RE: Letter Agreement - Renewal of Memorandum of Understanding Between the County of Kern and the City of Bakersfield Regarding Transfer of Tax Revenues Upon Annexation (“MOU”)
(City Agreement No. 15-277; Kern County Agreement No. 830 -215; and Kern County Agreement No. 587-2020)
Dear Sirs:
Reference is made to the MOU entered into on November 4, 2015, by and between the CITY OF BAKERSFIELD, a charter city of the State of California and a municipal corporation (hereinafter “CITY”) and the COUNTY OF KERN, a political subdivision of the State of California (hereinafter “COUNTY”). This Letter Agreement is made and entered into on __________________, 202 5, by and between CITY and COUNTY.
R E C I T A L S
WHEREAS, on November 4, 2015, CITY and COUNTY entered into the MOU to provide adjustments to the allocation of property taxes upon annexation between the parties; and
WHEREAS, on September 15, 2020, CITY and COUNTY entered into Kern County Agreement No. 587 -2020 to renew the MOU, effectively extending the term of the MOU for an additional period of five years ending November 4, 2025; and
WHEREAS, CITY and COUNTY recognize that it is important that any tax sharing arrangements between CITY and COUNTY should be determined in Renewal of MOU – City of Bakersfield and County of Kern
advance to facilitate sound planning for development and the provision of services as a result of that development; and
WHEREAS, CITY and COUNTY have worked together to develop a fair and equitable approach to tax sharing, maximizing locally available revenues; and
WHEREAS, CITY and COUNTY seek to align the interests of both jurisdictions in a way that promotes and financially encourages future development; and
WHEREAS, as provided for in this MOU, CITY and COUNTY intend to ensure the most timely, efficient and cost -effective delivery of services provided to the public; and
WHEREAS, pursuant to the provisions of Article 13, section 29(b) of the State Constitution, cities and counties are authorized to enter into contracts to apportion between them the revenue derived from any sales or use tax imposed by them pursuant to the Bradley -Burns Uniform Local Sales and Use Tax Law, provided that the contract is approved by two-thirds of both City Council and the Board of Supervisors; and
WHEREAS, the term of the MOU is set to expire on November 4, 202 5, and the parties now desire to extend the term of the MOU for an additional eighteen (18) months.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and COUNTY mutually agree as follows:
1. In accordance with Section 11 of the MOU entitled “Term of this MOU” the parties agree to extend the term of the MOU for an additional period of eighteen (18) months ending May 4, 2027, unless terminated by mutual written agreement of the CITY and COUNTY.
2. All other provisions of the original MOU (Agreement No. 15-277/Kern County Agreement No. 830-2015) shall remain in full force and effect.
