RECOMMENDATION:

Staff recommends adoption of the resolution

BACKGROUND:

On November 7, 1990, the City Council approved Ordinance No. 3327, which added Chapter 15.82 to the Bakersfield Municipal Code. The purpose of Chapter 15.82 is to promote the public interest by establishing and imposing a f ee as a method for financing the development, improvement, and/or enhancement of public parks. New residential construction is charged a fee for the development of new parks, the Park Development and Improvement Fee (Fee). Chapter 15.82.060 of the Bakersfi eld Municipal Code states the Recreation and Parks Director shall submit a proposed fee schedule (annual report) regarding the Fee amount to be collected for each new dwelling unit. This Fee shall be adjusted annually by the construction cost index (CCI). Also, the Fee schedule shall be further adjusted to reflect all costs incurred for park development, improvement, or enhancement. This Fee shall be adopted by resolution of the City Council following a noticed public hearing.

Staff regularly reviews the actual costs to develop a new park including amenities from both the Recreation and Parks Department and the Public Works Department. The last Fee adjustment was adopted by the City Council on November 06, 2024 with an effective date of January 1, 2025 . City Staff has calculated the proposed adjusted Fee based on the increase of 4.33% in the CCI - Los Angeles from July 2024 through July 2025 (Exhibit A) and the current actual cost to develop a new park. Staff recommends that the Fee be increased from the current $3,142.00 per residential unit to $3,278.00 per residential unit.

FISCAL IMPACT:

The Park Development and Improvement Fee are collected for future park sites within new residential tracts. The increase in the fee will help reduce funding gaps that currently occur in new park construction.
