Re: Zone Change No. 25-0001 for approximately 11.22 acres located on the north side of Camino Media, east of Old River Road. Also identified as Parcels H & I of P.M.W. No. 17-0426, Assessor Parcel Number s (APNS) 390-300-29 & 30. Located in a portion of Section 6, T30S, R27E, M.D.M. McIntosh & Associates Job No. 21-003.01
Please consider the following information provided, as justification for an exemption from the requirement to perform an independent traffic impact analysis f or the subject Zone Change. In August of 2021, Ruettgers and Schuler prepared a traffic evaluation for the General Plan Amendment and Zone Change No. 21-0302 from Office Commercial (OC) and Professiona l and Administrative Office Zone (C-O) to High Medium Density Residential (HMR) and Limited Multiple-Family Dwelling with PUD overlay (R-2/PUD). The project proposes to further revise the zoning on th e entire 11.22 gross acres to be consistent with th e revised City of Bakersfield municipal code Title 17 . The land use designation will remain High Medium Density Residential (HMR). The proposed zoning is for High Density Multi-Unit Dwelling Zone (R-4).

The attached Tables 1, 2 and 3 indicate updated tri p generation calculations using the “Institute of Transportation Engineers” Trip Generation Manual 11 th Edition for the proposed Zone Change. Table 1 indicates that the proposed zoning will result in a P.M. Peak Hour trip generation of 103 Trip Ends. For the A.M. Peak Hour, Table 3 indicates the proposed zoning will result in an A.M. Peak Hour trip generation of 82 Trip Ends. These trip generation numbers are le ss than the original traffic evaluation prepared by Ruettgers and Schuler. Table 2 indicates similar tr ip generation calculations for Daily Traffic volume s as compared to the previous analysis.

Since this proposed revision to the zoning will have less traffic than the current use, the project should be exempted from performing a detailed traffic impact analysis in accordance with the City’s “Methodology for Independent Assessment of Regional Impact Fees” . The project applicant would therefore like to request that the Regional Transportation Impact Fee (RTIF) fixed rate fee schedule be used for computation of required impact fees for the project.

P:\PROJECTS\21003.01-CAMTOWN\Studies\Traffic\2100301ts01.docx In 2013 SB 743 was passed by legislation and signed into law by the Governor of California, with the intent to change the evaluation of traffic impacts related to CEQA from Level of Service (LOS) to Vehicle Mil es Traveled (VMT). Under CEQA, agencies have the disc retion to adopt policies and thresholds based on a wide range of options and evaluation criteria. Caltrans and the Governor’s Office of Planning and Research recommends that projects exceeding a level of 15 pe rcent below the existing VMT per capita may be considered to have less than significant impacts.

For the purpose of this study, it was assumed the City of Bakersfield will adopt this same recommendation for VMT. Based on the original traffic evaluation, the KernCOG model showed an average regional VMT per trip of 9.76 miles for households, and an estimated VMT per trip of 4.89 for the project, 49% less than the average. Since the project will have similar trip data, travel patterns and trip destinations it is assumed that the VMT impacts under CEQA will still be less than significant, therefore no additional analysis is required.

Along with the above mentioned tables, attached is a copy of the proposed Zone Change exhibit map with the project area shown, the original traffic evaluation prepared by Ruettgers and Schuler, and the proposed site plan. Please contact us should you have any questions regarding this request for exemption.
