ADMINISTRATIVE REPORT
MEETING DATE: December 17, 2025 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: November 21, 2025
SUBJECT: Amendment No. 1 to Agreement No. 2024-010
with NV5, Inc. (to revising the contractor’s schedule of hourly billing rates and extend the term of the agreement until March 31, 2026) to continue providing geotechnical and materials testing services for Capital Improvement Projects. All Wards
RECOMMENDATION:
Staff recommends approval of Amendment No.1.
BACKGROUND:
As part of the construction inspection process for the City’s Capital Improvement Program projects, various materials used in construction must be tested for compliance with the specific project’s specifications. The City does not have the staff or the equ ipment necessary to perform these test s or analysis. Therefore, the City enters into agreements with a local testing laboratory to provide required services.
On January 10, 2024, Council approved an on -call agreement with NV5, Inc. following a formal qualification-based selection process. This agreement provides geotechnical and materials testing services for calendar years 2024 and 2025, with a not-to-exceed compensation amount of $1,266,105.00
In order to maintain a level of service that align with t he ongoing demand for inspection services, staff recommends that the current agreement with NV5 Inc. be amended to extend the term of the agreement until March 31, 2026 this extension will ensure coverage and continuity for ongoing Capital Improvement Program (CIP) projects, particularly as many of these projects are expected to continue beyond the current contract end date of December 31, 2025.
The City is currently in the process of selecting new firms through a formal qualifications -based process.
However, it would be unfeasible to onboard a new firm in the middle or latter stages of active projects, as doing so could disrupt project momentum, reduce efficiency, and compromise the consistency of the materials testing and inspection services . Extending the agreement with NV5 Inc. will allow for a smoother transition and uninterrupted support until new contracts are in place and projects are completed.
FISCAL IMPACT:
There is no fiscal impact associated with this amendment, as it is sole ly a time extension. No additional appropriations are necessary, and any remaining services under the agreement will continue to be funded by budgeted Capital Improvement Projects
COUNCIL GOAL:
Reliable Infrastructure
