ORDINANCES
Item 7.c.1 Ward Inclusion (Ward 2) This ordinance updates the City’s ward boundaries to incorporate Annexation No. 713 (South H No. 4) into Council Ward 2 following the Kern County LAFCo’s recording of the Certificate of Completion on September 26, 2025. The annexation, initiated by the property owner, encompasses approximately 0.673 acres at the northwest corner of South H Street and Cec il Brunner Drive. The property holds a General Plan designation of General Commercial and is pre -zoned as R -3 (Medium Density Multi-Unit Dwelling). The associated property tax revenue exchange is governed by the existing Master Tax Split Agreement between the City of Bakersfield and the County of Kern.

Item 7.c.3 Municipal Code Amendments (All W ards) City departments periodically propose minor updates to the Bakersfield Municipal Code (BMC) to align with current practices, correct typographical errors, or ensure compliance with new regulations. Staff recommends amendments to four sections: BMC Sections 17.10.020 and 17.12.020 to incorporate language agreed upon with the California Department of Housing and Community Development to support affordable housing, and BMC Sections 17.65.010 and 17.65.030 to update references to state law following California’ s creation of a separate Government Code chapter for accessory dwelling units and junior accessory dwelling units. These updates will not impact the City’s General Fund.

AGREEMENTS
Item 7.e.12 Mt. Vernon Recycling and Composting Facility (All Wards) In October 2023, the City issued a request for proposals for vendors to provide manual sorting services at the Mount Vernon Organics Recycling Facility (Facility) located at 2601 Mount Vernon Avenue and received two responses. After review, The Open Door Network was selected. Council has since approved the original agreement and the subsequent first amendment. Amendment No. 2 proposes extending the term to December 13, 2026, to continue recycling and sorting materials at the Facility. Payments to The Open Door Network will come from the Solid Waste Operations Budget, which is funded by the Refuse Enterprise. There is no impact to the General Fund associated with the agreement. In addition, approximately 60 percent of the cost will be reimbursed by Kern County per the City and County Green waste cost sharing agreement.

Item 7.e.13 Amendment to Agreement with CAPK (All Wards) In September 2021, the Department of Housing and Urban Development (HUD) allocated $5,458,039 to the City of Bakersfield in HOME -ARP funds. On November 20, 2024, the City Council approved Agreement No. 2024 -308 not to exceed $247,852 with Community Action Partnership of Kern (CAPK) in HOME -ARP funds to increase staffing for Coordinated Entry System (CES) services. HUD mandates CES for homelessness services programs. CES assists with creating an immediate response plan for unsheltered clients and increases access to temporary housing options and applies the whole person care service model . This Amendment will extend the term from November 30, 2025, to September 30, 2026, to allow CAPK to successfully expend its remaining HOME -ARP funds. The Amended Agreement only extends the term of the contract and does not add scope or cost, so there is no impact to the General Fund.
