AMENDMENT NO. [3] TO
AGREEMENT NO. 2023-253
This AMENDMENT NO. 3 TO AGREEMENT NO. 2023-253 is made and entered into on ________________, by and between the CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY”), and J. L. PLANK INC., DBA CEN-CAL CONSTRUCTION a Corporation authorized to do business in California (referred to herein as “CONTRACTOR”).
R E C I T A L S
WHEREAS, on October 25, 2023 CITY and CONTRACTOR entered into Agreement No. 2023-253 for in the amount of $480,100 for canal liner repair services; and
WHEREAS, on June 26, 2024, Council approved Amendment No. 1, which increased compensation by $250,000 for a total amount of $730,100; and
WHEREAS, on October 23, 2024, Council approved Amendment No. 2 extending the Agreement’s term by one (1) year and increasing compensation by $730,100 for a total amount of $1,460,200; and
WHEREAS, the parties desire to enter into Amendment No. 3 to extend the term of the agreement by one (1) year to continue canal liner repair services; and
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows:
1. Section 12 of Agreement No. 2023-253 entitled “TERM.” is hereby amended to read as follows:
12. TERM. Unless terminated sooner, as set forth herein, CONTRACTOR shall provide services to term date of October 25, 2026.
2. Except as amended herein, all provisions of Agreement No. 2023- 253 shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 3 to Agreement No. 2023-253 to be executed the day and year first above written.
