FROM: Kristina Budak, Water Director
DATE: December 9, 2025
SUBJECT: Amendment No. 2 to Settlement Agreement and Mutual Release with Rosedale Rio-Bravo Water Storage District

[Document Description]

RECOMMENDATION:

Staff recommend approval of the amendment.

BACKGROUND:

In 2019, a dispute arose between Rosedale Rio -Bravo Water Storage District (“RRBWSD”) and City concerning their respective rights and obligations under Agreement No. 76-80 regarding certain supplies of water from the Kern River that are referred to in 76 -80 as “Miscellaneous Quantity Water.” On December 11, 2019, RRBWSD filed a Complaint against City in Kern County Superior Court (BCV -19- 103483) (the “Action”). On December 06, 2021, RRBWSD amended its Complaint via its filing of its First Amended Complaint. City filed its Answer to RRBWSD’s First Amended Complaint in the Action in which City denied the material allegations in RRBWSD’s First Amended Complaint and asserted various affirmative defenses.

On July 01, 2022, City and RRBWSD settled the Action by entering an agreement titled Settlement Agreement and Mutual Release. As an inducement for settlement of the litigation, the Parties implemented a “Pilot Project” through calendar year 2024.

The Parties previously extended Pilot Project’s term for one (1) calendar year to December 31, 2025. The Parties now wish to extend the Pilot Project’s terms by two (2) calendar years to December 31, 2027. City Staff have no objection and support the approval of the amendment.

FISCAL IMPACT:

The action to a mend the agreement is only to extend the term and nothing related to additional costs.

Therefore, this has no fiscal impact on the General Fund.

COUNCIL GOAL:

Innovative and Efficient City Government
