FROM: Zachary Meyer, Public Works Director
DATE: October 7, 2025
SUBJECT: Consent to Common Use Agreement with Pacific Gas and Electric Company (PG&E) to allow the construction of a road over an existing 34” High Pressure Gas Pipeline within Tract 6880 (Ward 5).
RECOMMENDATION:
Staff recommend approval of the Common Use Agreement.
BACKGROUND:
Lennar Homes of California, LLC, through their land bank company TPG AG EHC III (LEN) CA 2, LP, has entered a common use agreement with the City of Bakersfield for the con struction of public improvements associated with Tract 6880 Phase 4. A key part of these improvements is the construction of Blackwater Valley Drive, which will cross over an existing large high -pressure gas pipeline owned by Pacific Gas & Electric Company (PG&E). Once completed, the public improvements will be maintained by the City of Bakersfield.
The improvement plans have been reviewed and approved by both the City and PG&E. In order to move forward with construction, the developer must obtain final permission from PG&E. To address this, PG&E has prepared a Consent to Common Use Agreement, which must be executed between the City and PG&E to allow the roadway to be built across their pipeline.
The Public Works Department has reviewed the common use agreement and is recommending that the City Council approve the agreement. This is the final step needed to comply with project requirements and allow the developer to proceed with construction of the improvements.
FISCAL IMPACT:
There will be no impact to th e City General Fund, as the proposed improvements will be bonded for by the developer and they will pay all required fees to PG&E for processing this agreement.
COUNCIL GOAL:
Reliable Infrastructure
