DATE: November 5, 2025
SUBJECT: PFAS Treatment Program – Phase 1

2. Appropriate $800,000 of Litigation Revenue to Domestic Water Fund Capital Improvement budget.

RECOMMENDATION:

Staff recommend approval of agreement.

BACKGROUND:

The Water Department manages the City’s Municipal Water System and regularly utilizes professional engineering services for the design of wells, pumps, pipelines, and treatment systems.

Following the EPA’s April 26, 2024, release of the new National Prima ry Drinking Water Regulations (NPDWR) for PFAS/PFOA, the City identified several municipal wells requiring treatment to meet the new Maximum Contaminant Levels (MCLs) by April 26, 2029, ensuring continued compliance and protection of public health.

Item 1:

On August 19, 2025, the City issued a Request for Qualifications (RFQ) for the PFAS Treatment Program – Phase 1, which includes the design of six (6) City wells. On September 26, 2025, City received Statements of Qualifications (SOQs) from:

 Provost & Pritchard Consulting Group (Bakersfield, CA)  Dee Jaspar & Associates, Inc. (Bakersfield, CA)
 Pacific Advanced Civil Engineering, Inc. (Fountain Valley, CA)  Michael Baker International (San Diego, CA)

Through the review of consultant proposals and interview process, City staff recommend awarding the agreement to Provost & Pritchard Consulting Group for a 36-month term, not to exceed $726,301.

Item 2:

On June 05, 2023, City joined multi -district litigation no. 2873 (“MDL 2873”) against 3M, DuPont, and other PFAS/PFOA manufacturers to recover damages from PFAS/PFOA water contamination caused by these manufacturers. In 2024, the City reached a settlement in MDL 2873 permitting the recovery of capital costs to install treatment vessels at nine (9) City wells. To date, City has received $4,509,945.52 and additional settlement payments are expected.

At this time, Staff requests to appropriate $800,000 of the litigation revenue to the Domestic Water Fund Capital Improvement budget. This amount includes an additional 10% contingency to account for any out of scope items that may arise during the design of the six (6) wells.

FISCAL IMPACT:

Sufficient funds are budgeted in the Domestic Water Enterprise Fund capital improvement program for this agreement, therefore, there is no impact to the City General Fund for this consultant agreement.

COUNCIL GOAL:

Reliable Infrastructure
