittals met the minimum requirements. The following is the summary of the contractors reviewed for each separate service recruited:

Asbestos/Lead Abatement

1. Asbestos Services, Inc. was the only submittal received. QBS was 99.4.

Asbestos/Lead Sampling and Testing

1. Central Cal Surveys, LLC. submitted a statement of qualifications. QBS was 86.2.

2. Charles Taylor Environmental submitted a statement of qualifications. QBS was 84.7.

Public Works staff recommend approving a contract with the following contractors:

1. Asbestos Services, Inc. with a not to exceed agreement for $450,000.

2. Central Cal Surveys, LLC. with a not to exceed agreement for $100,000.

Each contract will be effective for one year from the effective date of the Agreement, with the option to automatically extend the duration for up to three (3) consecutive one -year periods unless either party terminates the Agreement. The contract amounts were based on current staffing levels and projected workload.

FISCAL IMPACT:

Funding for the three (3) agreements will be from varying sources, including the General Fund. The work conducted by each contractor may be done in all seven wards depending on the job site or facility.

MEETING DATE: 10/8/2025 AGENDA CATEGORY: Consent – Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: 9/23/2025
SUBJECT: Contract Change Order No. 173 to Agreement No. 19-069 with Security Paving Company (increasing compensation by $31,000.00; revised not to exceed $152,225,004.59) for the Centennial Corridor Mainline Project. (Wards 1, 2, & 3)

RECOMMENDATION:

Staff recommends approval of the change order.

BACKGROUND:

The Centennial Corridor Mainline Project (Project) proposes to extend State Route 58 (SR -58) from the current terminus as a freeway at State Route 99 (SR -99) to the Westside Parkway. At the SR -58/SR-99 interchange, the Project adds a collector -distributor on the northbound SR -99 and constructs a new northbound to westbound connector. The Project also includes various local road improvements including; realignment and introducing cul-de-sacs at the end of local roads along the corridor, widening and realignment of Chester Avenue at SR -58, and construction of a traffic signal at the eastbound SR-58 ramps/Brundage Lane intersection (which is part of the SR -58/Cottonwood Road interchange). This Project was awarded in July of 2019.

Change Order No. 17 3 provides compensation to the contractor for the removal of existing excess abutment concrete and eighty linear feet of abandoned 24” concrete pipe at the Ming Avenue to northbound 99 on-ramp. The concrete and pipe had to be removed due to being within the new pavement structural section. This change order results in a net increase of $31,000.00.

FISCAL IMPACT:

The sum of all change orders to date on this project reflects a total cost increase of $5,211,348.34 which results in a 3.54% increase of the original contract amount as illustrated below:

Original Contract Amount = $147,013,656.25
Previous Change Orders = $5,180,348.34
Current Change Orders = $31,000.00
Amended Contract Agreement after CCOs = $152,225,004.59 Net Increase to date = $5,211,348.34

MEETING DATE: October 8, 2025 AGENDA CATEGORY: Consent - Bids TO: Honorable Mayor and City Council
FROM: Randy McKeegan, Finance Director
DATE: September 26, 2025
SUBJECT: Accept bid and approve contract with Toter, LLC ($787,756.90) for the supply of black refuse containers, green waste containers and blue recyclable containers for the Solid Waste Division.

RECOMMENDATION:

Staff recommend acceptance of the bid and approval of the contract.

BACKGROUND:

Bids were solicited for an Annual Contract to supply refuse and recycling carts. Two bids were received in response to solicitation. The contract award is for a one -year period; renewable annually for four consecutive one-year periods at the City’s option and upon mutually agreeable terms.

The Solid Waste Division within the Public Works Department is responsible for refuse collection within the City. This includes the deployment, replacement and repair of rationally molded containers provided to residential customers for general refuse, recycling and green waste curbside collection. The bids solicited were based on estimated quantities of 3,000 black re fuse containers, 5,500 green waste containers and 3,000 blue recyclable containers. The City determines the lowest overall bidder by multiplying the supplier’s unit price for each of the items by the estimated number of units for each item.

For the past twenty years, the City has exclusively specified rotationally molded carts due to their proven durability, long service life, and ability to withstand the heavy demands of residential and commercial collection routes under varying climate conditions. The Solid Waste Division’s operational history has shown that rotationally molded carts provide superior performance in resisting cracking, splitting, and premature failure, particularly under rough handling, hot or cold weather exposure, and with heavy organics loads. the City’s priority is ensuring maximum durability, longer field life, and reduced replacement cycles. These factors directly support the City’s long -term sustainability and cost-efficiency goals by minimizing the need for frequent cart replacements.

The three bids received are as follows:

The first and second lowest bids were deemed non -responsive, as the bid proposals failed to meet technical requirements. Staff find the bid proposal submitted by Toter, LLC to be acceptable and recommend approval of the contract for $787,756.90.

SCOPE OF WORK
BID NO. 25-26-04 ~ ANNUAL CONTRACT FOR REFUSE AND RECYCLING CARTS

1. INTENT
The City of Bakersfield is soliciting bids from qualified, experienced and reputable suppliers for providing REFUSE AND RECYCLING CARTS (refuse, green waste and recyclables) . The City may purchase carts from more than one supplier, depending on options selected by the city and made available by bidders. Supplier shall furnish and use, at his own expense, all materials, labor, tools, equipment, supplies and transportation to manufacture and provide the products required under the contract.

It is the City’s intent to contract to assure a continuing and reliable supply of carts (refuse, green waste and recycling) for the Solid Waste Division. The needs stated herein are those for new homes and businesses which may be developed, in addition to replacement of worn-out carts currently in service, wi th unknown levels of demand, and may be termed immediate, usual and common, of a casual quantity. However, estimated annual quantities are given solely as a basis for comparison of bids and are not to be construed as a guarantee of the materials or products to be purchased. The City reserves the right to increase or decrease quantities listed to meet the needs of the City during the period(s) of the contract.

Contract Term. The contract is expected to begin on or after September 24, 2025. The term of the contract shall be one (1) year . Contract may be renewed annually thereafter for four (4) consecutive one -year periods, at the City’s option and upon mutually agreeable terms.

Contract Renewal and Price Adjustment. It will be the responsibility of the Supplier to request contract renewal and a price adjustment and to provide all documentation necessary. The request for price adjustment must be submitted to the Purchasing Officer at least sixty (60) calendar days prior to the annual anniversary date of the contract. Requests filed after this time period may not be considered. The Purchasing Officer will review the request for increase and either grant or deny the request within twenty (20) calendar days of receip t of request. Any Agreement unit price changed as a result of this procedure shall become effective on the anniversary date of the Agreement and shall be binding on the Supplier for the ensuing renewal term or terms.

Annual adjustments shall be based on the following:

U.S. Department of Labor Producer Price Index (PPI) Series Id PCU3252113252111 for Plastics material and resin mfg., Thermoplastic resins and plastics materials, Base Date: 198012 (unadjusted figures) for the twelve-month period ending two (2) months prior to the end of the current term of the contract.

Price adjustments shall be calculated by applying the simple percentage method. This method is defined as dividing the Index value at time of calculation (latest version of the Index published as of the date of the request for price adjustment) by the Index value of base period (final published data of the Index for the base period at the time of bid or subsequent renewal periods), then multiplying the sum by the base price (price at time of award).

Index Value at time of Calculation x Price at Time of Award = Adjusted Price Index Value of Base Period

The City reserves the right to accept or reject any request for a price increase; however, the City will consider annual price increases only in cases when the Contractor’s commercial rates have changed for all customers served by the Bidder. The price change cannot apply only to services provided under this Agreement. Adjustments shall in no case exceed five percent (5%) unless very unusual and significant changes have occurred in the industry.

If the City approves the price increase, the price shall remain firm for one (1) year from the effective date of the price increase. If the City does not approve the price increase, the Contractor may terminate its performance under the Agreement upon thirty (30) days advance written notice to the Purchasing Officer. Termination of performance shall be the Contractor’s only remedy if the Purchasing Officer does not approve the price increase.

If the Contractor and the City do not agree on a price, using the procedure set forth above, the City may terminate the Agreement whether or not the City has previously elected to extend the term.

If at any time during the term of the Agreement a price decrease occurs, the Contractor shall submit a price decrease in accordance with the methodology prescribed herein. The price decrease shall become effective upon the City’s Purchasing Officer’s receipt of Contractor’s notice. Additionally, since the contract is operating on pricing resulting from the use of the Producer Price Index, the City reserves the right, at any time, to initiate a request for price decrease based upon the Producer Price Index.

2. CONTRACT REQUIREMENTS
The specifications included herein apply to rotationally molded linear or cross-linked plastic refuse containers and lids, including all hardware necessary for assembly. The City will consider only those firms capable of demonstrating compatibility of containers with "existing" automated and semi-automated collection equipment already installed and utilized by the City of Bakersfield; the City shall be the sole judge of compatibility . A sample cart (representative for each container type bid) is required for evaluation and testing (if deemed necessary) prior to bid submittal/acceptance.

Experience and References . Bidders must demonstrate that a minimum of fifty thousand (50,000) of the exact container type proposed for City purchase have been manufactured and are currently in use (refuse, green waste and recyclables containers may be counted to meet this requirement). Supplier shall provide a list of locations where carts are being serviced by automated refuse vehicles. In addition, Supplier shall provide three (3) references currently using refuse and green waste containers. One of the three (3) references must demonstrate a minimum of three (3) years’ experience with the product bid. All three (3) references must have a minimum of five thousand (5,000) of the proposed containers, utilizing the materials bid in current service; all pertinent information including name, address, and telephone number of all customers noted above shall be supplied with the bid.

Construction. All refuse, yard waste and recyclables containers shall be delivered complete and ready to assemble, and shall be shipped and delivered in a new, unused state. Containers shall be molded from a fully recyclable material supplied from a national petrochemical manufacturer; certification by manufacturer and prior approval of said material by the City is required. Assemblies, sub -assemblies, and com ponent parts shall be standard and interchangeable throughout the entire quantity of containers delineated in the bid.

Supplier warrants that all containers, lids and hardware meet all applicable industry and safety standards in design, use, balance, strength, weight and volume capacity. The weight capacity (limit) shall be clearly stamped on the lid of each container.

Testing and Inspection . City reserves the right to perform, or have performed, such inspections and testing as considered necessary to document that ASTM standards are achieved and assure the acceptability and suitability of containers, lids, and hardware. City may, at its optio n, have testing performed by an independent laboratory and the expense for such testing shall be borne by the City. Testing or inspections performed under this reservation shall not be considered a waiver of any right or breach of warranty.

Delivery Schedule. A minimum of four hundred (400) containers shall be delivered to the City of Bakersfield within thirty (30) days after issuance of order, with the balance to be delivered as needed. Other will be ordered as needed by truckload quantities.

Liquidated Damages. For all containers not delivered to the City of Bakersfield within the time schedule specified, the City will assess liquidated damages against the Supplier in the amount of fifty cents ($0.50) per undelivered container each day, excluding Saturdays, Sundays, and Federal Holidays. Liquidated damages, if any, will be assessed in accordance with the specified minimum delivery rates and will be deducted from any monies owed to Supplier.

Warranty. The word "container" is used in this specification to define a complete unit including lid and appurtenant hardware. All containers furnished shall be unconditionally (100%) warranted for minimum of ten (10) years after physical delivery and acceptance by the City. The unconditional warranty shall include, but not be limited to, such items as cracking, chipping, peeling, and other types of distortion; failures at attachment points for lids, hinges, or other points of attachment; weathering, degrading, defective or insufficient materials; poor workmanship on the part of manufacturer; lowered ultraviolet resistance during normal usage as the container ages, and placement of all warnings and directions for use upon the lid/container as specified. Defective containers, which are replaced under warranty provisions, sha ll be replaced as complete containers (including lid and hardware) within thirty (30) working days from notification of defect by the City. City may hold damaged containers until a suitable quantity is reached for efficient processing.

Supplier agrees to reimburse the City for any loss which may be incurred by the City incidental to the loading, shipping, and disposal of defective containers.

All costs, including shipping costs for delivery to Bakersfield, incurred in the replacement of said defective units or parts shall be fully borne by the Supplier. In addition to any warranty implied by fact or law, Supplier expressly warrants all items to be new, free from defect in design, materials, construction and workmanship, and to be fit and sufficient for their intended purpose.

Supplier shall not be responsible for damage or destruction caused by fire, vandalism, abuse, neglect, or acts of God after containers have been delivered and accepted.

Manufacturer’s Literature. Supplier shall be required to furnish a complete itemized parts list and assembly manual for containers. Supplier shall supply the names of all sublet vendors from which they procure finished parts or materials

used in the assembly of containers, including (but not limited to) springs and appurtenant hardware. All proposals shall include complete printed manufacturer specifications, published literature, and photographs or illustrations of units that the firm proposes to furnish. Any exception or variance from these specifications must be specifically identified as such in writing.

Patent and Copyright. Supplier shall be required to defend buyer at Supplier’s own expense in all suits, actions, or proceedings whether legal, administrative or in equity, in which buyer is made a defendant for actual or alleged infringement of any United States of America or foreign letters patent resulting from buyer’s use of the refuse containers purchased as a result of this request for proposals. Supplier further agrees to pay and discharge any and all judgments or decrees which may be rendered in any such suit, action, or proceeding against buyer. Supplier shall be required to indemnify, defend, and hold harmless the buyer from any and all license, royalty and proprietary fees or costs, including legal costs which may arise out of buyers purchase and use by City residents of refuse containers supplied by Supplier.

l. Cart Body Weight and Thickness Options: The City performs field tests on carts to determine the amount of deflection or distortion that occurs when the carts are compressed by the lifting arm. To prevent cart sidewall distortion from preventing carts from being fully emptied during the normal lift ing cycle, the City will consider optional bids which add additional wall thickness and or cart body weight to the basic model cart normally produced. (Bid Form Alternate #2) Bidders should include any available options to increase the wall thickness or cart body weight and the incremental price for each option.

m. Containers shall be designed to be picked up and dumped by a clasping arm mechanism that applies force at point approximately one-third (1/3) of the height below the top edge.

n. Containers shall be adequately designed to prevent sliding down through lifting arm when lifted and shaken in the upside-down position during emptying. • "Do not move with lid open." (Or "Move only when lid closed.")

p. Markings. Refuse carts shall be hot stamped on both sides with the City of Bakersfield "All America City" logo.

Green Waste and Blue Recycling carts shall be hot stamped on both sides with City of Bakersfield "Recycling" logos.

q. Decals. Street address identification is required on the cart lid; carts shall feature a minimum 4" x 10" location to allow markings for said purpose.

4. ADDITIONAL DESIGN SPECIFICATIONS – APPLICABLE TO AUTOMATED, VENTILATED ROLL -OUT GREEN WASTE CONTAINERS (Optional Bid Item #1)

Lower vents must be positioned in such a manner as to disallow the spillage of moisture when the cart is tipped, rolled, or dumped.

c. Wording. Additional to th e wording shown in Item 3-O above. Must be in both English and Spanish and shall be molded into the lids of each container reflecting the following:
• "Yard Waste Only."
• “Do not move with lid open." (Or "Move only with lid closed.")

ADMINISTRATIVE REPORT

MEETING DATE: October 8, 2025 AGENDA CATEGORY: Consent - Bids TO: Honorable Mayor and City Council
FROM: Randy McKeegan, Finance Director
DATE: September 30, 2025
SUBJECT: Accept bid from Allstar Fire Equipment ($109,936.17) for SEEK Thermal Imaging Cameras and Accessories for the Fire Department.

RECOMMENDATION:

Staff recommend acceptance of the bid.

BACKGROUND:

Bids were solicited for SEEK® Thermal Imaging Cameras and Accessories for the Fire Department. Three bids were received in response to solicitation.

Thermal imaging cameras (TICs) are vital tools for the Bakersfield Fire Department as they provide enhanced ability to protect lives, property, and firefighters in high-risk environments. These devices allow our firefighters to see through smoke, darkness, and other low-visibility conditions. The TICs significantly improve search and re scue operations by reducing the time it takes to locate victims in smoke -filled structures, directly increasing survival chances. They also aid our firefighters during fire attack by identifying the seat of the fire, detecting hidden hotspots, and revealing areas of fire spread that are not visible to the naked eye.

TICs play a critical role in firefighter survival. In zero -visibility conditions, these cameras provide orientation points, help locate safe egress routes, and allow firefighters to identify downed or disoriented crew members quickly. In a mayday situation, TICs can mean the difference between life and death, giving rapid visual confirmation of a firefighter’s location to accelerate rescue efforts.

Beyond fire suppression, these cameras are valuable in hazardous materials responses, where they allow our teams to monitor container integrity and identify leaks. By improving situational awareness, TICs provide an added layer of safety for the Bakersfield Fire Department personnel, reduce risk of disorientation, and ensure a more effective response. While TICs cannot see through walls, modern models deliver higher resolution, faster refresh rates, and rugged durability, making them an indispensable tool in fulfilling our mission.

The three bids received are as follows:

BIDDER AMOUNT Responsive (YES/NO)
Allstar Fire Equipment
Arcadia, CA $109,936.17 YES
Witmer Public Safety Group, Inc.

Coatesville, PA $111,787.00
NO – Bidder failed to
acknowledge Addendum
No. 1 which included a
revised bid form.

MES Services Company, LLC
Sandy Hook, CT $119,161.69
NO – Bidder failed to
acknowledge Addendum
No. 1 which included a
revised bid form.

The second and third highest bids were deemed non -responsive, as the bid proposals did not include an acknowledgement to Addenda issued which included a revised bid form. Staff find the bid proposal submitted by Allstar Fire Equipment to be acceptable and recommend approval of the purchase in the amount of $109,936.17.

FISCAL IMPACT:

On September 10, 202 5, Council approved the request to appropriate $10,000 in donated funds from Pacific Gas and Electric Company’s Charitable Giving Program to the Fire Departments General Operating budget for the purchase of thermal imaging cameras. The remaining balance of $99,936.17 will be initially covered by funds from the Fire Department’s General Fund Operating budget. However, these costs will be reimbursed through the California Firefighter Joint Apprenticeship Committee (Cal -JAC) reimbursement program. This state -funded program supports participating fire departments across California by helping offset training expenses and promoting professional development within the fire service.

FROM: Christian Clegg, City Manager
DATE: September 24, 2025
SUBJECT: Appropriate $710,000 Transient Occupancy Tax fund balance to the Community Facilities Capital Improvement Budget.
(Ward 2)

RECOMMENDATION:

Staff recommends approval of the appropriation.

BACKGROUND:

The Dignity Health Arena, Theater, and Convention Center’s current freestanding marquee has been in a state of disrepair for a few years, as the technology being used to operate it is obsolete and replacement parts are no longer available for the current system.

The bid and Agreement No. 2025 -147 with Sansi North America, LLC was approved by City Council on August 13, 2025. Sansi will replace and install a new digital freestanding LED Marquee outside the Dignity Health Arena, Theater, and Convention Center.

The City has sufficient profits from the Arena operations in Transient Occupancy Tax (TOT) funds to pay for the new Marquee without impacting the general fund. Staff recommends the appropriation of TOT funds to the Community Facilities Capi tal Improvement Budget to create a new Capital Improvement Project (CIP) and process vendor invoices to complete this project.

FISCAL IMPACT:

No impact to the general fund.

FROM: Jennifer M. Byers, Economic & Community Development Director DATE: September 11, 2025
SUBJECT: Agreement with Flood Ministries (not to exceed $250,000) for the Community Vitality Family Reunification Initiative
..

RECOMMENDATION:

Staff recommends approval of agreement

BACKGROUND:

On July 7, 2025, the City of Bakersfield released a Request for Proposals (RFP) from qualified agencies to conduct outreach and implement the Community Vitality and Family Reunification (CVFR) Initiative, a diversion-based program that would facilitate reuniting individuals who are experiencing homelessness or at imminent risk of experiencing homelessness, with family, friends, or other personal support networks by means of supportive services including but not limited to transportation. The CVFR Initiative aims to prevent and address homelessness in the region by improving strategic and efficient field responses to individuals in need of services and reducing the number of individuals who are discharged into homelessness from agencies such as incarceration institutions, medical facilities, and foster care. The initiative prioritizes reunifying individuals experiencing homelessness with care and family and loved ones within and outside the Continuum of Care’s (CoC) jurisdiction.

Three (3) proposals were received and scored based on the RFP criteria. The proposal submitted by Flood Bakersfield Ministries, Inc. (Flood ) was selected to administer the Community Vitality and Family Reunification Initiative to provide street outreach, supportive services, and family reunification in collaboration with City Code Enforcement’s Rapid Response Teams (RRT), and Bakersfield Police Department (BPD). If approved, Flood street outreach teams will accompany RRT and BPD t o calls for service, conduct triage and assessment, and/or connect clients to immediate resources such as sober living homes, detox, mental health services, shelters, short -term housing, as well as case -management and housing navigation.

MEETING DATE: October 8, 2025 AGENDA CATEGORY: Reports TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: October 1, 2025
SUBJECT: School Safety and Multi-Modal Traffic Safety Progress Report

[Document Description]

RECOMMENDATION:

Staff recommends Council receive and file report and presentations.

BACKGROUND:

City Council established t he Multi -Modal and Traffic Safety Committee to address growing concerns around transportation safety, accessibility, and sustainability within the community. As population density, development activity, and multimodal traffic volumes continue to rise, so does the need for a comprehensive, data-driven approach to traffic management and safety planning.

The committee brings together stakeholders from various departments, agencies, and community groups to ensure a coordinated and inclusive strate gy. Its scope encompasses all modes of transportation, including vehicular traffic, public transit, cycling, and walking. The committee also integrates Vision Zero principles to prioritize the reduction of traffic-related injuries and fatalities. Two stakeholders, who have been working with the City for improvements in these areas, are Blue Zones Project Bakersfield and the Bakersfield City School District . Both stakeholders have been present at committee meetings and all parties are working towards a stronger partnership in improving safety for students that walk and bike to school.

This report will be presented jointly by the City of Bakersfield staff, Chipman Junior High School staff and students, and other partners in the effort of Multi-modal Traffic Safety. This report will highlight possible solutions around Chipm an Junior High, potential programs and solutions in communicating pedestrian and bicycle safety, and an overview of multi-model related projects/accomplishments since the formation of the co mmittee. The committee remains committed to fostering a safe, connected, and equitable transportation network for all users.

FISCAL IMPACT:

There is no funding impact associated with this report; however, prior funding for Multi-Modal and Traffic Safety initiatives comes from various funding sources, including the Transportation Development Act Article 3, the Active Transportation Program, Congestion Mitigation and Air Quality Program, General Fund, and Public Safety and Vital Services (PSVS) Fund.
